About formation of the Agency on promotion of investments under the Ministry of Economics of the Kyrgyz Republic

For the purpose of ensuring activization of process of attraction of foreign investments to the Kyrgyz Republic, increase in efficiency of their use, being guided by articles 10 and 25 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Create Agency on promotion of investments under the Ministry of Economics of the Kyrgyz Republic (further - the Agency).

2. Approve the enclosed Regulations on the Agency.

3. Establish the extreme number of staff of employees of the Agency in number of 21 units (without serving and technicians).

4. Bring in the order of the Government of the Kyrgyz Republic "About the extreme number of staff of the ministries, administrative departments and other state bodies of the Kyrgyz Republic" of August 22, 2011 No. 473 the following change:

in Item 6 of appendix 1 to the above-stated resolution of figure "340" and "96" to replace with figures respectively "361" and "117".

5. Bring in the order of the Government of the Kyrgyz Republic "Questions of the Ministry of Economics of the Kyrgyz Republic" of February 20, 2012 No. 117 the following amendment:

- to add the scheme of management of the Ministry of Economics of the Kyrgyz Republic approved by the above-stated resolution with line item of the following content:

"Agency on promotion of investments".

6. To the Ministry of Finance of the Kyrgyz Republic in accordance with the established procedure to provide in case of development of the bill of modification and amendments in the Law of the Kyrgyz Republic "About the republican budget of the Kyrgyz Republic for 2014 and the forecast for 2015-2016" funds for content of the Agency.

7. To the Ministry of Economics of the Kyrgyz Republic in three-months time to resolve the organizational technical issues connected with formation of the Agency.

8. This resolution becomes effective from the date of official publication. 

9. To impose control of execution of this resolution on department of economy and investments of Government office of the Kyrgyz Republic.

Regulations on the Agency on promotion of investments under the Ministry of Economics of the Kyrgyz Republic

1. General provisions

1. The agency on promotion of investments under the Ministry of Economics of the Kyrgyz Republic (further - the Agency) is the subordinated division of the Ministry of Economics of the Kyrgyz Republic providing attraction and promotion of direct investments in economy of the Kyrgyz Republic.

2. The agency in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic which came in the procedure established by the law into force international treaties which participant is the Kyrgyz Republic, and this Provision.

3. Full name of the Agency:

- in state language: "Kyrgyz Respublikasynyn Ekonomika ministrliginin Investitsiyalarda's aldyndaga to ilgeriletu of boyunch mamlekettik agenttik";

5. The agency is legal entity and has emblem, seal with the image of the State Emblem of the Kyrgyz Republic and the name, forms, stamps, settlement and other accounts in national and foreign currency in bank institutions of the Kyrgyz Republic.

6. The agency has the isolated property, can acquire on its own behalf property rights and appear the claimant and the defendant in court.

2. Purpose and tasks of the Agency

7. The purposes of the Agency are attraction and promotion of direct investments in economy of the Kyrgyz Republic in cooperation with state bodies, local government bodies, business community and the non-state sector.

8. Tasks of the Agency are:

- participation in development and implementation of measures for stimulation of investment activity;

- ensuring interaction of state bodies, local government bodies, business communities and the non-state sector on realization and maintenance of investing programs and projects in the sphere of public-private partnership and private investments in the territory of the Kyrgyz Republic;

- development of the international and interregional foreign economic relations of the Kyrgyz Republic, regarding investment attraction;

- assistance of diversification of economy of the Kyrgyz Republic by development of recommendations for investment attraction to priority sectors of economy.

3. Functions of the Agency

9. The agency according to the assigned tasks performs the following functions:

- carrying out consultations, meetings, seminars, conferences, exhibitions, presentations and fairs of investing programs and projects;

- preparation, the edition and distribution among potential investors of information on investment opportunities and conditions of business activity in the Kyrgyz Republic;

- rendering assistance to domestic enterprises in search of foreign investors and in the conclusion of contracts with foreign investors;

- rendering assistance to foreign investors within the competence;

- implementation of preparation and promotion of projects of public-private partnership;

- holding organizational, information and advertizing activities on investment attraction in the country and abroad;

- establishment of contacts and participation in negotiation with potential foreign investors for the purpose of attraction them for implementation of investment projects in the Kyrgyz Republic;

- carrying out target search of investors, proceeding from priorities of investment policy;

- conducting examination of investment proposals of foreign investors on the basis of economic feasibility of projects, contribution to development of economy by regions.
