For the purpose of optimization of activities for regulation of number of wild animals in the protected natural territories of the state forest fund and according to part provision (1) article 5 of the Law on fauna No. 439-XIII of April 27, 1995 (The official monitor of the Republic of Moldova, 1995, Art. No. 62-63, 688), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on regulation of number of wild animals in the protected natural territories of the state forest fund it (is applied).

2. To impose control over the implementation of this Resolution on the Ministry of the environment and the National agency of safety of foodstuff.

Regulations on regulation of number of wild animals in the protected natural territories of the state forest fund

I. General provisions

1. The regulations on regulation of number of wild animals in the protected natural territories of the state forest fund (further - the Provision) provide taking measures to regulation of number of some animal species in all protected natural territories of the state forest fund for the purpose of public health care, protection of animals and plants and prevention of damage which can be caused to national economy, wild fauna and the circle of its dwelling in case of increase in number of some animal species and/or emergence of epizooty.

2. Measures for regulation of number of animals are applied in all protected natural territories of the state forest fund. Holding actions for regulation of number of some animal species is performed by means of the methods directed to maintenance of number of populations of all animal species at the level conforming to national and international ecological and scientific requirements without derogation at the same time of value of economic, cultural and recreational factors of the territory.

3. Regulation of number of some animal species in absolutely reserved zones of scientific reserves, in zone of wetlands of the international value and in zone A of national parks, including by the direction of beaters in these zones is forbidden.

4. Types and the number of the animals (number of copies) who are subject to regulation, and also procedure for application of measures of regulation affirm the Ministry of the environment based on the reasoned offers of the Moldsilva Agency in writing approved with Academy of Sciences of Moldova, and in case of epizooty - with the National agency on safety of foodstuff.

5. Activities for regulation of number of animals by the regulation methods established in subitems 1) - 5) Item 8, are performed based on the forest ticket issued according to Forest code provisions.

6. Monitoring and control of observance of this provision are performed by Inspectorate for environmental protection together with the Moldsilva Agency according to provisions of the Law on environmental protection No. 1515-XII of June 16, 1993 and the Forest code No. 887-XIII of June 21, 1996.

II. Methods of regulation of number of animals

7. Methods of regulation of number of animals include evidence-based actions in the protected natural territories of the state forest fund, the populations performed for the purpose of protection of health, prevention of threat for human life, protection against diseases of pets, for prevention of damage which can be caused to crops, wild fauna and the circle of its dwelling, and also losses which the national economy can incur. Also methods of regulation of number of animals include measures for reducing or maintenance of number of wild animals, for protection and recovery of natural ecosystems, for maintenance of ecological equilibrium, including urgent measures directed to withdrawal of aggressive copies from the protected natural territories of the state forest fund which pose real threat for life and human health.

8. The following methods of regulation of number of animals are established:

1) zhivootl and withdrawal from the environment of certain quantity of animals from some territories and settling by the corresponding type of other territories according to the recommendations developed by Academy of Sciences of Moldova and approved by the Ministry of the environment;

2) immobilization of animals which provides immobilization of wild animals and their moving to other territories of the state forest fund needing settling by this type according to the recommendations developed by Academy of Sciences of Moldova and approved by the Ministry of the environment;

3) movement of wild animals from the overpopulated protected territories by method enticing them into other nearby zones;

4) slaughter of animals in case of epizooty or suspicion of infectious diseases is performed by the Moldsilva Agency together with the National agency on safety of foodstuff, according to provisions of the Law on veterinary and sanitary activities No. 221-XVI of October 19, 2007;

5) withdrawal by shooting of animals in case of significant increase in their quantity is last resort and is performed only in case the methods listed in subitems 1), 2) and 3) are exhausted and the desirable result was not achieved.

III. Organization of activities for regulation of number of animals

9. Methods of regulation of number of animals are performed by the user of the protected territory of forest fund in the presence of the representative of Institute of zoology of Academy of Sciences of Moldova, Inspectorate for environmental protection and the veterinarian of the National agency for safety of foodstuff. Methods of regulation of number of animals are performed with observance of regulations and safe engineering.
