About approval of Rules of issue of omissions on exit in territorial waters (sea) and internal waters of the Republic of Kazakhstan Kazakhstan undersized self-propelled and not self-propelled (surface and underwater) vessels (means) and vehicles on ice

According to Item 1 of article 48 of the Law of the Republic of Kazakhstan "About Frontier of the Republic of Kazakhstan" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of issue of omissions in territorial waters (sea) and internal waters of the Republic of Kazakhstan Kazakhstan undersized self-propelled and not self-propelled (surface and underwater) vessels (means) and vehicles on ice.

2. Recognize invalid:

1) the resolution of the Cabinet of Ministers of the Republic of Kazakhstan of January 4, 1994 No. 20 "About approval of the Instruction about procedure for document creation on exit (release) of watercrafts, vehicles on ice from places of basing and procedure for the equipment of moorings, piers and stationing sites of watercrafts, vehicles on ice and Rules of boundary regime at check points through Frontier of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan 1994, No. 1, the Art. 8);

2) Item 2 appendices to the order of the Government of the Republic of Kazakhstan of July 27, 2000 No. 1132 "About measures for improvement of servicing of passengers of the international flights at the airports of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan 2000, No. 31, the Art. 383).

3. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of issue of omissions on exit in territorial waters (sea) and internal waters of the Republic of Kazakhstan Kazakhstan undersized self-propelled and not self-propelled (surface and underwater) vessels (means) and vehicles on ice

Chapter 1. General provisions

1. These rules of issue of omissions on exit in territorial waters (sea) and internal waters of the Republic of Kazakhstan Kazakhstan undersized self-propelled and not self-propelled (surface and underwater) vessels (means) and vehicles on ice (further - Rules) determine procedure for issue of Committee of homeland security of the Republic of Kazakhstan by the Border service (further - the Border service) omissions on exit in territorial waters (sea) and internal waters of the Republic of Kazakhstan Kazakhstan undersized self-propelled and not self-propelled (surface and underwater) vessels (means) and vehicles by ice, and also foreign self-propelled and not self-propelled (surface and underwater) vessels (means), vehicles on ice which are temporarily operated in territorial waters (sea) and internal waters of the Republic of Kazakhstan (further - the omission).

2. Physical persons and legal entities (further - initiators) in case of exit from port (stationing site), stay in territorial waters (sea) and internal waters of the Republic of Kazakhstan and return to port (stationing site) on Kazakhstan undersized self-propelled and not self-propelled (surface and underwater) vessels (means) and vehicles on ice upon the demand of representatives of the Border service show for verification of the omission, issued by the Border service, and identity documents.

3. The border service when conducting search actions in boundary space has the right to bring restrictions or to temporarily suspend omissions what the state and local executive bodies are notified on.

Chapter 2. Procedure for issue of omissions

4. For receipt of omissions initiators represent in electronic format through the web portal of "the electronic government" (further - the portal) to the Border service the following documents:

1) representation on receipt of omissions for exit in territorial waters (sea) and internal waters of the Republic of Kazakhstan Kazakhstan undersized self-propelled and not self-propelled (surface and underwater) vessels (means) and vehicles on ice (further – representation) with the list of persons attached to it in form according to appendix 1 to these rules;

2) copies of allowing documents of the relevant authorized bodies for maintaining in territorial waters (sea) and internal waters of trade, research, prospecting or other activities.

5. State bodies and the organizations which intend to conduct sea scientific research and (or) prospecting activities in territorial waters (sea) in case of introduction through the portal of submissions to the Border service in addition provide information about:

1) nature and project objectives, description of the scientific equipment;

2) method and means which will be used, including the name, type and ships class, exact geographical data on areas to whom the project will be carried out;

3) to date of arrival and leaving of survey ships or in appropriate cases of placement and removal of the equipment;

4) name of the organization, head or person responsible for the project.

6. The brought representations shall be approved with the relevant territorial subdivision of Committee of homeland security of the Republic of Kazakhstan within three working days.

7. In case of factual determination of submission of the documents specified in items 4 and 5 these rules, not in full the Border service within two working days gives written motivated refusal about further review of representation in form according to appendix 2 to these rules.

8. The term of consideration of representation and issue of the omission by the Border service through the portal constitutes no more than fifteen working days from the moment of introduction of representation by the initiator.

9. Issue of the omission is performed by the Border service in form according to appendix 3 to these rules through the portal in electronic format.

10. The omission is issued for the term specified in representation taking into account effective periods of permission of the relevant authorized bodies to conducting trade, research, prospecting or other activities, but no more than one calendar year.

After effective period the omission voids.

11. In case of loss (spoil) of the omission by the initiator are represented the written petition for repeated issue of the omission to the Border service, and also written explanation upon its loss.

In time no more than three working days are performed by the border service repeated issue of the omission.
