About approval of Rules of the choice of service providers on catering services of students in the organizations of secondary education

According to Item 4-1 of article 8 of the Law of the Republic of Kazakhstan of July 27, 2007 "About education" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of the choice of service providers on catering services of students in the organizations of secondary education.

2. This resolution becomes effective since June 1, 2014 and is subject to official publication.

Rules of the choice of service providers on catering services of students in the organizations of secondary education

1. General provisions

1. These rules of the choice of service providers on catering services of students in the organizations of secondary education (further - Rules) are developed according to Item 4-1 of article 8 of the Law of the Republic of Kazakhstan of July 27, 2007 "About education" and determine procedure for carrying out the choice of service providers on catering services of students in the organizations of secondary education. The choice of suppliers is performed on competitive basis by the organizer of tender. When implementing the choice of the supplier of food service of students if the organizer of tender for several organizations of secondary education is the educational body, the last holds competition with breakdown on lots on the organizations of education.

2. In Rules the following concepts are used:

1) the organizer of tender - the organization of secondary education or educational body in case the organization of secondary education does not keep independently financial accounting;

2) service - the provision of food by the student in the organizations of secondary education including production process, deliveries and realization of culinary products and goods;

3) the potential supplier - the physical person performing business activity, or the legal entity applying for the conclusion of the service provision agreement;

4) the supplier - the physical person performing business activity, or the legal entity who signed the service provision agreement;

5) the bid - the documents submitted by the potential supplier, constituted according to the tender documentation, confirming possession material, financial and manpower for rendering service;

6) the tender documentation - documents, bids and the containing conditions submitted by the organizer of tender to the potential supplier for preparation and procedure for carrying out tender according to the Standard tender documentation at the choice of the supplier of food service of students in the organizations of secondary education (further - the Standard tender documentation) according to appendix 1 to these rules;

7) tender committee - the temporary collegiate organ created by the organizer of tender for carrying out tender;

8) Internet resource - Internet resource of the organizer of tender or educational body, in case of absence at the organizer of tender of own Internet resource.

3. The organizer of tender does not participate in quality of the potential supplier of service.

2. Tender committee

4. For accomplishment of the procedure of carrying out tender the decision of the organizer of tender creates tender committee and the secretary of the commission is determined. Members of tender committee are the chairman, the vice-chairman and other members of the commission. Representatives of the executive bodies performing within the competence management in the field of management of state-owned property in the field of sanitary and epidemiologic wellbeing of the population, and also representatives of non-governmental organizations, the parent public in coordination with them are included tender committee. The secretary is not member of the commission and has no right to vote in case of adoption of decisions by the commission. The total quantity of members of the commission constitutes odd number, but at least five people. The commission is effective from the date of entry into force of the decision on its creation and stops the activities from the date of the conclusion of the service provision agreement.

5. Commission chairman is the first head of the organization or educational body, in case of its absence functions of the chairman are performed by the vice-chairman of the commission. If the organizer of tender the educational body acts as the vice-chairman of the commission the head of the organization of secondary education is. If the organization of secondary education by the vice-chairman of the commission acts as the organizer of tender the deputy manager of the organization of secondary education is.

6. The tender committee considers the bid of the potential supplier, determines the winner of tender according to the Standard tender documentation and places the protocol on tender results on Internet resource.

7. The meeting of tender committee is competent if at it there is most (at least two thirds) of members of tender committee. In case of absence of one of members of tender committee in the minutes of tender committee the reason of its absence is specified.

8. The decision of tender committee is made by open voting. In case of equality of votes the decision for which the chairman voted is deemed accepted. Members of tender committee in case of disagreement with the solution of tender committee submit to the chairman motivated objections in writing.

9. Solutions of tender committee are drawn up by the secretary of the commission in the form of protocols, signed and are polistno initialed by all members of the commission.

3. Procedure for the choice of the supplier

10. The organizer of tender develops and approves the tender documentation on the basis of the Standard tender documentation.

11. The organizer of tender within five calendar days from the date of approval of the tender documentation, but at least in twenty calendar days prior to final date of submission of requests by potential suppliers, informs potential suppliers by placement on Internet resource of the announcement of tender in form according to appendix 2 to these rules. In the announcement day and time of the end of order taking are specified.

12. If there is need for rendering food services of students according to requirement for the period before summing up tender, the organizer of tender makes the decision on involvement of the supplier rendering of food service. In case of adoption of this decision the organizer of tender sends inquiry to the supplier rendering of food service for rendering food services of students in the organizations of secondary education. The supplier rendering of food service in case of consent within five calendar days from the moment of receipt sends letters of the organizer of tender the answer with application of documents according to the subitem 2) of Item 9 of the Standard tender documentation.

13. The potential supplier according to the tender documentation prepares the bid which includes the list of the documents submitted by the potential supplier, or his representative by proxy in confirmation of its compliance to requirements of the tender documentation and directs to the postal address of the organizer of tender, or purposely, before the expiration of final term of their representation.
