About carrying out registration actions for change of the location of legal entities and residences of physical persons - entrepreneurs

According to Item 9 of the Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 395, and for the purpose of ensuring protection of the rights and legitimate interests of legal entities and physical persons - entrepreneurs of PRIKAZYVAYU:

1. Determine that carrying out registration actions for change of the location of legal entities and the residence of physical persons - entrepreneurs to whose location/residence the Autonomous Republic of Crimea and the city of Sevastopol is is performed by the state registrars of legal entities and physical persons - entrepreneurs of registration services of territorial authorities of the Ministry of Justice in areas and the city of Kiev (further - the state registrars of legal entities and physical persons - entrepreneurs).

Action of paragraph one of this Item does not extend on change of the location of legal entities and residences of physical persons - entrepreneurs within the territory of the Autonomous Republic of Crimea and the city of Sevastopol.

2. To the public registration service of Ukraine (Alekseev I. S.) provide:

1) carrying out the registration actions determined by Item 1 of this order, the state registrars of legal entities and physical persons - entrepreneurs of registration services of territorial authorities of justice of areas and the city of Kiev based on the documents provided by the Law of Ukraine "About state registration of legal entities and physical persons - entrepreneurs";

2) the direction the state registrars of legal entities and physical persons - entrepreneurs who carried out the registration actions determined by Item 1 of this order, the documents submitted for their carrying out, according to the procedure, determined by part four of article 14 of the Law of Ukraine "About state registration of legal entities and physical persons - entrepreneurs";

3) message (mailing, telephone message, electronic communication, etc.) the state registrars of legal entities and physical persons - entrepreneurs who carried out the registration actions determined by Item 1 of this order, the state registrars of legal entities and physical persons - entrepreneurs of registration services of territorial authorities of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea and the city of Sevastopol on the storage location of registration case on need of transfer of the registration case which is drawn up according to Procedure for storage and transfer of registration cases of legal entities and physical persons - entrepreneurs, the approved order of the Ministry of Justice of Ukraine of February 10, 2012 No. 238/5, registered in the Ministry of Justice of Ukraine on February 10, 2012 for No. 203/20516 (with changes), on the new location of legal entities and the residence of physical persons - entrepreneurs. Such transfer is performed by the mailing according to article 14 of the Law of Ukraine "About state registration of legal entities and physical persons - entrepreneurs" or by issue of the registration case which is drawn up according to Procedure for storage and transfer of registration cases of legal entities and physical persons - entrepreneurs, the approved order of the Ministry of Justice of Ukraine of February 10, 2012 No. 238/5, registered in the Ministry of Justice of Ukraine on February 10, 2012 for No. 203/20516 (with changes) according to the address of authorized representatives of legal entities and physical persons - entrepreneurs on receipt about obligation of its subsequent transfer to the state registrar on the new location of legal entities and the residence of physical persons - entrepreneurs;

4) capture on accounting of registration cases by the state registrars by means of software of maintaining the Unified State Register of Legal Entities and physical persons - entrepreneurs in day of receipt of the documents sent according to the subitem 2 presents of Item;

5) provision by the state company "Information and Resource Center" (Malyutin A.) access to registration cases of legal entities and physical persons - entrepreneurs in the Autonomous Republic of Crimea and the city of Sevastopol in the Unified State Register of Legal Entities and physical persons - entrepreneurs to the state registrars of legal entities and physical persons - entrepreneurs of registration services of territorial authorities of justice of areas and the city of Kiev for the purpose of carrying out the registration actions determined by Item 1 of this order.

3. To department of interaction with authorities to submit this order on state registration according to the Presidential decree of Ukraine of October 03, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the Chairman of the Public registration service of Ukraine Alekseev I. S.
