About the List of diseases and physical defects in the presence of which permission to acquisition of weapon is not issued to the citizen also the Procedure for passing by citizens of medical examination for acquisition of weapon

According to article 20 of the Law of the Republic of Tajikistan "About weapon" the Government of the Republic of Tajikistan decides:

1. Approve the List of diseases and physical defects in the presence of which permission to acquisition of weapon is not issued to the citizen (appendix 1).

2. Approve the Procedure for passing by citizens of medical examination for acquisition of weapon (appendix 2).

3. To the Ministry of Internal Affairs and the Ministry of Health and Social Protection of the Republic of Tajikistan to bring the regulatory legal acts into accord with this resolution.

Appendix 1

The list of diseases and physical defects in the presence of which permission to acquisition of weapon is not issued to the citizen

1. Mental and behavioural disturbances. Nervous diseases. Narcological diseases:

- organic frustration, including symptomatic, mental disturbances;

- schizophrenia, shizotipichesky and crazy frustration;

- frustration of mood (affective frustration);

- the neurotic frustration connected with stress and somatoformny frustration;

- the behavioural syndromes connected with physiological violations and physical factors:

- intellectual backwardness;

- frustration of the personality and behavior at mature age;

- disorders of psychological development;

- the behavioural and symptomatic frustration which developed at children's and teenage age;

- neurosises;

- epilepsy;

- multiple sclerosis;

- neuropathy of the taking-away nerve;

- mental and behavioural disturbances owing to the use of psychoactive agents (alcoholic drinks, narcotic, means, toksikomanichesky means).

2. Eye diseases:

- visual acuity with correction below 0,6 on one eye and below 0,4 on another or 0,8 on one eye in the absence of sight on another;

- permanent changes century, including their mucous;

- the paresis of muscles century interfering sight:

- the paresis of muscles of eyeball limiting it movements;

- resistant diplopiya;

- lack of binocular sight;

- restriction of field of vision more than on 20sh in any meridian;

- the chronic diseases of covers of eye which are followed by considerable malfunction of sight;

- lowering of visual acuity owing to resistant pomutneniye of the refracting circles or changes of eye bottom, anomalies of refractions, and also other reasons of organic nature;

- visual acuity with correction below 0,7 on the best eye, below 0,4 on the worst;

- short-sightedness and far-sightedness in case of admissible correction 6,0 of dioptries, including contact lenses (the amount of the sphere and the cylinder shall not exceed 6,0 of dioptries);

- difference in refraction of two eyes of more 2,0 of dioptries:

- diseases of retina and optic nerve (pigmentary retinit, atrophy of optic nerve, otsloyka of retina and another);

- glaucoma in the presence of decompensation, changes of sharpness and fields of vision;

- lack of sight on one eye, if visual acuity on the second eye of less 0,8 (without correction).

3. Disease of organs of hearing:

- conductive and neurotouch loss of hearing (complete deafness on one ear in case of perception of informal conversation on other ear at distance less than 3 meters, the shepotny speech at distance of one meter or in case of perception of informal conversation on each ear at distance less than 2 meters);

- the diseases of any etiology causing violations of functions of vestibular mechanism, nistagm (Menyer's disease, labirintit, vestibular crises of any etiology and another):

- spontaneous nistagm.

4. Consequences of injuries and orthopedic zabolevaniya*:

a) restrictions in case of use of short-barreled weapon of the gun and revolver:

- good-quality and malignant new growths, slow-moving hems, the expressed restriction of mobility of neck, resistant contractures in joints, incorrectly accrete changes, false joints, habitual dislocations, shortening of extremities which are followed by considerable traffic restriction in joints and complicate weapon handling;

- lack of prepotent hand * or its segments;

- lack of fingers or phalanxes, and also immovability in interphalanx joints;

- lack of thumb or two phalanxes of thumb on prepotent hand;

- absence or immovability of 2 and 3 fingers on prepotent hand;

- heavy contracture at least one finger with complete data of finger on prepotent hand;

- the severe forms of shortening of fingers complicating capture and weapon handling;

- absence and restriction of movements of 4 and 5 fingers on prepotent hand;

- other consequences of injuries and orthopedic diseases complicating capture and weapon handling.

b) in addition to paragraphs specified for use of long-barreled weapon are provided in the subitem "a", the following restrictions:

- absence or the deformations of one upper extremity or its segments complicating habitual weapon handling;

- any deformations and deformations of the upper extremities or segments complicating capture and fixing of weapon to body of middle part the second hand;

Notes:

* 1. Prepotent hand - for right-handed persons - right and for lefthanders - the left hand.

* 2. The restrictions specified in the 4th Item in case of use of the gun and revolver belong to prepotent hand, in case of the address of long-barreled weapon - to both hands.

Appendix 2

Procedure for passing by citizens of medical examination for acquisition of weapon

1. General provisions

1. The procedure for passing by citizens of medical examination for acquisition of weapon (further - the Procedure) determines procedure for passing of medical examination and receipt of the medical certificate, the list of the documents necessary for receipt of the medical certificate represented by citizens to medical institutions of the Ministry of Health and Social Protection of the Republic of Tajikistan, and also form and effective period of the medical certificate.

2. Procedure for passing by citizens of medical examination

2. Medical examination is performed by medical commissions, in the district / city centers of health. Said commission is created by heads of the centers of health.
