About approval of the Standard regulations on departmental fire protection

According to part three of article 61 of the Code of civil protection of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve Standard regulations on departmental fire protection that is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Standard regulations on departmental fire protection

1. Departmental fire protection is created by subject of managing which belongs to the sphere of management of the ministry, of other central executive body (further - the company), in coordination with such ministry, body and consists of the state rescue and fire fighting divisions (parts) (further - rescue and fire fighting divisions) which number is determined by the subject of managing.

2. Departmental fire protection is created for accomplishment of the tasks provided by the Code of civil protection of Ukraine for the purpose of protection of life and human health, state-owned property against the fires and maintenance of proper level of fire safety on the objects belonging to the company.

3. Departmental fire protection in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, orders of the Ministry of Defence, other regulatory legal acts and regulations on departmental fire protection which affirms the relevant ministry based on this Standard provision.

4. The main objectives of departmental fire protection is ensuring fire safety, prevention of emergence of the fires and accidents during the fires, suppression of the fires, rescuing of the population, and also assistance in mitigation of consequences of other emergency situations.

5. The services of fire safety created for ensuring fire safety on objects of the Ministry of Defence, the Ministry of Internal Affairs, Ministry of Justice (objects of the Public criminal and executive service, the camp for content of prisoners of war), the SSU, Services of foreign intelligence, National police, Administration of Gosspetssvyaz, Administration of State frontier service, State special transservice, exercise control of observance of fire safety regulations on such objects.

6. Departmental fire protection according to the tasks assigned to it:

1) is prevented by emergence of the fires and accidents in case of the fires;

2) is performed by suppression of the fires, carries out evacuation of people and material values, actions for minimization or liquidation of the fires;

3) carries out rescue and other urgent works;

4) exercises control of observance of procedure for carrying out fire-dangerous works;

5) is represented by the company of the offer on carrying out research, project and construction work in the field of fire safety;

6) exercises control over the implementation of industry programs regarding ensuring fire safety;

7) participates in the solution of questions of staffing of departmental fire protection;

8) uses warning system objects in case of threat of origin or emergence of emergency situations, and also departmental mass media for informing on need of observance of requirements of fire safety;

9) performs other functions provided by acts of the legislation.

7. Officials of departmental fire protection have the right:

To receive 1) from officials and employees of the company of the data and documents on condition of fire safety, data on the fires, technical documentation on development and production of fire-dangerous devices, the equipment and other products, substances and materials;

2) to be involved in investigation of circumstances and reasons of the fires, death and injuring of people, destruction and damage of property;

3) to constitute protocols on administrative offenses and to prepare offers on accountability of persons guilty of violation of requirements of fire safety on the objects belonging to the company;

4) to participate in project development of departmental and industry standards, regulations, rules, specifications on production of products and the works establishing requirements to fire-dangerous engineering procedures and products;

To direct 5) in case of identification of violations of the requirements of fire safety creating threat of life and/or to human health, the corresponding materials to territorial authorities of DSNS for decision making.

8. The rescue and fire fighting divisions having the exit fire fighting equipment are involved in suppression of the fires according to the procedure, the established Ministry of Defence.

9. During suppression of the fires workers of departmental fire protection have the right to easy access to residential, production and other rooms, and also acceptance of all necessary measures directed to rescuing of the population, prevention of spread of fire and liquidation of the fire.

10. The head of departmental fire protection directly submits to the director or his deputy.

11. The methodical management, coordination of activities of departmental fire protection is performed by the director, and control of activities of departmental fire protection - DSNS.

12. Life, health and operability of persons who are employees of rescue and fire fighting divisions (except those which work in the organizations and the organizations financed from the Government budget of Ukraine), without fail are subject to insurance according to the signed insurance contract on classes of insurance 1 and 2, determined by article 4 of the Law of Ukraine "About insurance".

13. It is forbidden to involve employees of rescue and fire fighting divisions in accomplishment of the tasks which are not provided by this Standard provision.

14. The number of staff of rescue and fire fighting divisions is determined by the subject of managing according to the tasks assigned to such divisions and taking into account fire risk of production and standard states which affirm the ministry, other central executive body in coordination with DSNS.

15. On the executive positions and positions connected with accomplishment of functions on prevention of emergence of the fires and control in the field of fire safety persons having basic or complete higher vocational technical education are designated.

16. Financial and material logistics of departmental fire protection is performed by the subject of managing.
