ORDER OF THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN

of February 19, 2014 No. 115

About approval of standards of the state services rendered by local executive bodies in the sphere of family and children, and modification of some decisions of the Government of the Republic of Kazakhstan

(as amended of the Order of the Government of the Republic of Kazakhstan of 13.03.2015 No. 140)

According to the subitem 3) of article 6 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) standard of the state service "Issue of References on Guardianship and Custody";

2) standard of the state service "Establishment of Guardianship Or Custody over the Orphan Child (Orphan Children) and Child(children), Without Parental Support";

3) standard of the state service "Issue of References in the Single Accumulation Pension Fund and (or) the Voluntary Accumulation Pension Fund, Banks, in Law-enforcement Bodies for the Order Property of Minor Children and Registrations of Inheritance to Minor Children";

4) standard of the state service "Issue of References of the Bodies Performing Functions on Guardianship Or Custody for Execution of Transactions with the Property Belonging on the Property Right to Minor Children";

5) standard of the state service "Provision of Free Transportation to the General Education Organizations and Back Home to the Children Living in the Remote Rural Items";

6) standard of the state service "Provision of Free Food to Separate Categories of Students and Pupils at Comprehensive Schools";

7) standard of the state service "Purpose of Allowance Payment to Guardians or Custodians to Content of the Orphan Child (Orphan Children) and Child(children), Without Parental Support";

8) changes which are made to some decisions of the Government of the Republic of Kazakhstan.

2. This resolution becomes effective from the date of its first official publication.

Standard of the state service "Issue of References on Guardianship and Custody"

1. General provisions

1. The state service "Issue of References on Guardianship and Custody" (further - the state service).

2. The standard of the state service is developed by the Ministry of Education and Science of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears departments of education of the cities of Astana and Almaty, departments of formation of areas and cities of regional value (further - the service provider).

Reception of applications and issue of results of rendering the state services are performed through:

1) the Republican state company on the right of economic maintaining "Service center of the population" of Committee on control of automation of the state services and coordination of activities of service centers of the population of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - TsON);

2) web portal of "the electronic government": www.egov.kz (further - the portal).

2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the moment of delivery of documents in TsON, and also addresses for the portal - no more than 5 minutes;

2) the most allowed time of expectation for delivery of documents uslugopoluchatel - no more than 15 minutes;

3) the most allowed time of servicing of uslugopoluchatel - no more than 5 minutes.

5. Form of rendering the state service: electronic (completely automated) and (or) paper.

6. Result of rendering the state service - the certificate of guardianship and custody over the orphan child (orphan children) and child(children), without parental support, according to appendix 1 to this standard of the state service.

The result of the state service is provided in electronic format. In case of the request of uslugopoluchatel for receipt of the state service on paper the result is drawn up in electronic format, unpacked and certified by the signature of the head of the service provider.

On the portal the result of rendering the state service goes to uslugopoluchatel to "private office" in electronic form, signed by the digital signature (further - the EDS) the authorized person of the service provider.

7. The state service is rendered free of charge.

8. Working schedule:

1) TsONa: Monday through Saturday inclusive, except for days off and holidays, according to the labor law of the Republic of Kazakhstan, according to the established working schedule from 9:00 to 20:00 o'clock, without interruption.

Acceptance is performed according to the procedure of "electronic" queue, without making an appointment and the accelerated servicing.

In case of desire of uslugopoluchatel "booking" of electronic queue by means of the portal is possible;

2) the portal - round the clock (except for technical breaks in connection with carrying out repair work).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel:

in case of the appeal to TsON:

1) the statement of uslugopoluchatel (from the guardian (custodian) according to appendix 2 to this standard of the state service;

2) these certificates of birth of the child (in case of the child's birth till August 13, 2007).

Data of identity documents of uslugopoluchatel (the guardian (custodian), the certificate of birth of the child (in case of the child's birth after August 13, 2007), the worker of TsONa receives from the corresponding state information systems in the form of the electronic documents certified by the EDS of authorized persons of state bodies.

The service provider receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law which contain in information systems, when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

In case of documents acceptance the worker of TsONa verifies data from information system TSONOV with originals of documents of uslugopoluchatel and returns originals to uslugopoluchatel;

on the portal:

1) the request in electronic form signed by the EDS of uslugopoluchatel;

2) certificates of birth of the child.

In case of the address on the portal of the data on identity documents of uslugopoluchatel, the certificate of birth of the child (issued after August 13, 2007), containing in the state information systems, the service provider receives from the corresponding state information systems in the form of the electronic documents certified by the EDS of authorized persons of state bodies.

In case of the address through the portal to uslugopoluchatel the notification report on acceptance of request for rendering the state service with indication of date and time of receipt of result of the state service goes to "private office".

10. In case of provision by uslugopoluchatel of incomplete document package according to Item 9 of this standard of the state service, the worker of TsONa refuses reception of an application and issues the receipt on refusal in documents acceptance in form, according to appendix 3 to this standard of the state service.

3. Procedure for appeal of decisions, actions (failure to act) of local executive bodies of areas, cities of republican value, the capital, areas, cities of regional value, and also service providers and (or) their officials, service centers of the population and (or) their workers concerning rendering the state services

11. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state services: the claim is submitted addressed to the head of the service provider or addressed to the head of the relevant local executive body of areas, the city of republican value, the capital (further - akimat) to the addresses specified in Item 13 of this standard of the state service.

The claim is submitted in writing by mail or purposely through office of the service provider or akimat.

Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider, or akimat, with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint. After registration the claim goes to the head of the service provider, or akimat, for determination of the executive in charge and acceptance of adequate measures.

In case of incorrect servicing by the worker of TsONa, the claim is submitted addressed to the head of TsONa to the addresses and phones specified in Item 13 of this standard of the state service.

Confirmation of adoption of the claim in office of TsONa which arrived as if on purpose, and mail, is its registration (stamp, the entering number and registration date are put down on the second copy of the claim or the cover letter to the claim). After registration the claim goes to the head of TsONa for determination of the executive in charge and acceptance of adequate measures.

Also information on procedure for appeal of actions (failure to act) for the worker of the service provider, TsONa can be received by phone single contact center concerning rendering the state services, specified in Item 16 of this standard of the state service.

The claim of uslugopoluchatel which arrived to the service provider, akimat or TsONa is subject to consideration within five working days from the date of its registration. The motivated answer about results of consideration of the claim goes to uslogopoluchatel by mail or is issued purposely in office of the service provider, akimat or TsONa.

In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.

12. In disagreement cases with results of the rendered state service, the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

4. Other requirements taking into account features of rendering the state service including rendered electronically and through service centers of the population

13. Addresses of places of rendering the state service are placed:

1) on Internet resource of the Ministry: www.edu.gov.kz;

2) TsONa: www.con.gov.kz;

3) on the portal: www.e.gov.kz.

14. Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.

15. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of "private office" of the portal, service desks of the service provider, and also single contact center concerning rendering the state services.

16. Contact telephone numbers of service desks of the service provider concerning rendering the state service are placed on Internet resource of the Ministry: www.edu.gov.kz, single contact center concerning rendering the state services: 8-800-080-7777, 1414.
