About approval of regulations of the state services in questions of civil registration and apostilization"

(as amended of the Order of the Minister of Justice of the Republic of Kazakhstan of 19.06.2014 No. 215)

For the purpose of implementation of the subitem 2) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", PRIKAZYVAYU:

1. Approve enclosed:

1) Regulations of the state service "Registration of the Birth, including Modification, Amendments and Corrections in Civil Registration" according to appendix 1 to this order;

2) Regulations of the state service "Registration of Marriage (Matrimony), including Modification, Amendments and Corrections in Civil Registration" according to appendix 2 to this order;

3) Regulations of the state service "Issue of Repeated Certificates or Certificates of Civil Registration" according to appendix 3 to this order;

4) Regulations of the state service "Paternity Proof Registration, including Modification, Amendments and Corrections in Civil Registration" according to appendix 4 to this order;

5) Regulations of the state service "Registration of Change of Name, Middle Name, Surname, including Modification, Amendments and Corrections in Civil Registration" according to appendix 5 to this order;

6) Regulations of the state service "Recovery of Civil Registrations" according to appendix 6 to this order;

7) Regulations of the state service "Registration of Death, including Modification, Amendments and Corrections in Civil Registration" according to appendix 7 to this order;

8) Regulations of the state service "Registration of Adoption (Adoption), including Modification, Amendments and Corrections in Civil Registration" according to appendix 8 to this order;

9) Regulations of the state service "Registration of Annulment of Marriage (Matrimony), including Modification, Amendments and Corrections in Civil Registration" according to appendix 9 to this order;

10) Regulations of the state service "Apostilization of the Official Documents Coming from Judicial Authorities and Other State Bodies, and also Notaries of the Republic of Kazakhstan" according to appendix 10 to this order.

2. Recognize invalid:

1) subitems 5), 6), 7), 8), 9), 10) Item 1 of the order of the Minister of Justice of the Republic of Kazakhstan of November 29, 2012 No. 389 "About approval of regulations of electronic state services" (it is registered in the Register of state registration of regulatory legal acts for No. 8133);

2) Item 1 of the order of the Minister of Justice of the Republic of Kazakhstan of November 29, 2012 No. 390 "About approval of regulations of the state services in the sphere of civil registration and about introduction of amendments to the order of the Minister of Justice of the Republic Kazakhstan of June 27, 2011 No. 235 "About approval of regulations of the state services"" (it is registered in the Register of state registration of regulatory legal acts for No. 8134).

3. To impose control of execution of this order on the Chairman of Committee of registration service and rendering the Ministry of Justice of the Republic of Kazakhstan to legal assistance Abishev B. Sh.

4. To provide to committee of registration service and rendering legal assistance in the procedure established by the legislation state registration of this order and its official publication.

5. This order becomes effective after ten calendar days after day of its first official publication.

Appendix 1

to the Order of the Minister of Justice of the Republic of Kazakhstan of January 30, 2014 No. 36

Regulations of the state service "Registration of the Birth, including Modification, Amendments and Corrections in Civil Registration"

1. General provisions

1. These Regulations of the state service "Registration of the Birth, including Modification, Amendments and Corrections in Civil Registration" are developed based on the Standard of the state service "Registration of the Birth, including Modification, Amendments and Corrections in Civil Registration" approved by the order of the Government of the Republic of Kazakhstan of December 31, 2013 No. 1559 (further - the Standard).

The state service "Registration of the Birth, including Modification, Amendments and Corrections in Civil Registration" (further - the state service) appears territorial authorities of justice (further - service providers).

Reception of applications and issue of result of rendering the state service is performed on alternative basis through:

service provider;

The republican state company on the right of economic maintaining "Service center of the population" of Committee on control of automation of the state services and coordination of activities of service centers of the population of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - the center);

web portal of "the electronic government": www.e.gov.kz (further - the portal).

2. Form of rendering the state service: electronic (partially automated) and (or) paper.

3. Result of rendering the state service:

1) at the service provider:

registration of the birth and issue of the registration certificate of the birth on paper in case of presentation of the identity document;

issue of the new certificate with the made changes, amendments and corrections, ratified the service provider who issued the paper document in case of presentation of the identity document.

2) in the center:

issue of the certificate of birth on paper, in case of presentation of the identity document;

issue of the new certificate with the made changes, amendments and corrections, ratified the service provider who issued the paper document in case of presentation of the identity document.

3) on the portal - the notification on acceptance of the electronic statement and setting a date on registration of the birth in electronic form certified the electronic and digital signature (further - the EDS) the authorized person of the service provider.

2. The description of operations procedure of structural divisions (workers) of the service provider in the course of rendering the state service

4. The basis for the procedure (action) for rendering the state service is receipt by the service provider of the statement and necessary documents for rendering the state service from uslugopoluchatel or electronic request of uslugopoluchatel, stipulated in Item 9 Standards.

Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.

5. Procedures (action) which are part of process of rendering the state service:

1) documents acceptance by the specialist of the service provider or employee of the center and registration of a statement;

2) consideration of the application and verification of the submitted documents by the specialist of the service provider;

3) registration of result of rendering the state service by the specialist of the service provider;

4) issue of result of rendering the state service to uslupoluchatel or employee of the center.

3. The description of order of interaction of structural divisions (workers) of the service provider in the course of rendering the state service

6. The list of the structural divisions of the service provider participating in process of rendering the state service:

employee of office of the service provider;

head of the service provider;

head of department of civil registration and apostilization of the service provider;

specialist of department of civil registration and apostilization of the service provider;

7. The description of the sequence of procedures (actions) between structural divisions (workers) of the service provider:

1) the employee of office of the service provider after receipt of the statement and necessary documents for rendering the state service carries out registration in the Single system of electronic document management of the service provider, puts on control according to term, and submits stipulated in Item 4 Standards to the head of the service provider;

2) the head of the service provider according to the resolution writes the statement of uslugopoluchatel to the head of department of civil registration and apostilization or the specialist of department of civil registration and apostilization (in territorial authorities of justice where unit of the head of department is not provided) for execution;

3) the specialist of department of civil registration and apostilization checks the submitted documents for compliance to Item 9 of the Standard, and also to the Code of the Republic of Kazakhstan "About scrap (matrimony) and family";

4) after check and the analysis of the submitted documents the specialist of the service provider in information system the registration Item "Record of the Act of Civil Status" creates assembly record, performs registration and prints out the appropriate certificate about registration of the act of civil status;

The specialist of the service provider gives 5) after forming of the appropriate certificate about registration of the act of civil status to the signature to the head of the service provider, then the official stamp of the service provider is set the registration certificate of the act of civil status;

6) the ready registration certificate of the act of civil status is transferred to uslugopoluchatel based on the receipt or to the employee of the center according to the register under list.

The statements arriving from the center in information system of state bodies is not registered.

8. Documents acceptance and issue of result of rendering the state service is performed by the service provider - Monday through Friday inclusive from 9:00 till 18:30 o'clock, break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

The state service is rendered in turn, without making an appointment and the accelerated servicing;

9. Terms of rendering the state service are stipulated in Item 4 Standards.

In case of acceptance of necessary documents for rendering the state service through the service provider the receipt is issued to uslugopoluchatel with indication of:

1) dates of reception of an application;

2) the number of the enclosed documents;

3) dates, time of issue of documents;

4) surnames, name, middle name of the specialist who adopted the statement on document creation.

10. The description of the sequence of procedures between specialists of the service provider is provided in the table according to appendix 1 to these Regulations.

4. The description of order of interaction with service center of the population and (or) other service providers, and also procedure for use of information systems in the course of rendering the state service

11. Documents acceptance and issue of result of rendering the state service is performed in the center - Monday through Saturday inclusive from 9:00 to 20:00 o'clock without interruption, except days off and holidays, according to the labor law of the Republic of Kazakhstan and according to the established working schedule.

The state service is rendered according to the procedure of "electronic" queue, without the accelerated servicing, possibly booking of electronic queue by means of the portal.

In case of acceptance of necessary documents for rendering the state service through the center the receipt on acceptance of the relevant documents is issued to uslugopoluchatel with indication of:

1) numbers and dates of acceptance of request;

2) type of required state service;

3) quantities and the name of the enclosed documents;

4) date (time) and place of issue of documents;

5) surnames, name, middle name of the employee of the center which adopted the statement on document creation;

6) surnames, name, middle name of uslugopoluchatel, surname, name, middle name of the authorized representative and their contact telephone numbers.

If registration was made after 2008, the employee of the center receives data on identity documents of uslugopoluchatel, and also registration certificates of acts of civil status from the corresponding state information systems in the form of the electronic documents certified by the EDS of authorized persons of state bodies.

The employee of the center verifies authenticity of originals of documents with the data provided from the state information systems of state bodies then returns originals to uslugopoluchatel.

In case of provision by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 Standards, the employee of the center refuses reception of an application and issues the receipt on refusal in documents acceptance in form according to appendix 3 to the Standard.
