About approval of the Technical regulation "About Safety of Fresh Fruit and Vegetables"

(as amended of the Order of the Government of the Kyrgyz Republic of 20.01.2015 No. 15)

According to the Law of the Kyrgyz Republic "About bases of technical regulation in the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve the enclosed Technical regulation "About Safety of Fresh Fruit and Vegetables".

2. This resolution becomes effective after six months from the date of official publication. This resolution is effective before entry into force in the territory of the Kyrgyz Republic of the corresponding technical regulation of the Customs union.

Technical regulation "About Safety of Fresh Fruit and Vegetables"

Chapter 1. General provisions

1. This Technical regulation "About Safety of Fresh Fruit and Vegetables" (further - the Technical regulation) is developed for the purpose of ensuring protection of life and health of citizens, animals and plants, environmental protection, the prevention of the actions misleading consumers of fresh fruit and vegetables.

2. The technical regulation establishes obligatory for application and execution of the requirement to safety of the fruit and vegetables intended for fresh consumption, to processes of their production, storage, transportation, realization and destruction.

Requirements of this Technical regulation extend to the fresh fruit and vegetables which are in circulation in the territory of the Kyrgyz Republic.

3. Objects of technical regulation of this Technical regulation are fresh fruit and vegetables:

1) potatoes;

2) tomatoes;

3) onion, leek and other bulbous vegetables, garlic;

4) cabbage headed, cauliflower, cabbage sheet and similar edible vegetables;

5) carrots, turnip, beet dining room, celery, garden radish and other root crops;

6) apples, pears and other seeded cultures;

7) bean cultures, hulled and unshelled;

8) melon cultures (water-melon, melon, etc.) and cucumbers;

9) apricots, cherry, sweet cherry, peaches, plum and others kostochkovy, grapes and other berry cultures (raspberry, currant, wild strawberry, sea-buckthorn, etc.);

10) green cultures (fennel, salad, parsley, etc.).

4. In this Technical regulation the following basic concepts are used:

safety of foodstuff - guarantee that foodstuff will not do harm to the consumer when this product is prepared and eaten according to its purpose;

the protected soil - constructions (greenhouses, hotbeds, the warmed soil) for cultivation of seedling, vegetable and fruit plants and product receipt all the year round;

identification - establishment of identity of fresh fruit and vegetables to their organoleptic and physical and chemical characteristics;

disinfecting - the actions for processing of seeds directed to destruction of causative agents of infectious diseases;

production supervision is the package of measures performed by physical persons and legal entities for observance of health regulations and hygiene standards, and also accomplishment of the preventive actions aimed at safety of products and reduction of contamination hazard of the made products;

the packer is physical person or legal entity which bears responsibility for stacking, marking and packaging of goods;

fumigation (aeration) - processing of products, raw materials and materials in hermetic conditions against wreckers (insects, arachnoid, rodents, etc.).

Chapter 2. Safety requirements to production processes of fresh fruit and vegetables

5. The fresh fruit and vegetables imported and made in the territory of the Kyrgyz Republic are allowed in the address in case of their compliance on safety indicators to the requirements of this Technical regulation established in appendices 1 and 2 to this Technical regulation.

6. In case of production of fresh fruit and vegetables requirements of the Law of the Kyrgyz Republic "The general technical regulation on providing ecological safety in the Kyrgyz Republic" shall be observed.

7. For the purpose of prevention of damnification to health of the consumer the producer in production process of fresh fruit and vegetables shall take measures for elimination of possible risks in case of:

1) disinfecting of seeds;

2) to preparation of the soil for crops;

3) use of fertilizers;

4) irrigation of the soil;

5) to sanitary processing of rooms, equipment and stock;

6) harvesting and its storage.

8. Safety of fresh fruit and vegetables in case of production is based on the following principles:

1) availability of obligatory information on the used landing material and seeds;

2) availability of the documents confirming quality and safety of each batch of pesticides, biological products, mineral fertilizers;

3) implementation of crop rotation or kulturooborot;

4) reducing contamination hazards of the environment.

9. Use is not allowed:

1) the raw sewer water for irrigation of the soil;

2) genetically modified grades and hybrids of plants, and also seeds and other landing material.

10. The sources of water supply and water constructions pumping water for economic and drinking needs from superficial and underground sources shall have zone of sanitary protection and conform to the requirements established by the legislation of the Kyrgyz Republic.

11. The container intended for transportation and storage of fresh fruit and vegetables shall be dry, net, without foreign smells.

12. Fresh fruit and vegetables shall be free from quarantine objects for ensuring environmental protection and meet the requirements of the legislation of the Kyrgyz Republic in the field of quarantine of plants.

13. The producer (seller) of fresh fruit and vegetables shall observe requirements of the Law of the Kyrgyz Republic "The technical regulation "Hygiene of Production of Foodstuff".

14. In fresh fruit and vegetables availability of pathogenic microorganisms and causative agents of parasitic diseases (egg of helminths, tsist of intestinal pathogenic protozoa and others) and their toxins constituting health hazard of the person is not allowed.

Chapter 3. Requirements to packaging, marking of fresh fruit and vegetables

15. When packaging presence of the deformed fruit and vegetables and (or) with signs of decay and mold is not allowed.
