RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About enhancement of procedure for marking and customs clearance of separate types of the imported consumer goods

(as amended of the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 06.04.2017 No. 185)

According to the Law of the Republic of Uzbekistan "About consumer protection" and the resolution of the President of the Republic of Uzbekistan of January 29, 2013 "About measures for further increase in competitiveness of domestic production and strengthening of fight against illegal commodity importation" the Cabinet of Ministers decides No. PP-1913:

1. Approve Rules of marking and customs clearance of separate types of the imported consumer goods which are subject to the obligatory marking in state language which is put down by manufacturers according to appendix No. 1.

2. Determine that import of medicines (the code according to the Commodity Nomenclature of Foreign Economic Activity 3004), having consumer packaging (container), is performed with obligatory marking in state language.

Marking of the imported medicines is carried out by investment to consumer packaging (container) of information for the consumer in state language in the form of leaf insert, without additional marking on packaging. In case of lack of the marking in state language which is put down by manufacturer marking of the imported medicines after their import to the territory of the Republic of Uzbekistan, in storage time under customs locks, by placement in group packaging of the corresponding units of inserts in state language is allowed.

The text of marking of medicines in state language affirms Head department on quality control of medicines and medical equipment of the Ministry of Health of the Republic of Uzbekistan.

3. Make changes and addition to the resolution of the Cabinet of Ministers of May 13, 2013 No. 127 "About additional measures for enhancement of import of consumer goods to the Republic of Uzbekistan" (the joint venture of the Republic of Uzbekistan, 2013, No. 5, the Art. 29) according to appendix No. 2.

4. To the State Customs Committee, the State Tax Committee together with the Ministry of Justice of the Republic of Uzbekistan and the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

5. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov.

Rules of marking and customs clearance of separate types of the imported consumer goods which are subject to the obligatory marking in state language which is put down by manufacturers

I. General provisions

1. These rules according to the Law of the Republic of Uzbekistan "About consumer protection" and the resolution of the President of the Republic of Uzbekistan of January 29, 2013 No. PP-1913 "About measures for further increase in competitiveness of domestic production and strengthening of fight against illegal commodity importation" determine conditions of marking and customs clearance of the consumer goods which are subject to the obligatory marking in state language which is put down by manufacturers.

2. In these rules the following basic concepts are applied:

label - plate (from paper, tree, cardboard, skin, metal, etc.) with the text which is put down in case of production of goods for designation of weight, the destination, production, structure, owner or other data;

label - the label with text attached to goods by means of thread or tape by manufacturing plant;

marking - the text, drawings or information designations on consumer packaging and (or) container of the imported goods;

sticker - the label with special glue layer which serves for placement additional, not entered the label or packaging, data;

container - the basic element of packaging representing product for placement of products;

transport container - the container forming independent transport unit;

packaging - the means or complex of means providing protection of products against damages and losses, the environment against pollution, and also process of the product circulation;

consumer packaging - the container which is arriving to the consumer with products, not performing function of transport container;

the label - the graphical and text sign applied on goods in the form of sticker in case of its production with indication of trademark of manufacturer, the name, date of production, expiration date and (or) other data on goods;

the form, the passport - the sheet (book) in which data on goods are entered.

II. Conditions of marking of the consumer goods which are subject to obligatory marking in state language

3. The goods included in appendix No. 1 to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 13, 2013 in No. 127 "About additional measures for enhancement of import of consumer goods to the Republic of Uzbekistan" and having the consumer packaging which is part of goods and being included in its price in which they directly arrive in retail trade are subject to the obligatory marking in state language which is put down by manufacturer. Marking of the goods which were in the use is performed in accordance with general practice according to these rules.

4. Are not subject to the obligatory marking in state language which is put down by manufacturer, the goods imported:

legal entities and physical persons, including foreign, for own needs and not intended for productive or other business activity;

for official (office) use of foreign states by diplomatic and consular representations in the Republic of Uzbekistan, the international and intergovernmental organizations, representations of foreign states under these organizations and other international organizations, and also for their personnel;

as exhibition samples, test pieces, researches and marketing.

5. Marking compliance in state language to requirements of regulating documents for standardization of products is performed by accredited bodies on certification.

6. Marking in state language shall be complete and reliable for the consumer according to requirements of appendix to these rules.

7. The main consumer properties and characteristics of goods, and also the other information containing on marking of manufacturer it shall be specified on marking in state language according to appendix to these rules.
