About approval of standards of the state services in the sphere of social protection of the population

According to the subitem 3) of article 6 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) standard of the state service "Purpose of Retirement Benefits from Authorized Organization";

2) standard of the state service "Purpose of the State Base Retirement Benefit";

3) standard of the state service "Purpose of the Public Social Benefits on Disability, on the occasion of Loss of the Supporter and on Age";

4) standard of the state service "Purpose of the Public Special Welfare Payments";

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective after ten calendar days after day of its first official publication.

Standard of the state service "Purpose of Retirement Benefits from Authorized Organization"

1. General provisions

1. The state service "Purpose of Retirement Benefits from Authorized Organization" (further - the state service).

2. The standard of the state service is developed by the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears territorial subdivisions of Committee on control and social protection of the Ministry (further - the service provider).

Reception of applications and issue of results of rendering the state service are performed through:

1) the Republican state state company "State Center for Pension Payment of the Ministry of Labour and Social Protection of the Population of the Republic of Kazakhstan" (further - GTsVP);

2) the web portal of "the electronic government" www.egov.kz (further - the portal) regarding receipt of information on purpose of retirement benefit.

2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package uslugopoluchatel in GTsVP - 10 (ten) working days;

on the portal - no more than 30 minutes from the moment of receipt of electronic request in information system GTsVP.

The term of rendering the state service is prolonged in cases of need of dooformleniye of case papers:

in case of doubts in reliability of the provided document(s) or reclamation of the additional document(s) - for the term of no more than 30 (thirty) working days, at the same time, if documents are completed, the state service is rendered within 10 (ten) working days from the date of provision of the additional document(s) in GTsVP. GTsVP notifies the applicant on need of submission of additional documents within 5 (five) working days;

in case of identification of the mistakes made by GTsVP - for 5 (five) working days, at the same time, if documents are completed, the state service is rendered within 10 (ten) working days from the date of their elimination;

2) the most allowed time of expectation for delivery of document package - 30 minutes;

3) the most allowed time of servicing of uslugopoluchatel in GTsVP - 30 minutes.

5. Form of rendering the state service: electronic (partially automated) and (or) paper.

6. Result of rendering the state service:

in GTsVP - the notification on purpose of retirement benefit;

on the portal - information on purpose of retirement benefit certified by the digital signature (further - the EDS) the service provider.

Form of provision of result of rendering the state service: electronic and (or) paper.

7. The state service is rendered free of charge.

8. Working schedule:

1) GTsVP - Monday through Friday inclusive from 9:00 till 18:00 o'clock, with lunch break from 13:00 till 14:00 o'clock, except days off and holidays according to the labor law of the Republic of Kazakhstan.

Acceptance of uslugopoluchatel: from 9:00 till 14:00 o'clock Monday through Saturday inclusive, at the same time from 13:00 till 14:00 o'clock and on Saturday from 9:00 till 14:00 o'clock acceptance is performed by duty experts.

The state service is rendered in turn, without making an appointment and the accelerated servicing;

2) the portal - round the clock (except for technical breaks in connection with carrying out repair work).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or his representative by proxy):

in GTsVP:

1) the statement in form according to appendix 1 to this standard of the state service;

2) the identity document (the identity certificate, the certificate of the stateless person, the residence permit of the foreigner), and also for oralmans - the certificate of the oralman;

3) the document confirming registration on the permanent residence of uslugopoluchatel (the address reference or the reference of rural akims, for inhabitants Baikonur the reference of department of accounting and registration of citizens of housing Baikonur of the Russian Federation);

4) data on bank account number in authorized organization for issue of pensions and benefits or the control account of cash of correctional facility;

5) the certificate of the organization (company) of the average monthly income from January 1, 1995 for any 3 years in a row, irrespective of work stoppages, in form according to appendix 2 to this standard of the state service;

6) for confirmation of working life of person having the right to retirement benefits are represented, depending on their availability, the following documents:

service record;

education document;

the military ID or the reference of managements and departments of areas and cities for defense;

the certificate of birth of children (either the birth record or certificate of registration of the act of civil status issued by bodies of civil registration) and one of the following documents of children:

identity certificate;

the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage;

the certificate about the termination of average educational institution;

the diploma about the termination of specialized secondary or higher educational institution, or the reference of educational institution confirming training;

the document confirming place of registration on the permanent residence of children;

the death certificate of children (or assembly record about death or the certificate of registration of the act of civil status issued by bodies of civil registration);

the certificate of tax authority of payment of insurance premiums in the Pension fund of the Republic of Kazakhstan for the period works till January 1, 1998 (when accounting years of service according to subitems 5) and 17) Item 1 of article 13 of the Law of the Republic of Kazakhstan of June 21, 2013 "About provision of pensions in the Republic of Kazakhstan");

certificate of rehabilitation;

certificate of military commissariat of participation in fighting;

the judgment confirming the fact of implementation and the period of care of the disabled person of the first group, the lonely disabled person of the second group and the retirement pensioner needing assistance, aged, reached eighty-year age, the disabled person aged up to 16 years who was injured from consequences of atomic testing, ecological disasters or infected with virus of immunodeficiency or sick AIDS;

the document confirming the accommodation fact in zones of extreme and maximum radiation risk from August 29, 1949 to July 5, 1963;

references from archival organizations or from place of employment if records about labor activity are not made in the service record or are available corrections;

the reference confirming accommodation abroad of the spouse (spouse) of employees of the former Soviet organizations, organizations of the Republic of Kazakhstan and the international organizations;

the reference confirming accommodation of the spouse (spouse) of the military personnel in areas where there was no employment opportunity;

the reference confirming accommodation of the spouse (spouse) of the employee of special state bodies in areas where there was no possibility of her (his) employment in the specialty;

the marriage certficate and (or) annulment of marriage or the statement from assembly record about the conclusion and (or) annulment of marriage or the certificate of registration of the act of civil status issued by bodies of civil registration (in case of change of surname);

in case of establishment of guardianship (guardianship), the document confirming establishment of guardianship (guardianship) is submitted;

the power of attorney - in case of filing of application and necessary documents the third parties.

Documents are submitted in originals and copies for reconciliation then originals of documents return to uslugopoluchatel;

on the portal:

request in electronic form, the uslugopoluchatel certified by the EDS.

When giving by uslugopoluchatel of all necessary documents:

1) in GTsVP - the detachable coupon of the statement with indication of registration date and the date of receipt of the state service, surname and initials of person who accepted documents is issued to uslugopoluchatel;

2) through the portal - in "private office" of uslugopoluchatel the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service is displayed.

3. Procedure for appeal of decisions, actions (failure to act) of the central state bodies, and also service providers and (or) his officials concerning rendering the state services

10. Appeal of decisions, actions (bezdeystviye) of the Ministry, the service provider and (or) his officials, GTsVP and (or) its workers concerning rendering the state services: the claim is submitted addressed to the head of the service provider, GTsVP to the address specified in Item 12 of this standard of the state service or addressed to the head of the Ministry, to the address: 010000, city of Astana, Ulitsa Orynbor, house No. 8, entrance 6, phone: 8 (7172) 74-37-23, 74-33-65, 74-28-41.

The claim is submitted in writing by mail or purposely through office of the service provider, or the Ministry, in the working days.

Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider, or the Ministry, with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint. After registration the claim goes to the head of the service provider, or the Ministry, for determination of the executive in charge and acceptance of adequate measures.

The claim of uslugopoluchatel which arrived to the service provider, the Ministry is subject to consideration within 5 (five) working days from the date of its registration.

In case of the address through the portal information on procedure for appeal can be obtained by phone single contact center: 1414.

When sending the claim through the portal information on the address which is updated during processing of the address by the service provider is available to uslugopoluchatel from "private office" (mark about delivery, registration, execution, the answer about consideration or refusal in consideration).

In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 (fifteen) working days from the date of its registration.

11. In disagreement cases with results of the rendered state service, the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

4. Other requirements taking into account features of rendering the state service including rendered electronically

12. Addresses of places of rendering the state service are placed on Internet resource of the Ministry: www.enbek.gov.kz, Section "State Services".

13. Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.

14. Uslugopoluchatel has possibility of receipt of information on the status of rendering the state service in the mode of remote access by means of "private office" of the portal, service desks of the service provider, and also single contact center concerning rendering the state services.

15. Contact telephone numbers of service desks concerning rendering the state service: 8 (7172) 24 07 49, 24 12 91. Single contact center concerning rendering the state services: 1414.

1. General provisions

1. The state service "Purpose of the State Base Retirement Benefit" (further - the state service).

2. The standard of the state service is developed by the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears territorial subdivisions of Committee on control and social protection of the Ministry (further - the service provider).

Reception of applications and issue of results of rendering the state service are performed through:

1) the Republican state state company "State Center for Pension Payment of the Ministry of Labour and Social Protection of the Population of the Republic of Kazakhstan" (further - GTsVP);

2) the Republican state company on the right of economic maintaining "Service center of the population" of Committee on control of automation of the state services and coordination of activities of service centers of the population of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - TsON) - in case of primary request for purpose of the state base retirement benefit;

3) the web portal of "the electronic government" www.egov.kz (further - the portal) regarding receipt of information on purpose of the state base retirement benefit.

2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package uslugopoluchatel in GTsVP or in TsON - 10 (ten) working days;

on the portal - no more than 30 minutes from the moment of receipt of electronic request in information system GTsVP.

The term of rendering the state service is prolonged in cases of need of dooformleniye of case papers:

in case of doubts in reliability of the provided document(s) or reclamation of the additional document(s) - for the term of no more than 30 (thirty) working days, at the same time, if documents are completed, the state service is rendered within 10 (ten) working days from the date of provision of the additional document(s) in GTsVP or TsON. GTsVP notifies the applicant on need of submission of additional documents within 5 (five) working days;

in case of identification of the mistakes made by GTsVP or TsON - for 5 (five) working days, at the same time, if documents are completed, the state service is rendered within 10 (ten) working days from the date of their elimination;

3) the most allowed time of servicing of uslugopoluchatel in GTsVP - 30 minutes, in TsON - 15 minutes.

5. Form of rendering the state service: electronic (partially automated) and (or) paper.

6. Result of rendering the state service:

in GTsVP or TsON - the notification on purpose of the state base retirement benefit;

on the portal - information on appointment or on refusal in purpose of the state base retirement benefit goes to uslugopoluchatel to "private office" in electronic form, certified by the digital signature (further - the EDS) the authorized person of the service provider.

Form of provision of result of rendering the state service: electronic and (or) paper.

7. The state service is rendered free of charge.

8. Working schedule:

1) GTsVP - Monday through Friday from 9:00 till 18:00 o'clock, with lunch break from 13:00 till 14:00 o'clock, except days off and holidays according to the labor law.

Acceptance of uslugopoluchatel: from 9:00 till 14:00 o'clock Monday through Saturday inclusive, at the same time from 13:00 till 14:00 o'clock and on Saturday from 9:00 till 14:00 o'clock acceptance is performed by duty experts.

The state service is rendered in turn, without making an appointment and the accelerated servicing;

2) TsONa - Monday through Saturday inclusive, in compliance the working schedule from 9:00 to 20:00 o'clock without interruption for lunch, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

Acceptance is performed according to the procedure of "electronic queue", without making an appointment and the accelerated servicing.

In case of desire of uslugopoluchatel "booking" of electronic queue by means of the portal is possible;

3) the portal - round the clock (except for technical breaks in connection with carrying out repair work).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or his representative by proxy):

in GTsVP or in TsON:

1) the statement in form according to appendix to this standard of the state service;

2) the identity document of uslugopoluchatel (the identity certificate, the certificate of the stateless person, the residence permit of the foreigner), and also for oralmans - the certificate of the oralman;

3) the document confirming registration on the permanent residence of uslugopoluchatel (the address reference or the reference of rural akims, for inhabitants Baikonur the reference of department of accounting and registration of citizens of housing Baikonur of the Russian Federation);

4) data on bank account number in authorized organization for issue of pensions and benefits or the control account of cash of correctional facility;

5) in case of establishment of guardianship (guardianship), the document confirming establishment of guardianship (guardianship) is submitted;

6) the power of attorney - in case of filing of application and necessary documents the third parties.

Documents are submitted in originals and copies for reconciliation then originals of documents return to uslugopoluchatel.

Submission of copies of the identity documents of uslugopoluchatel confirming registration on the permanent residence is not required in case of confirmation of information containing in the specified documents the state information systems;

on the portal: request in electronic form, the uslugopoluchatel certified by the EDS.

When giving by uslugopoluchatel of all necessary documents to uslugopoluchatel it is issued:

in GTsVP - the detachable coupon of the statement with indication of registration date and the date of receipt of the state service, surname and initials of person who accepted documents;

in TsONe - the receipt on acceptance of the relevant documents with indication of:

1) statements with indication of number and date of reception of an application;

2) type of required state service;

Appeal of decisions, actions (bezdeystviye) of the Ministry, the service provider and (or) his officials, GTsVP, TsON and (or) its workers concerning rendering the state services: the claim is submitted addressed to the head of the service provider, GTsVP, TsON to the address specified in Item 14 of this standard of the state service or addressed to the head of the Ministry of the address: 010000, city of Astana, Ulitsa Orynbor, house No. 8, entrance 6, phone: 8 (7172) 74-37-23, 74-33-65, 74-28-41.
