1. Approve enclosed:

Procedure for modification (amendments) of the data declared in the declaration on goods;

form of adjustment of the declaration on goods;

Procedure for filling of adjustment of the declaration on goods.

2. Make to decisions of the Commission of the Customs union changes according to appendix.

3. Determine that modification (amendments) of the data declared in the declarations on goods registered by customs authorities till January 1, 2011 is made with use of the customs papers applied in state members of the Customs union before the specified date.

4. Declare invalid:

The decision of the Commission of the Customs union of May 20, 2010 No. 255 "About procedure for modification and (or) amendments in the declaration on goods after release of goods";

The decision of the Commission of the Customs union of May 20, 2010 No. 256 "About procedure for modification and (or) amendments in the declaration on goods before decision making about release of goods in case of preliminary customs declaring";

The decision of the Commission of the Customs union of May 19, 2011 No. 639 "About modification and amendments in the Instruction about procedure for modification and (or) amendments in the declaration on goods after release of goods";

The decision of Board of the Eurasian economic commission of June 7, 2012 No. 68 "About modification of the Instruction about procedure for modification and (or) amendments in the declaration on goods after release of goods";

The decision of Board of the Eurasian economic commission of June 18, 2013 No. 131 "About modification of the Instruction about procedure for modification and (or) amendments in the declaration on goods after release of goods".

5. This Decision becomes effective since July 1, 2014.

Procedure for modification (amendments) of the data declared in the declaration on goods

I. General provisions

1. This Procedure determines cases and procedure for modification (amendments) of the data declared in the declaration on goods (further - DT), except for procedure for change (amendment) for the data declared in DT as which transport (transportation), business and (or) other documents, before release of goods were used.

Modification (amendments) of the data declared in DT as which transport (transportation), business and (or) other documents were used after release of goods is performed according to this Procedure taking into account the features established by the Section V of the Instruction on procedure for use of transport (transportation), business and (or) other documents as the declaration on goods approved by the Decision of the Commission of the Customs union of May 20, 2010 No. 263.

2. In case of modification (amendments) of the data declared in DT adjustment of the declaration on goods (further – KDT), except as specified,  20 and 26 presents specified in Items 14, About, and also in Item 21 of the Instruction on procedure for use of transport (transportation), business and (or) other documents as the declaration on goods is used.

KDT is filled according to the Procedure for filling of adjustment of the declaration on goods approved by the Decision of Board of the Eurasian economic commission of December 10, 2013 No. 289.

3. The customs transactions connected with modification (amendments) of the data declared in DT are made in state member of the Eurasian Economic Union (further – state member) in which customs authority DT to which changes and (or) additions are made is registered.

4. For and on behalf of the customs applicant the customs transactions connected with modification (amendments) of the data declared in DT can be made by the customs representative to submission of the documents confirming powers of the customs representative on making of the corresponding customs transactions. The documents confirming powers of the customs representative on making of the customs transactions connected with modification (amendments) of the data declared in DT are not represented if such documents were submitted to customs authority when giving DT to which changes and (or) additions are made.

II. Modification (amendments) of the data declared in the declaration on goods before release of goods at the initiative of the customs applicant

5. Modification (amendments) of the data declared in DT at the initiative of the customs applicant is performed on the basis:

a) permissions of customs authority according to the motivated address of the customs applicant about modification (amendments) of the data declared in DT (further - the address), in case of observance of conditions, stipulated in Item 1 Article 112 of the Customs code of the Eurasian Economic Union (further - the Code);

b) permissions of customs authority according to the address in case, stipulated in Item 2 articles 114 of the Code, in need of the statement of data in DT or refining of the data declared in DT which can be in character unknown to the customs applicant at the time of giving of DT in case of preliminary customs declaring.

6. For modification (amendments) of the data declared in DT before release of goods the customs applicant represents to the customs authority which registered DT, the address which properly filled KDT is.

Documents, the confirming changes (amendments) made to the data declared in DT, and in case of modification (amendments) of data on customs value of goods - also the declaration of customs value are attached to KDT (further - DTS). If DT is given in the form of the electronic document, KDT and documents confirming changes (amendments) made to the data declared in DT can be represented electronically, including in the form of electronic documents, according to the procedure, established by the legislation of state members.

DTS is presented in the form of the electronic document or paper document (depending on form of giving of DT).

Documents, the confirming changes (amendments) made to the data declared in DT can not be represented to customs authority if data on such documents and (or) data from them can be received according to Item 2 of article 80 of the Code.
