About the Statement of the Verkhovna Rada of Ukraine in connection with stop of action of the Decision of the Verkhovna Rada of the Autonomous Republic of Crimea of March 6, 2014 about carrying out on March 16, 2014 the all-Crimean referendum
Considering that on March 6, 2014 the Verkhovna Rada of the Autonomous Republic of Crimea makes the decision on holding on March 16, 2014 the all-Crimean referendum and inclusion of the Autonomous Republic of Crimea in structure of the Russian Federation as her subject, the Verkhovna Rada of Ukraine declares:
1. Due to the stop the acting president of Ukraine Turchynov A. V. according to the Constitution of Ukraine of action of the decision of the Verkhovna Rada of the Autonomous Republic of Crimea of March 6, 2014 about holding the all-Crimean referendum on March 16, 2014 the Verkhovna Rada of Ukraine states that the specified decision of the Verkhovna Rada of the Autonomous Republic of Crimea contradicts provisions of the Constitution of Ukraine, namely:
Articles 1, according to which Ukraine is the sovereign and independent, democratic, social, constitutional state;
Articles 2, according to which sovereignty of Ukraine extends to all its territory. Ukraine is the unitary state. The territory of Ukraine within the existing border is complete and inviolable;
Articles 73, according to which exclusively All-Ukrainian referendum resolves issues of change of the territory of Ukraine;
Item 20 parts one of Article 92, by which it is determined that only the laws of Ukraine determine the organization and procedure for elections and referenda;
Articles 134, according to which the Autonomous Republic of Crimea is the integral component of Ukraine and within the powers determined by the Constitution of Ukraine resolves the issues carried to its competence;
Articles 133, according to parts one and the second which the system of the administrative-territorial device of Ukraine is constituted: The Autonomous Republic of Crimea, areas, areas, the cities, areas in the cities, settlements and villages;
Article parts one 137, which determines the exhaustive list of questions on which the Autonomous Republic of Crimea performs normative regulation, among which there is no question of determination of the status of the Autonomous Republic of Crimea;
Article parts one 138, which determines the exhaustive list of the questions carried to maintaining the Autonomous Republic of Crimea and by which Item 2 it is determined that the organization and holding local referenda treats maintaining the Autonomous Republic of Crimea.
2. The appeal of the Verkhovna Rada of the Autonomous Republic of Crimea to the President of the Russian Federation and Federalnm Sobrany of the Russian Federation is to the contradicting articles 134 and 138 of the Constitution of Ukraine according to which the Verkhovna Rada of the Autonomous Republic of Crimea is not given authority to perform the foreign policy relations.
3. The Verkhovna Rada of Ukraine demands from the Verkhovna Rada of the Autonomous Republic of Crimea immediately to review the decision of March 6, 2014 and to bring it into accord with the Constitution of Ukraine and the Constitution of the Autonomous Republic of Crimea approved by the Law of Ukraine of December 23, 1998. If the specified decision in March 12, 2014 will not be brought by the Verkhovna Rada of the Autonomous Republic of Crimea into accord with the Constitution of Ukraine and the Constitution of the Autonomous Republic of Crimea, in the Verkhovna Rada of Ukraine the question of early termination of powers of the Verkhovna Rada of the Autonomous Republic of Crimea will be initiated.
4. The Verkhovna Rada of Ukraine considers it expedient to address the European Commission "For democracy through the right" (the Venetian Commission) concerning the decision of the Verkhovna Rada of the Autonomous Republic of Crimea of March 6, 2014 about holding on March 16, 2014 so-called all-Crimean referendum.
5. The Verkhovna Rada of Ukraine appeals to residents of the Autonomous Republic of Crimea not to participate in illegal referendum and thus to show the line item on unity of the Ukrainian people and territorial integrity of Ukraine.
