About measures for provision of services for state registration of the rights to real estate

According to Items 3 and 9 of the Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 395, for the purpose of providing and protection of the rights and legitimate interests of owners, other assignees of real estate, provision of services on the state regisration of the rights to real estate and their encumbrances by PRIKAZYVAYU:

1. Determine that state registration of the rights and their burdenings (further - state registration of the rights) on the real estate located within the territory of the Autonomous Republic of Crimea and the city of Sevastopol according to the legislation in the sphere of state registration of the rights perform:

according to applications which are submitted personally by the applicant or by sending by mail to bodies of state registration of the rights of the Autonomous Republic of Crimea and the city of Sevastopol, - the state registrars of the rights to real estate (further - the state registrars) bodies of state registration of the rights of the Dnipropetrovsk, Odessa, Khmelnytskyi and Chernihiv regions;

according to applications which are submitted personally by the applicant or by sending by mail to bodies of state registration of the rights of the Kherson and Zaporizhia regions, - the state registrars of such bodies.

In case of filing of applications in bodies of state registration of the rights of the Autonomous Republic of Crimea and the city of Sevastopol such bodies provide adoption of statements with obligatory specifying of the postal address of the applicant for correspondence and production of electronic copies of the documents submitted for state registration of the rights by their scanning and placement in the database about registration of statements and requests of the State register of the rights to real estate (further - the State register is right).

By means of the software of the State register of the rights Ukrgosreestr performs transfer of statements in bodies of state registration of the rights of the Dnipropetrovsk, Odessa, Khmelnytskyi and Chernihiv regions for their further review by the state registrars.

The state registrars of bodies of state registration of the rights of the Dnipropetrovsk, Odessa, Khmelnytskyi and Chernihiv regions carry out state registration of the rights according to the Procedure for state registration of the rights to real estate and their encumbrances approved by the resolution of the Cabinet of Ministers of Ukraine of October 17, 2013 No. 868. Extraction from the State register of the rights, or the decisions made by the state registrar, the specified bodies of state registration of the rights send the certificate on the property right (in case of its forming) by mail with the inventory of investment to the applicant.

Documents which were filed by the applicant for carrying out state registration of the rights to bodies of state registration of the rights of the Autonomous Republic of Crimea and the city of Sevastopol are issued personally to the applicant or go by mail with the inventory of investment the specified bodies after consideration by the state registrars of bodies of the state registration of the rights of the Dnipropetrovsk, Odessa, Khmelnytskyi and Chernihiv regions corresponding statements.

In case of filing of applications the state registrars of such bodies carry out state registration of the rights according to the Procedure for state registration of the rights to real estate and their encumbrances approved by the resolution of the Cabinet of Ministers of Ukraine of October 17, 2013 No. 868 to bodies of state registration of the rights of the Kherson and Zaporizhia regions.

2. To the public registration service of Ukraine (Alekseev I. S.) take the adequate measures necessary for realization of Item 1 of this order, way:

1) temporary assignment of accomplishment of obligations of the state registrars of bodies of state registration of the rights of the Autonomous Republic of Crimea and the city of Sevastopol on the state registrars of bodies of state registration of the rights of the Kherson and Zaporizhia regions;

2) ensuring transfer of statements by means of the software of the State register of the rights to real estate in bodies of state registration of the rights of the Dnipropetrovsk, Odessa, Khmelnytskyi and Chernihiv regions and proper control of their further review by the state registrars.

3. To the state company "Information center" of the Ministry of Justice of Ukraine (Bogdanov L. V.) take the adequate measures necessary for carrying out the registration actions determined by Item 1 of this order.

4. To department of interaction with authorities to submit this order on state registration according to the Presidential decree of Ukraine of October 03, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

5. This order becomes effective from the date of its official publication.

6. To impose control over the implementation of this order on the Chairman of the Public registration service of Ukraine Alekseev I. S.
