1. Approve Regulations on working conditions of the foreign specialists involved to training of athletes - members of national teams of the Republic of Uzbekistan on sports, according to appendix.

2. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan A. I. Ikramov.

Regulations on working conditions of the foreign specialists involved to training of athletes - members of national teams of the Republic of Uzbekistan

I. General provisions

1. This Provision determines payment procedure and working conditions of the foreign specialists involved to training of athletes - members of national teams of the Republic of Uzbekistan on the basis of the employment contract (contract) which compensation is performed at the expense of budgetary funds.

2. In this Provision the following basic concepts are used:

the foreign specialist - the specialist in the field of sport from other country having practical sports experience;

the employer - republican school of the highest sports skill, republican sports federation (association, the center, etc.) on sports;

the sports consultant - the specialist by the form sport giving advice (consultations) concerning training of the athlete or team and also in the course of their participation in sports competitions;

the sports manager - the specialist in the field of management, economies, psychology, sociology providing productive professional activity of the athlete or team;

the trainer - the physical person having the corresponding education performing carrying out educational and training and physical cultural events and also management of competitive activities for achievement of sports results.

3. The foreign specialist can be employed as the trainer, sports manager, the sports consultant.

4. The foreign specialist involved to training of athletes - members of national teams of the Republic of Uzbekistan, can work in the territory of the Republic of Uzbekistan in the presence of the confirmation on the right of labor activity issued on his name in accordance with the established procedure and based on the permission to attraction of foreign labor power got by the employer.

II. Submission of offers on the conclusion of employment contracts (contracts) with foreign specialists

5. The employer studies activities of foreign specialists on the basis of their results. Following the results of studying makes the choice of the productive foreign specialist and enters with it negotiations.

6. In case of the consent of the foreign specialist to render the services to the employer the last prepares necessary documents for preparation of offers on the conclusion with it the employment contract (contract).

7. The employer represents to the Ministry of physical culture and sport of the Republic of Uzbekistan (further - the Ministry) offers on the conclusion of employment contracts (contracts) with foreign specialists (further - proposals of the employer) which contain:

data on trainer's activities of the foreign specialist;

program of the foreign specialist in training of athletes;

education documents of the foreign specialist (in the presence);

the expected amount of monthly payment of work of the foreign specialist (in the amount of thirty to hundred minimum wages, except soccer specialists whose amount of payment is determined by the agreement (contract) the concluded parties.

8. The ministry sends proposals of the employer to Commission of experts which is created in case of it.

III. Consideration of proposals of employers on the conclusion of employment contracts (contracts) with foreign specialists in Commission of experts

9. The commission of experts is created by the order of the minister of physical culture and sport of the Republic of Uzbekistan.

The commission of experts is created as a part of at least seven people, with inclusion of chiefs of the relevant managements in it and managements of personnel of authorized body, representatives of National Olympic Committee of Uzbekistan, Republican schools of the highest sports skill and republican sports federations (associations, the centers, etc.) on sports.

The commission of experts is headed by the chairman (at the level not below the deputy minister of physical culture and sport).

10. The commission of experts within one month considers proposals of the employer regarding feasibility of allocation of budgetary funds for compensation of the foreign specialist invited by the employer.

11. The meeting of Commission of experts is conducted by the chairman, and in case of its absence - one of members of Commission of experts according to the decision of the chairman.

12. The meeting of Commission of experts is considered competent if at it there are at least two thirds of total number of members of Commission of experts. Decisions are made by open voting.

13. The commission of experts considers proposals of the employer and makes the decision on feasibility of allocation of budgetary funds for compensation to the foreign specialist or on refusal in allocation of budgetary funds.

14. The solution of Commission of experts is deemed accepted if the simple majority of the members of the commission who are present at meeting voted for it. In case of equality of votes the voice of the chairman is decisive.

15. The solution of Commission of experts is drawn up by the protocol and signed by the chairman and the secretary of Commission of experts.

16. In case of decision making about feasibility of allocation of budgetary funds for compensation to the foreign specialist the commission of experts at the same time determines the size of these means (from thirty to hundred minimum wages on the date of the conclusion of the agreement (contract). At the same time are considered:

the documents listed in Item 8 of this provision:

the predicted results on training of athletes - members of national teams of the Republic of Uzbekistan.

17. In case of decision making about refusal in allocation of budgetary funds for compensation of the foreign specialist offered by the employer in the solution of Commission of experts causes of failure are specified.
