About approval of the Regulations on procedure for development and approval of drafts of ecological standard rates

For the purpose of streamlining of system of ecological regulation by single approach to development, registration and approval of drafts of ecological standard rates, and also in pursuance of the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 27, 2013 "About the action program on environmental protection of the Republic of Uzbekistan for 2013 - 2017" the Cabinet of Ministers decides No. 142:

1. Approve Regulations on procedure for development and approval of drafts of ecological standard rates according to appendix.

2. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

3. To impose control of execution of this resolution on Information analysis department concerning agricultural and water economy, conversion of agricultural products and consumer goods of the Cabinet of Ministers of the Republic of Uzbekistan.

Regulations on procedure for development and approval of drafts of ecological standard rates

I. General provisions

1. This Provision determines procedure for development and approval of drafts of ecological standard rates of impact on the environment (further – drafts of ecological standard rates) the organizations, the individual entrepreneurs performing the production or rendering services connected with formation of emissions, dumpings of pollutants into the environment and waste (further - the organizations).

The scheme of development and approval of drafts of ecological standard rates is given in appendix No. 1 according to this Appendix.

2. Projects provide the reasonable ecological standard rates of impact on the environment (standard rates of emissions, dumpings, educations and placements of waste) developed based on results of inventory count of sources of environmental pollution.

3. In the Provision the following basic concepts are applied:

water disposal - set of the sanitary actions and technical devices providing removal of sewage limits of the settlement or the territory of the organization which is performed by means of the stormwater, industrial and household drainage system;

temporary placement of waste - storage of waste in the territory of the organization in the places and other squares which are specially equipped for these purposes until their use in the subsequent production cycle or sendings for conversion, utilization or subject to permanent placement of waste;

the statement for ecological effects - the final stage of assessment procedure of impact on the environment completed before acceptance by the completed construction (reconstruction, upgrade, expansion) of object (or its site) in operation and establishing ecological standard rates of impact on the environment;

inventory count of sources of emissions, dumpings of pollutants, educations and placements of waste - process of identification, registration, arrangement, determination of quantity, parameters of sources of emissions, dumpings, educations and placements of waste and high-quality composition of the pollutants which are thrown out to the environment;

source of environmental pollution - the anthropogenous object making the pollution caused by substances or set of the substances arriving to the environment in production process;

quota - the regulation of admissible content of pollutant in ground layer of the atmosphere calculated for the area of placement of the organization taking into account impact per capita and the environment;

class of danger of withdrawal - gradation of withdrawal or its component on degree of possible negative impact on objects of the environment and the person;

limit of placement of waste - the extreme number of waste permitted for placement for certain term;

regulation of formation of waste - withdrawal exit size in case of conversion of certain mass of the main raw materials or production of certain quantity of finished goods in the conditions of providing the standard rate of formation of waste;

the standard rate of formation of waste - assigned amount of waste of specific type in case of production of unit of production or per unit of initial raw materials;

regulation of emissions and dumpings of pollutants into the environment, educations and placements of waste - establishment of limits in which change of their natural property which is determined by reaction of the most sensitive type of organisms (indicators) to changes is allowed;

approximate and safe level of impact of the substance (OBUV) contaminating the atmosphere - the temporary standard rate of the substance contaminating the atmosphere established by calculation method for the purposes of designing of industrial facilities;

the threshold limit value (TLV) - concentration of pollutant in air, water, the soil which shall not cause reflex reactions in human body;

the maximum permissible emission (MPE) - the mass of pollutants in the emissions in unit of time creating the ground concentration which are not exceeding the maximum permissible quotas established for atmospheric air;

the maximum permissible dumping (MPD) - the mass of substance in sewage, the most admissible to assignment in the set mode in this Item in unit of time for the purpose of ensuring regulations of quality of water in the checkpoint;

the sanitary protection zone - the zone of space and vegetation which is specially allocated between the organization and the area of residence of the population, providing dispersion of ground concentration of pollutants to the level of regulations (quotas);

technical and achievable indicators - the indicators of sewage calculated taking into account technical capabilities of constructions on sewage treatment from pollutants;

waste recycling - extraction from waste of valuable components or use of waste as secondary raw materials, fuel, fertilizers and other purposes.

4. Drafts of ecological standard rates are developed by the organizations and are represented for conducting environmental assessment and approval to bodies of the State committee of the Republic of Uzbekistan for ecology and environmental protection (further - Goskomecologies).

5. In case of arrangement of sources of emissions, dumpings of pollutants into the environment, educations and placements of waste on several industrial platforms which are territorially removed from each other project development is made for each industrial platform separately. As criterion of remoteness of platforms serves lack of mutual impact of the sources of environmental pollution located on them.

II. Procedure for project development of ecological standard rates.

General provisions

6. Project development of ecological standard rates consists of two stages:

carrying out inventory count of sources of emissions, dumpings, educations and placements of waste;

regulation of emissions, dumpings, educations and placements of waste.

7. Inventory count is carried out on purpose:

determinations of parameters of sources of emissions, dumpings, educations and placements of waste;

determinations of basic data for development of standard rates of emissions, dumpings, educations and placements of waste;

estimates of ecological characteristics of the technologies and materials used in the organization;

developments of actions for environmental protection from pollution.

8. Inventory count is carried out directly the organization or with involvement of the legal entities and physical persons specializing in development of materials on protection and rational use of natural resources, once for the period works of the organization.

In case of reconstruction and change of the production technology refining of data of the inventory count which is carried out earlier based on which develops new drafts of ecological standard rates is made.

9. For accuracy of the data of inventory count of sources of emissions, dumpings of pollutants into the environment, educations and placements of waste responsibility is born by the head of the organization (the project orderer of ecological standard rates) in the procedure established by the legislation.

10. Inspection of sources of emissions, dumpings, education and locations of waste which name shall correspond to production schedules of production is carried out in inventory progress consistently on technological chain, beginning from the basic and finishing with side productions.

III. Procedure for project development of ecological standard rates of maximum permissible emissions of pollutants in the atmosphere

11. Inventory count of sources of pollution of the atmosphere is carried out according to requirements of this provision and includes:

inspection of sources of pollution of atmospheric air, the pyleochistny and gas-catching equipment, determination of their parameters (height, diameter) and characteristics of emissions (temperature, speed);

determination of location of each of sources of emissions in local system of coordinates of industrial site of the organization;

determination of quantity and structure of allocations and emissions of pollutants in the atmosphere;

efficiency evaluation of operation of the pylegazoochistny equipment and other airsecurity actions of the organization.

12. Stages of carrying out inventory count:

at the first stage data collection about the organization as source of pollution of the atmosphere is performed: about location, structure of the organization, the scheme and the description of engineering procedures, balance sheet schemes of the main and auxiliary productions. Data on availability and quantity of sources of emissions, annual fuel consumption, raw materials and materials are provided;

at the second stage visual and tool inspection of sources of allocation and emissions of pollutants, efficiency of the pylegazoochistny equipment are carried out, their characteristics are determined;

at the third stage the analysis and systematization of the received results is made, four Sections of the form of inventory count of sources of emissions in form according to appendix No. 2 to this Provision are filled in.

13. Determination of quantity and structure of allocations and emissions of pollutants in the atmosphere is made by calculation methods according to the techniques approved from Goskomecology or the techniques which are drawn up in the form of the industry regulating documents approved from Goskomecology with attraction, in case of need, of tool measurements.

14. Names of pollutants, value of their ecological standard rates, maximum allowable concentration shall conform to the approved standards. In the absence of maximum allowable concentration on pollutant it is necessary to consider footwear.

15. On sources of emissions of pollutants end-to-end numbering on increasing, according to the procedure of carrying out inventory count is entered.

When refining inventory count of number of the liquidated sources of emissions fall, and again entered the sequence numbers following the last are assigned.

16. The purpose of regulation of emissions of pollutants of the organization from which they arrive in the atmosphere is ensuring compliance with the criteria of quality of atmospheric air regulating maximum permissible content of pollutants in it for health of the population and the main components of ecological system, and also condition in case of which maximum permissible (critical) loads of ecological system outside border of the organization or its sanitary protection zone are provided.

17. The main criterion for establishment of PDV are quotas for the pollutants for different ekologo-economic areas given in appendix No. 3 to this Provision.

18. Regulation of emissions of pollutants in the atmosphere is established by results of calculations of their ground concentration outside industrial site received taking into account the climatic and meteorological characteristics, for form according to appendix No. 4 to this Provision accepted as basic data for calculation of dispersion of pollutants, with further identification of compliance of the received results to the established regulations on each pollutant and creation of the list of pollutants in form according to appendix No. 5 to this Provision.

Sizes PDV are established in g/sec. and ton/year.

In case of exceeding of regulations the emissions calculated on condition of observance of quotas outside the platform are accepted to the standard rate and nature protection actions for their achievement for form according to appendix No. 6 to this Provision are developed. For confirmation of efficiency of the offered nature protection actions control calculations of ground concentration of pollutants are carried out.

19. Exceeding of standard rates of PDV is established if the actual value of gross emission (ton/year) for the organization in general for the considered year is more, than the established size PDV (ton/year) on substance, source, the organization, or the actual value of the maximum one-time emission (/c) from any source of emission or the organization in general is higher than the established sizes in/page.

20. One-time emission of pollutants from one source which duration does not exceed 5% of working hours of the capital processing equipment a year belongs to volley and is not subject to regulation. The characteristic of volley emissions are entered in the table in form according to appendix No. 7 to this Provision.

21. For the organizations, by the form activities belonging to the IV category of impact on the environment, the standard rate of PDV is established according to the actual data obtained by results of the carried-out inventory count without project development of PDV and conducting the state environmental assessment.

IV. Procedure for project development of ecological standard rates of maximum permissible dumpings of pollutants into superficial reservoirs and land relief

22. Inventory count of sources of formation of sewage is carried out according to requirements of this provision and includes:

results of inspection of sources of water supply with data acquisition about the quality and quantity characteristic of the initial water consumed on the technological, economic and drinking purposes, having watered (irrigation), fire extinguishing, methods of its cleaning, amounts of turnover, repeated and repeated and consecutive water supply in form according to appendix No. 8 to this Provision;

balance sheet technological schemes of the basic, auxiliary and other productions with indication of normative and actual amounts of water consumption and water disposal separately on each site;

technological reasons for privnos of pollutants in the formed sewage on each specific production site;

reasons according to the accepted scheme of water disposal of number of releases of sewage with indication of their quality characteristic (with appendix of analysis results of quality of water);

the description of structure and technical condition of constructions on sewage treatment, efficiency of their work according to analyses of composition of sewage before cleaning in form according to appendix No. 9 to this Provision;

results of inspection of receivers of sewage in the location of each release and their description with indication of: names of water object where dumping of sewage, categories of water use, the topographical and hydrological characteristic, background concentration of pollutants in waterway which are drawn up according to appendix No. 10 to this Provision is performed.

In case of dumping of sewage on land relief data on type, permeability and filterability of the soil creating the natural bottom of water intake on the level of bedding of ground waters and their high-quality structure in form according to appendix No. 11 to this Provision are represented.

23. Its different lowerings, including ravines, hollows, the developed pits, deepenings in sands and dry beds of Sai and streams belong to land relief.

24. Dumpings of pollutants with production and economic and household waste, and also drainage waters are subject to regulation.

25. Size PDS is determined how the work of average daily hour consumption of sewage on concentration of pollutant, admissible to dumping.

26. Regulation of dumpings of pollutants into the environment is made by establishment of PDS of these substances with sewage in water objects or on land relief. When calculating PDS for the pollutants dumped with sewage after cleaning on constructions (mechanical, physical and chemical, biological, etc.), the technically achievable indicators (TAI) are used:

TDP1 - indicators of sewage, achievable in case of optimum operation of the treatment facilities operating on object;

TDP2 - indicators of sewage, achievable in case of use of the standard technology providing the best quality of the purified water taking into account technical and economic capabilities during the period of time established Goskomecologies;

TDP3 - indicators of sewage, achievable in case of use of the most effective technology and as close as possible to the threshold limit values (TLV).

27. PDS established taking into account technically achievable indicators are basis for further planning of the water preserving actions and can be reviewed in terms, the established Goskomecologies, with gradual transition to more tough regulations depending on ecological situation, terms of accomplishment of the approved actions directed to improvement of quality of the dumped sewage, etc.

28. Standard rates of PDS are established in the settlement way or according to project data based on the analysis of water material balance of the organization taking into account the composition of initial water and components used in the applied technology taking into account background concentration, in form according to appendix No. 12 to this Provision.

In all cases of PDS not higher than the level of background quality of the natural water used for dumping of sewage, and not below the threshold limit values established for superficial reservoirs of fishery and (or) cultural and community value is established.

29. The list of the normalized pollutants which are not introduced in sewage by engineering procedures is limited to the list according to appendix No. 13 to this Provision.

V. Procedure for project development of ecological standard rates of education and placement of waste

30. Inventory count of education and placement of waste is carried out to compliance with requirements of this provision and includes:

results of inspection of sources of formation of waste with data acquisition about their high-quality and quantitative characteristics, at the same time for determination of number of the formed waste are used:

the analytical method consisting in determination of quantitative exit of withdrawal in the conditions close to the operating engineering procedures;

the statistical technique representing set of methods and the methods of statistics opening conditions of formation of waste;

balance sheet and technological schemes of the basic, auxiliary and other productions;

information about composition of raw materials (materials, fuel), the nomenclature and outputs, operating mode of processing equipment (are presented in the form of the official reference);
