About approval of the Regulations on the organization and functioning of automated information system "Register of the state positions and government employees"

According to provisions of article 13 of the Law on the state position and the status of the government employee No. 158-XVI of July 4, 2008 (The official monitor of the Republic of Moldova, 2008, Art. No. 230-232, 840), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on the organization and functioning of automated information system "Register of the state positions and government employees" it (is applied).

2. To provide to the bodies of public management falling under operation of the Law on the state position and the status of the government employee No. 158-XVI of July 4, 2008 accomplishment of provisions of the specified Provision.

3. To impose control over the implementation of this Resolution on the State office.

Regulations on the organization and functioning of automated information system "Register of the state positions and government employees"

I. General provisions

1. The regulations on the organization and functioning of the Automated information system "Register of the state positions and government employees" (further - the Provision) establish procedure for the organization and the mechanism of functioning of the information resource intended for human resources management in bodies of public management of all levels.

2. The automated information system "The register of the state positions and government employees" (further - the Register) is component of the state information resources of the Republic of Moldova and is directed to collection, storage, updating and data analysis about the state and non-state positions, about personnel of bodies of the central and local public authority, to provision of information on regular structure of bodies of public management of all levels, their state and non-state positions, owners of the state and non-state positions, except the positions founded based on secret documents. The appropriate information resource is created by means of functioning of the Register. The information system is the tool intended including for ensuring effective management of personnel and information representation to authorized bodies.

3. The concepts applied in this Provision are used in the value provided by the Law on informatization and the state information resources No. 467-XV of November 21, 2003, the Concept of the automated information system "Register of the state positions and government employees" approved by the Order of the Government No. 1373 of December 1, 2006, the Law on registers No. 71-XVI of March 22, 2007 and in the legislation on public service. Also for the purposes of this provision the following concepts are used:

authentication in system - the procedure of check of authenticity of the subject of access to the Register;

complex of program technical means - set of the program and technical means providing functionality of the Register;

the holder of the Register - physical person or legal entity to which the owner delegated the powers on maintaining the Register which are not connected with registration of information objects according to the conditions established by the owner of the Register;

the supplier of data - the physical person or legal entity of the public law providing data of rather information objects of the Register;

identification - assignment of the identifier to subjects and access objects and/or comparison of the provided identifier with the list of the appropriated identifiers;

participants of the Register - the bodies of public management falling under operation of the Law on the state position and the status of the government employee No. 158-XVI of July 4, 2008 and the Order of the Government No. 1001 of December 26, 2011. "About enforcement of provisions of some legal acts" (appendix No. 1); loggers of the Register - the personnel divisions or persons who are responsible for registration of personnel in case of absence of the relevant division in body of public management; users are employees of participating bodies of the Register.
