Chapter 1. General provisions

Article 1. Subject of regulation and task of this Law

1. This Law governs the relations arising in the field of safety of traffic of the Republic of Armenia, establishes the principles and the directions of state policy in the field of traffic safety, the legal basis of the organization and safety of traffic, power of state bodies and local self-government in the field of the organization and safety of traffic, and also the right and obligation of participants of traffic.

2. Task of this Law is protection of life, health and property of citizens, their rights and legitimate interests, interests of society and state by the prevention of safety hazards of traffic, in particular the road accidents, decrease in their weight and effects.

Article 2. The basic concepts used in this Law

In this Law the following basic concepts are used:

insufficient visibility - Yo visibility of the road in the conditions of fog, rain, snowfall and (or) others adverse weather conditions for traffic safety and (or) visibility at distance to 300 meters;

the autodrome of Yo-the protected, separated closed territory equipped with stationary established constructions, devices and elements for accomplishment of exercises for the purpose of instruction of driving of vehicles or acquisition of skills of driving of vehicles;

the autoplatform - Yo separated territory equipped with mobile devices and elements for accomplishment of exercises for the purpose of instruction of driving of vehicles;

the car - the motorized vehicle (the car, the bus, the cargo vehicle, the passenger-and-freight car, the special equipment vehicle, the electric vehicle) provided for towage of the vehicle intended for transportation across the road of people or loads or for cargo transfer. This concept includes trolleybuses, that is trackless vehicles connected by the electric drive. The concept does not include such vehicles what agricultural tractors which use for towage of the vehicles intended for transportation across roads of people or loads or for cargo transfer is additional function are;

the settlement - the built-up territory on which entrance and departure with which is noted by route signs of the settlement;

the carriageway - Yo element of the road provided for movement of not rail vehicles;

lane - Yo longitudinal strip of the carriageway designated or not designated by marking which width is sufficient for movement of vehicles in one row;

the railway crossing - crossing at one level of the road and railway or tram tracks having the allocated cloth;

stop – deliberate reduction of the vehicle in motionless condition for a while up to 5 minutes or for time necessary for landing, disembarkation of the passenger and (or) loading, unloading of the vehicle;

the parking - reduction of the vehicle in purposely motionless condition for the period of more than 5 minutes, except as specified preventions of collision with other participant of traffic or kakimyo-or obstacle, landings, disembarkation of the passenger and (or) loading, unloading of the vehicle, and also other cases, stipulated by the legislation;

the traffic controller - the person having powers on regulation of traffic and performing this regulation in the procedure established by the legislation;

roadside - the road element adjoining the carriageway, differing from it in type of covering or allocated with the corresponding marking, provided for stop of the vehicle, movement of the cyclist and the pedestrian, placement of construction materials in case of repair of roads or other cases established by the legislation;

trail car (semitrailer truck) of Yo-the vehicle which is not equipped with the engine which is intended for starting by means of the motorized vehicle (including special trail car) and movements in its structure as whole;

forced stop – deliberate reduction of the vehicle in motionless condition owing to the emergence of danger or other obstacle in the road caused by defect of the vehicle or physical and (or) mental condition of the driver or passenger or cargo hauling or for the purpose of subordination to the prohibiting signal of the traffic light or the traffic controller or concession are expensive to other vehicle or prevention of collision with other participant of traffic or any obstacle or accomplishment of the requirement of the employee of police or other competent person about stop of the vehicle this in the procedure established by the law or accomplishment of the requirement provided by the traffic regulations approved by the Government of the Republic of Armenia. the bicycle – the vehicle, except the chair carriages having at least two wheels and, as a rule, set in motion by the muscular strength of the person who is on it, in particular by means of pedals or handles which can have also electric motor the maximum rated power of 0,25 of kW in the mode of long-term loading which automatically is disconnected at speed more than 25 km/h;

the pedestrian - person who is out of the vehicle on the road, except for the person having power on the work on the road of works and which is carrying out these works in the procedure established by the legislation. the crosswalk – the allocated site of the carriageway designated by route signs and (or) marking and in the procedure established by the legislation provided for movement of pedestrians;

the road - Yo strip of the earth equipped or adapted, used for movement of vehicles or the surface of artificial construction having at least one carriageway, and also including tram ways, sidewalks, roadsides and dividing strips in case of their availability;

traffic - Yo system of the public relations arising in the course of movement on the road of people and (or) loads by means of vehicles or without those;

traffic safety - Yo condition of protection of participants of traffic against dorozhnoyotransportny incidents;

technical means of the organization of traffic - Yo route signs, traffic lights, protective barriers, marking and other;

engineering constructions of roads of Yo-of stop, railway crossings, city electrotransportation lines, autopavilions, places of parking of vehicles, rest areas, snow protection forest belts, plantings, detours which are behind strip of withdrawal of the road, fire-proof and antiavalanche constructions, antiemergency pockets, road communication, lighting and other;

the road accident - the event which arose during movement on the road of the vehicle and with its participation owing to which people died or are wounded vehicles, loads, constructions are damaged or other material damage is caused;

traffic safety - Yo action directed to the prevention of dorozhnoyotransportny incidents and decrease in weight of their effects;

the participant of traffic - (further Yo participant of movement) Yo person who is directly participating in traffic: driver, pedestrian, passenger;

the organization of traffic - Yo complex of the organizational, legal and technical actions directed to traffic regulation;

the sidewalk - the road element adjoining the carriageway or separated it by any method, intended for movement of pedestrians in the procedure established by the legislation;

the motorized vehicle – the vehicle set in motion by the engine including tractors, self-propelled machines and mechanisms (except vehicles which engine capacity does not exceed 50 square centimeters), and also trolleybuses and electric vehicles;

the adjacent territory - the territory, directly adjacent to the road, which is not intended for end-to-end movement of vehicles (the yards, places of parking, the closed territories, gas stations and other);

the international movement - Yo movement across the Republic of Armenia of the vehicle registered in other country and which is in the Republic of Armenia is continuous or with break to two months and during up to one year;

the moped – the two-wheeled or three-wheeled motorized vehicle with the internal combustion engine in the working amount which is not exceeding working amount of 50 cubic cm or the electric motor the maximum rated power in the mode of long-term loading more 0,25 of kW and less than 4 kW which maximum constructive speed does not exceed 50 km/h. the bus - the car provided for passengers having more than 8 seats which is intended by the design and equipment for safe and convenient transportation of passengers and baggage;

dividing strip - the road element allocated structurally and (or) the corresponding marking, dividing adjacent carriageways, not intended for movement or stop of vehicles and pedestrians;

the cargo vehicle - the car intended by the design and equipment for cargo transfer;

the dead - person who died owing to the road accident;

Item of stop of the vehicle public - the place on certain piece of route of the vehicle public provided for landing disembarkation of passengers and equipped with the corresponding route signs;

the automobile passenger car - the car provided for passengers having no more than 8 seats which is intended by the design and equipment for safe and convenient transportation of passengers and baggage;

the self-made vehicle – the vehicle made according to the specifications established for the vehicles raised in individual (collective) procedure;

the competent official - the official of Police having competence to creation of the protocol on administrative offense and (or) removal on its basis of the decision;

removal from accounting - the action for accounting connected taking into account the vehicle by other competent authority or its export from the territory of the Republic of Armenia or utilization;
