AGREEMENT BETWEEN THE GOVERNMENT OF THE RUSSIAN FEDERATION AND GOVERNMENT OF THE REPUBLIC OF ARMENIA

About cooperation in the field of supply of natural gas, oil products and the rough natural diamonds to the Republic of Armenia

The government of the Russian Federation and the Government of the Republic of Armenia which further are referred to as with the Parties

in view of long-term interests of two states in development of cooperation,

being guided by the Treaty of friendship, cooperation and mutual aid between the Russian Federation and the Republic of Armenia of August 29, 1997,

in view of the Agreement between the Government of the Russian Federation and the Government of the Republic of Armenia on encouragement and mutual protection of capital investments of September 15, 2001,

expressing interest of the states of the Parties in settlement of mutual cooperation in the field of supply of natural gas, oil products and the rough natural diamonds to the Republic of Armenia,

in view of the Decision of the Supreme Eurasian economic council of October 24, 2013 about accession of the Republic of Armenia to the Customs union and the Common economic space of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation, the Statement of heads of the Republic of Belarus, the Republic of Kazakhstan, the Russian Federation and the Republic of Armenia of October 24, 2013 about participation of the Republic of Armenia in Eurasian integration process, and also the Memorandum of deepening of interaction between the Republic of Armenia and the Eurasian economic commission of November 6, 2013,

in view of the Agreement on creation of single customs area and forming of the Customs union of October 6, 2007, and also the legal base of the Common economic space,

agreed as follows:

Article 1

1. The purpose of this agreement is determination of conditions of cooperation of the Parties in the field of deliveries of goods from the Russian Federation to the Republic of Armenia.

2. For the purposes of this agreement goods are recognized:

1) the goods developed from oil;

2) natural gas in gaseous state;

3) the natural rough diamonds (codes of the Single commodity nomenclature of foreign economic activity of the Customs union (further - FEACN CU): 7102 21 000 0 and 7102 31 000 0).

Article 2

1. Coordination of activities and control of execution of this agreement are exercised by the following competent authorities:

from the Russian Side - the Ministry of Energy of the Russian Federation (regarding deliveries of the goods specified in subitems 1 and 2 of Item 2 of Article 1 of this agreement) and the Ministry of Finance of the Russian Federation (regarding deliveries of the goods specified in the subitem 3 of Item 2 of Article 1 of this agreement);

from the Armenian Side - the Ministry of Energy and Natural Resources of the Republic of Armenia (regarding deliveries of the goods specified in subitems 1 and 2 of Item 2 of Article 1 of this agreement) and the Ministry of Economics of the Republic of Armenia (regarding deliveries of the goods specified in the subitem 3 of Item 2 of Article 1 of this agreement).

2. In case of replacement of the competent authorities of the Party without delay notify on this each other through diplomatic channels.

3. For the purposes of this agreement are understood as customs authorities of the Parties:

for the Russian Federation - the Federal Customs Service;

for the Republic of Armenia - Committee of state revenues under the Government of the Republic of Armenia.

Article 3

1. Competent authorities of the Parties prior to the beginning of each calendar year approve amounts and the nomenclature of internal consumption in the Republic of Armenia of the goods specified in subitems 1 and 2 of Item 2 of Article 1 of this agreement the next calendar year and approve indicative balances the next calendar year by deliveries to the Republic of Armenia of these goods (further - indicative balances).

2. The diamond-mining companies of the Russian Federation and Public institution for forming of the State fund of precious metals and gemstones of the Russian Federation, storage, leave and use of precious metals and gemstones (Gokhran of Russia) under the Ministry of Finance of the Russian Federation deliver to the lapidary companies of the Republic of Armenia the rough natural diamonds according to the procedure and amounts which are established in the relevant contracts between the specified business entities of the Russian Federation and the Republic of Armenia.

Article 4

The parties create conditions for implementation by business entities (residents) of the states of the Parties of deliveries of goods from the territory of the Russian Federation to the Republic of Armenia.

Article 5

1. Concerning goods delivered from the Russian Federation to the Republic of Armenia in the internal consumption approved as a part of indicative balances (for the goods specified in subitems 1 and 2 of Item 2 of Article 1 of this agreement), and also concerning the goods specified in the subitem 3 of Item 2 of Article 1 of this agreement, the Russian Side does not collect export customs duties.

2. Concerning the goods specified in subitems 1 and 2 of Item 2 of Article 1 of this agreement exported from the Russian Federation to the Republic of Armenia in calendar year over the quantity provided by indicative balances this calendar year, export customs duties are subject to payment in the budget of the Russian Federation in accordance with the legislation of the Russian Federation and the customs legislation of the Customs union.

3. Concerning goods delivered from the Russian Federation to the Republic of Armenia without collection of export customs duties, the customs authority of the Russian Federation records the amounts of conditionally added export customs duties the accruing result from start date of application of this agreement.

Conditionally added export customs duties for the purpose of this agreement are understood as the amount of export customs duties calculated proceeding from amounts of actually exported goods and rates of the export customs duties established in accordance with the legislation of the Russian Federation and operating during the actual commodity exportation (in US dollars).

Accounting of conditionally added export customs duties is performed separately concerning each goods, and also the goods classified by the FEACN CU separate code.
