The purpose of this Law is regulation of the relations in the field of environmental control.
The legislation on environmental control consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about environmental control then are applied rules of the international treaty.
Environmental control - system of the state and public measures directed to prevention, identification and suppression of violation of requirements of the legislation in the field of environmental protection and rational use of natural resources, increase in efficiency of nature protection activities.
The main objectives of environmental control are:
prevention, identification and suppression of violation of requirements of the legislation in the field of environmental protection and rational use of natural resources;
observation of state of environment, identification of situations which can lead to environmental pollution, irrational use of natural resources, create threat of life and to health of citizens;
determination of compliance to ecological requirements of the planned or performed economic and other activity;
ensuring compliance with the rights and legitimate interests of legal entities and physical persons, accomplishment of obligations by them in the field of environmental protection and rational use of natural resources;
informing the state and other organizations and citizens on changes in the environment, forecasts of its condition, use of natural resources and the taken adequate measures;
increase in efficiency of nature protection activities and ensuring participation of self-government institutions of citizens, non-state non-profit organizations and citizens in implementation of the state and other ecological programs.
The basic principles of environmental control are legality, objectivity, independence, publicity, protection of the rights and legitimate interests of the personality, society and state.
The main directions of state policy in the field of environmental control are:
forming and development of system of environmental control;
creation of the favorable environment for life and health of citizens;
enhancement of organization-legal mechanisms of interaction of specially authorized state bodies in the field of environmental control (further - specially authorized state bodies), public authorities on places, bodies of the public and economic board, business entities with self-government institutions of citizens, non-state non-profit organizations and citizens in ensuring environmental protection and rational use of natural resources;
development of international cooperation in the field of environmental control.
Subjects to environmental control are:
earth, its subsoil, waters, plant and animal life, atmospheric air;
natural and technogenic sources of impact on the environment;
activities, action or failure to act which can lead to environmental pollution and irrational use of natural resources, create threat of life and to health of citizens.
Subjects of environmental control are:
Cabinet of Ministers of the Republic of Uzbekistan;
specially authorized state bodies;
public authorities on places;
bodies of the public and economic board;
business entities, self-government institutions of citizens;
non-state non-profit organizations;
citizens.
Types of environmental control are:
state environmental control;
departmental environmental control;
production environmental control;
public environmental control.
Cabinet of Ministers of the Republic of Uzbekistan:
provides realization of single state policy in the field of environmental control;
approves the state ecological programs and exercises control of their realization;
determines procedure of the state environmental control, and also state monitoring of the environment;
approves standard regulations on procedure of departmental, production, public environmental control, on environmental service, and also on the public inspector of environmental control;
performs international cooperation in the field of environmental control.
The Cabinet of Ministers of the Republic of Uzbekistan can perform also other powers according to the legislation.
Specially authorized state bodies are the State committee of the Republic of Uzbekistan on ecology and environmental protection, the Ministry of Health of the Republic of Uzbekistan, the State committee of industrial safety of the Republic of Uzbekistan, the Ministry of Internal Affairs of the Republic of Uzbekistan, the Ministry of agricultural and water economy of the Republic of Uzbekistan, the Agency on quarantine and protection of plants of the Republic of Uzbekistan, the State committee of veterinary science and development of livestock production of the Republic of Uzbekistan, the Ministry of Agriculture of the Republic of Uzbekistan.
The state committee of the Republic of Uzbekistan on ecology and environmental protection coordinates activities of other specially authorized state bodies in the field of the state environmental control.
Specially authorized state bodies:
participate in realization of single state policy in the field of environmental control;
exercise the state environmental control;
programs of the state monitoring of the environment participate in development of the state and other ecological programs, including, and provide their realization;
