1. Establish:

form of the agreement of the order on the organization and carrying out the electronic biddings selling capital structure (the building, construction), the incomplete preserved and not preserved capital structure according to appendix 1;

form of the agreement of the order on the organization and carrying out the electronic biddings selling the parcel of land sold in private property of the non-state legal entity of the Republic of Belarus necessary for construction and servicing of the sold property, or the right of lease of the parcel of land necessary for construction and servicing of the sold property according to appendix 2.

2. This resolution becomes effective after its official publication.

1. Subject of the agreement

 

1.1. The attorney shall on behalf of the Principal according to the Regulations on procedure for carrying out the electronic biddings approved by the resolution of Council of Ministers of the Republic of Belarus of July 12, 2013 No. 608 (further – the Provision), to organize and hold the electronic auction on sale ____________________________

2. Obligations of the Parties

 

2.1. The principal shall:

2.1.1. provide to the Attorney during ___ the working days from the date of the conclusion of this agreement reliable information about the sold subject of the electronic biddings;

2.1.2. upon the demand of the Attorney and to submit the necessary additional information about property within the terms established by him;

2.1.3. issue to the Attorney the power of attorney;

2.1.4. provide access of all interested persons to subject of the electronic biddings;

2.1.5. inform the Attorney on availability of the bases for cancellation of results of the electronic biddings or cancellation of the decision on sale of subject of the electronic biddings to the applicant for purchase listed in    the Provision Item 38 part one no later than three working days after emergence of such bases.

2.2. The attorney shall:

2.2.1. determine electronic trading platform for carrying out the electronic biddings and sign with the operator of electronic trading platform the agreement on carrying out the electronic biddings;

2.2.2. organize the publication of the notification on carrying out the electronic biddings and in addition information on the announced biddings and subject of the biddings ( including placement of information on the biddings on electronic trading platform), messages on refusal of carrying out the electronic biddings;

2.2.3. draw up results of the electronic biddings according to the Provision;

2.2.4. to personally perform the assignment given it;

2.2.5. after execution of the order or in case of termination of the contract of the order before its execution immediately to return to the Principal the power of attorney which effective period did not expire.

 

3. Costs for the organization and carrying out the electronic biddings.

Responsibility of the parties

3.1. Costs for the organization and carrying out the electronic biddings are compensated according to   Provision Item 42.

3.2. In case of non-execution or improper execution of obligations under this agreement the parties bear responsibility according to the legislation.

 

4. Final provisions

 

4.1. This agreement becomes effective from the date of its conclusion and is effective about day of the conclusion of the purchase and sale agreement of subject of the biddings.

4.2. This agreement can be changed, added or terminated according to the written agreement of the parties.
