According to article 21 of the Law of Ukraine "About seaports of Ukraine",  subitems 4.3.22 and 4.3.23 of subitem 4.3 of item 4 of the Regulations on the Ministry of infrastructure of Ukraine approved by the Presidential decree of Ukraine of May 12, 2011 No. 581, of the subitem "g" of Item 2 of Powers of the central executive bodies, Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations, actuators of city councils on price regulation and rates for separate types of products, goods and services (appendix to the resolution of the Cabinet of Ministers of Ukraine of December 25, 1996 No. 1548 (with changes), resolutions of the Cabinet of Ministers of Ukraine of June 3, 2013 No. 405 "About approval of the list of specialized services in seaport subjects of natural monopolies which are subject to state regulation" PRIKAZYVAYU:

1. Approve Rates for services in providing pilotage duty of courts which are applied.

2. Actually ceased to be valid according to the Order of the Ministry of infrastructure of Ukraine of 10.06.2014 No. 239

3. To provide to department of state policy in the field of sea and river transport:

1) submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine;

2) promulgation of this order on the official site of the Ministry of infrastructure of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the deputy minister Demidovich D. V.

Rates for services in providing pilotage duty of courts

I. General provisions

1.1. Rates for services in providing pilotage duty of courts (further - pilotage service) are levied in sea ports / maritime terminals from courts  which groups are specified in appendix 1 to these Rates.

1.2. The pilotage service is levied from all courts coming into sea ports / maritime terminals or the following in transit by shipping waterways.

The pilotage service is not levied in cases if according to the legislation pilotage duty in this area is not obligatory or the vessel is referred to category of the courts exempted from obligatory pilotage duty, and services in providing pilotage duty were not ordered and were not provided.

1.3. Charge of pilotage service is performed from conditional amount of the vessel calculated in cubic meters and is equal to the work of three sizes (vessel length, width of the vessel and depth of the vessel) specified in the measuring certificate (principal dimensions) or the document which replaces it.

The conditional amount of the vessel is subject to rounding in the following procedure: to 0,50 of cubic meter it is discarded, and 0,50 of cubic meter also is more rounded to 1 cubic meter.

The pilotage service is charged on vessel amount at least 5000 cubic meters. The vessel amount less than 5000 cubic meters is considered 5000 cubic meters.

For the ocean ships which are transporting loads on upper deck or having two or more decks except tween-deck courts, the depth used for calculation of amount of the vessel shall constitute at least a half of width of the vessel.

For the vessels of group B having two or more decks, the depth used for calculation of amount of the vessel shall constitute half of width of the vessel.

The conditional amount of barzho-towing structures, caravans and other compound floating constructions for charge of pilotage service is equal to the amount of amounts of separate elements.

For calculation of pilotage service conditional amount of courts of the RHO-RHO, RO-Flou, OBO, LO-RO, container carrying ships, hudobovoziv, light carriers, automobile-carriers is applied with 0,7 coefficient on condition of use of the specified courts according to their specialization. The type of vessel and its specialization are determined by ship's papers.

1.4. The pilotage service includes expenses on floating crafts which are used for delivery of the pilot to the vessel or removals of the pilot from the vessel.

For delivery/removal of the pilot about the vessel(s) during ice campaign, appears according to the current legislation, the allowance in the amount of 10 percent is applied to pilotage service (without discounts and/or allowances).

1.5. The main signs of the line of foreign shipping are:

establishment obligatory and optional foreign (for lines of foreign swimming) and the Ukrainian ports of call;

fixing for line work of types of vessel;

establishment of frequency of calling of the fixed courts the Ukrainian ports;

registration of the line Maritime administration on representation of seaports of Ukraine to Administration.

1.6. The pilotage service raises in overtime:

in the working days from 22:00 till 6:00 (night time) - for 25 percent;

on Saturday, Sunday and holidays according to calendar:

from 6:00 till 22:00 - for 50 percent;

from 22:00 till 6:00 - for 100 percent.

Calculation of the amount of the allowance is perfromed on the following formula:
