1. Approve the enclosed Instruction about procedure for realization of gemstones from fund of gemstones of the State fund of precious metals and gemstones of the Republic of Belarus to physical persons.

2. This resolution becomes effective since February 24, 2014.

The instruction about procedure for realization of gemstones from fund of gemstones of the State fund of precious metals and gemstones of the Republic of Belarus to physical persons

Chapter 1. General provisions

1. This Instruction determines procedure for realization by National Bank of the Republic of Belarus (further - National Bank) gemstones from fund of gemstones of the State fund of precious metals and gemstones of the Republic of Belarus to physical persons.

2. For the purposes of this Instruction following terms are used in the following values:

the certificate of quality on diamond - the document issued by National Bank determining characteristics and containing the main data on diamond. Forms of certificates of quality on diamond are forms of documents with certain degree of protection;

diamond - the facetted natural diamond having at least seventeen polished sides;

kaletta - the most lower part of diamond which can be in the form of point (thorn), side or the line;

carat - unit of mass of gemstones, equal 0,200 of gram;

crown - the part of diamond located between the plane of the platform and the upper plane of rundist;

the pavilion - the part of diamond located between the lower plane of rundist and kaletty;

the platform - the greatest single side of diamond on the area located in the center of crown;

rundist - the middle part of diamond representing the corbel covering the largest section of circle of diamond and dividing it on upper and lower speak rapidly.

The term "gemstones" is used in the value determined by the paragraph third article 1 of the Law of the Republic of Belarus of June 21, 2002 "About precious metals and gemstones" (The national register of legal acts of the Republic of Belarus, 2002, No. 73, 2/859).

3. For the purposes of this Instruction individual entrepreneurs do not treat physical persons.

4. The National Bank has the right to refuse to physical person realization of gemstones if it does not submit the identity document, in cases when the legislation provides obligatory data recording of the identity document of physical person.

5. The National Bank makes realization to physical persons of the diamonds having the certificate of quality on diamond (further - the certified diamonds). Realization of other gemstones to physical persons is not made.

Chapter 2. Procedure for realization to physical persons of the certified diamonds

6. Physical persons acquire the certified diamonds through central office and head departments of National Bank on areas.

7. On each certified diamond the certificate of quality on diamond in form according to appendix 1 to this Instruction is issued. The certificate of quality on diamond is the integral appendix to the diamond intended for realization.

8. The certified diamonds intended for realization to physical persons are packed into the extra packing ensuring safety of gemstones and impossibility of their withdrawal without its damage.

9. Information on procedure for realization of the certified diamonds and the prices of them, and also reference information on gemstones, including on high-quality and color characteristics, geometrical parameters and elements of gemstones, is located in a visible place in central office and head departments of National Bank on areas. Besides, information on the list of the certified diamonds exposed on realization and the prices of them is posted on the official site of National Bank on the global computer Internet.

10. The realization of the certified diamonds to physical persons is enabled in cash node or other isolated room ensuring safety of the certified diamonds and necessary working conditions with them.

11. The National Bank enables the realization of the certified diamonds to physical persons for Belarusian rubles with payment both in cash, and in non-cash form, including with use of bank payment cards. Use of foreign currency when carrying out calculations for the certified diamonds is performed according to the legislation.

The prices of the certified diamonds are established by National Bank in US dollars. Calculations in Belarusian rubles are made on the official rate of Belarusian ruble to the US dollar established by National Bank for date of realization.

12. In case of realization of the certified diamonds on clearing settlement (except payment cases with use of bank payment cards) the physical person submits the application in any form in which it enters surname, own name and middle name (if that is available), the name, amount of acquired gemstones in pieces and their weight in carats. The purchasing request of the certified diamonds can go by means of fax connection with the subsequent redispatching of the original by mail or transfer of the specified document when obtaining by physical person of the certified diamonds.

According to the accepted request the invoice for payment in non-cash form of the declared certified diamonds is issued to physical person.
