About some requirements imposed to the organization and carrying out lotteries

For the purpose of enhancement of the organization and carrying out lotteries, being guided by articles 2 and 18 of the Law of the Kyrgyz Republic "About lotteries", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Approve:

- The list of the obligatory data necessary for informing the participants of electronic lottery placed by the organizer of electronic lottery on the screen of the TV or the computer (further - the List), according to appendix 1;

- The instruction about procedure for provision of the reporting under lottery (further - the Instruction) according to appendix 2.

2. To public service of regulation and supervision of the financial market under the Government of the Kyrgyz Republic to take measures for observance by organizers of lotteries of conditions of carrying out and the requirements provided by the List and the Instruction.

3. This resolution becomes effective after fifteen days from the date of official publication.

4. To impose control of execution of this resolution on department of finance and credit policy of Government office of the Kyrgyz Republic.

Appendix 1

The list of the obligatory data necessary for informing the participants of electronic lottery placed by the organizer of electronic lottery on the screen of the TV or the computer *

Under the organization and carrying out electronic lottery the following List of the obligatory data necessary for informing the participants of electronic lottery placed by the organizer of electronic lottery on the screen of the TV or the computer is established:

1. Name and logo of lottery.

2. Name and logo of the organizer of lottery.

3. Number and date of issue of the certificate on the right of carrying out lottery.

4. The address of the website of the organizer of lottery containing conditions of carrying out lottery.

5. Address and phone number of the organizer of lottery.

6. Text: "For persons 18 years of age or over".

7. Price of participation in electronic lottery.

8. In case of broadcast of draw of lottery per television channels or per the Internet the text with indication of the current time and text "Air" is necessary. In case of broadcast of record text "Repetition".

9. The lottery program used by the organizer of electronic lottery shall provide display on the screen of the TV or the computer of condition of lottery and the rule of the game.

The instruction about procedure for provision of the reporting under lottery

1. General provisions

1. This Instruction about procedure for provision of the reporting under lottery (further - the Instruction) is developed according to article 18 of the Law of the Kyrgyz Republic "About lotteries" and establishes structure, procedure and terms of provision of the reporting by organizers of lotteries in authorized state body on regulation of lottery activities (further - authorized state body).

2. Action of this Instruction extends to all organizers of lottery performing activities based on the license for implementation of lottery activities, issued by authorized state body.

3. The reporting of the organizer of lottery is considered the reporting provided to authorized state body from the moment of receipt according to the procedure, established by this Instruction.

4. The reporting of the organizer of lottery is submitted in paper form.

5. Pages of the reporting (in number of the 2nd and more) shall be numbered and stitched. The reporting of the organizer of lottery established by this Instruction shall be certified by the signature of the head and seal of the organizer of lottery.

2. Requirements to structure, procedure and terms of submission of the reporting by the organizer of lottery

6. The organizer of lottery represents the following reporting to authorized state body:

a) the monthly reporting (for instant, drawing, electronic lotteries) in forms according to appendices 1, 2 and 3;

b) the reporting following the results of complete lottery (for the stimulating lotteries) in form according to appendix 4.

7. The document specified in the subitem "an" of Item 6 of this Instruction is constituted monthly and shall be provided to authorized state body following the results of every month no later than the 10th following the accounting period.

8. The document specified in the subitem "b" of Item 6 of this Instruction is constituted following the results of the complete stimulating lottery and shall be provided to authorized state body from the date of its completion in a month.

9. In case of need modification and amendments to the documents specified in Item 6 of this Instruction they shall be provided by the organizer of lottery to authorized state body within three working days from the moment of their introduction.

10. In the represented forms of the reporting all fields are filled. In case of absence in the filled data field the crossed out section is put ("-").

3. Responsibility for the represented reporting

11. Organizers of lottery bear responsibility for inopportuneness of representation and unauthenticity of the reporting specified in Section 2 of this Instruction according to the legislation of the Kyrgyz Republic.
