About approval of the Instruction for proceedings about administrative offenses in law-enforcement bodies of the Republic of Kazakhstan

1. Approve the Instruction for proceedings about administrative offenses in law-enforcement bodies of the Republic of Kazakhstan (further - the Instruction) according to appendix.

2. To committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.) provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication.

3. To chairmen of committees, chiefs of departments and independent Regional Offices of the Ministry of Internal Affairs of the Republic of Kazakhstan, departments of internal affairs of the cities of Astana, Almaty, areas, on transport and Representative offices of the Ministry of Internal Affairs of the Republic of Kazakhstan in the city of Baikonur:

1) to organize studying of this order by staff of law-enforcement bodies, and also production of the in-house documentation provided by the Instruction;

2) to organize work of law-enforcement bodies according to requirements of this order.

4. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan police major general Turgumbayev E. Z., Committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.).

5. This order becomes effective after ten calendar days after day of its first official publication.

The instruction for proceedings about administrative offenses in law-enforcement bodies of the Republic of Kazakhstan

1. This Instruction for proceedings about administrative offenses in law-enforcement bodies of the Republic of Kazakhstan (further - the Instruction) disaggregates procedure of implementation of production for cases on administrative offenses.

2. In divisions of law-enforcement bodies (further - Department of Internal Affairs) production on cases on administrative offenses is conducted by departments (departments, groups) of administrative practice (further - divisions of administrative practice), or employees to whose duties the specified functions belong (further - the responsible).

3. Forms of the protocol on administrative offense (further - the protocol) in form according to appendix 1 to this Instruction, resolutions on the case of administrative offense (further - the resolution) in form according to appendix 2 to this Instruction, the temporary certificate issued instead of the withdrawn car driver license (further - the temporary certificate), in form according to appendix 3 to this Instruction, are documents of the strict reporting.

4. Forms of protocols, temporary certificates have single numbering within one area (the city of republican value, the capital) and the series corresponding to digital designation on the state registration plates of this region.

5. Accounting of receipt and issue of forms of the strict reporting is conducted in the Magazine of receipt and expense of forms of the strict reporting under form according to appendix 4 to this Instruction by divisions of administrative practice or the responsible.

6. The damaged forms of the strict reporting when carrying out reconciliation of availability and the correct expenditure of forms of the strict reporting are transferred by the head of the structural unit of Department of Internal Affairs to division of administrative practice or to the responsible for accounting and write-off.

7. The protocol and (or) the resolution together with the materials attached to them form administrative case.

8. Administrative cases within eight hours after their creation are submitted the head of the structural unit of Department of Internal Affairs, and in front divisions - to the commander of platoon which checks correctness and justification of creation of the protocol, application of the reduced production, legality of the issued decree, taking measures of ensuring production to administrative case.

After check administrative cases are certified by the signature of the head of the structural unit of Department of Internal Affairs (the commander of platoon), for example: "Checked. There are no notes", are registered in the Register of administrative cases in form, according to appendix 5 to this Instruction and are on receipt transferred to division of administrative practice or to the responsible is ten hours from the moment of their creation not later.
