The instruction about procedure for accreditation of legal entities (individual entrepreneurs) on rendering services in the field of labor protection

Chapter 1. General provisions

1. This Instruction establishes procedure for accreditation of legal entities (individual entrepreneurs) on rendering services in the field of labor protection for implementation of functions of the labor protection specialist and carrying out certification of workplaces under the terms of work (further – accreditation).

2. For the purposes of this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus "About labor protection" are applied.

3. The requirements and conditions shown to legal entities (individual entrepreneurs) applying for accreditation (further if other is not established, - interested persons), are:

3.1. for implementation of functions of the labor protection specialist:

availability in staff of the legal entity of the specialist (specialists) for which, (which) work at this employer is principle place of employment according to the employment contract (contract), having (having) the higher education with qualification "engineer" or other higher education on condition of passing by it (them) retrainings at the level of the higher education in retrainings "labor protection specialist", length of service in the field of labor protection at least three years which passed (passed) advanced training concerning labor protection (if from the date of the end of training in labor protection by preparation, retraining or advanced training there passed more than three years), and also examination concerning labor protection in the terms established by the legislation;

availability at the individual entrepreneur of the higher education with qualification "engineer" or other higher education on condition of passing of retraining by it at the level of the higher education in retrainings "labor protection specialist", the length of service in the field of labor protection at least three years which underwent advanced training concerning labor protection (if from the date of the end of training in labor protection by preparation, retraining or advanced training there passed more than three years), and also examination concerning labor protection, in the terms established by the legislation;

3.2. for carrying out certification of workplaces under the terms of work (further – certification):

availability of the test laboratory accredited in the National accreditation system of the Republic of Belarus;

availability of the specialist (specialists) having (having) the higher education, work experience on carrying out certification, assessment of factors of the production circle, weight and intensity of the labor process at least three years which took place (passed) advanced training concerning certification (if from the date of the end of training in case of advanced training there passed more than three years);

software availability for registration of results of certification in electronic form.

4. The requirements and conditions shown to activities of legal entities (individual entrepreneurs) accredited on rendering services in the field of labor protection are:

observance of requirements of regulatory legal acts, including the technical regulatory legal acts which are according to legal acts and resolutions of Council of Ministers of the Republic of Belarus obligatory for observance, local legal acts, organizational and administrative documents concerning protection and working conditions;

advanced training according to the procedure, established by the legislation;

passing of examination concerning labor protection in the commissions of local executive and administrative organs:

workers of the legal entity - in the location of the legal entity;

the individual entrepreneur - at the place of residence;

observance throughout the entire period of action of accreditation of the requirements and conditions established in Item 3 of this Instruction.

Chapter 2. Procedure for accreditation

5. For accreditation interested persons represent in writing (the courier (courier), by means of mail service) to the Ministry of Labour and Social Protection the application signed by the head of the legal entity (individual entrepreneur) and also the following documents:

for implementation of functions of the labor protection specialist:

the copy of the diploma about the higher education (the diploma about retraining at the level of the higher education in retrainings "labor protection specialist");

the copy of the service record and if functions of the labor protection specialist are assigned to the authorized officer of the employer, the copy of the order on assignment of the corresponding obligations;

for certification:

the copy of the diploma about the higher education;

copy of the service record.

For implementation of functions of the labor protection specialist are specified in the statement for accreditation:

service type in the field of labor protection which the interested person assumes to render;

the full and abbreviated name of the legal entity (surname, own name, middle name (if that is available) the individual entrepreneur), registration number and date of state registration of the legal entity (individual entrepreneur), the location (for the legal entity), contact information (phone (fax), the e-mail address);

surname, own name, middle name (if that is available) the specialist (specialists) who is (consisting) on the staff of the legal entity performing (performing) function of the labor protection specialist;
