About enhancement of structure of executive bodies of the government of the Republic of Tajikistan

For the purpose of forming of effective system of public administration for ensuring strategic planning and sustainable social and economic development of the country, taking into account provisions of the Law of the Republic of Tajikistan "About system of state bodies of the Republic of Tajikistan" and according to article 69 of the Constitution of the Republic of Tajikistan I decide:

1. Approve the enclosed structure of the central executive bodies of the government of the Republic of Tajikistan.

2. Determine that:

- state bodies are a part of the system the ministries, the state committees, committees, services, the agencies and head departments;

- obligations of state bodies which management of activities is performed of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan are determined by the provisions approved respectively by presidential decrees of the Republic of Tajikistan and the orders of the Government of the Republic of Tajikistan;

- for the purpose of non-admission of abuse of intra-branch levers for protection of interdepartmental interests, relations of the ministries and state committees with services and the agencies of their systems are performed according to the laws and other normative simple acts of the Republic of Tajikistan.

3. Establish to the Prime Minister of the Republic of Tajikistan of four deputies, including the one first deputy.

5. Form the Industry ministry and new technologies of the Republic of Tajikistan.

6. Transform the Ministry of Education of the Republic of Tajikistan to the Ministry of Education and Science of the Republic of Tajikistan.

Determine that functions of maintaining scientific policy are removed from circle of powers of Academy of Sciences of the Republic of Tajikistan and are assigned to the specified Ministry.

7. Transform the Ministry of Labour and Social Protection of the population of the Republic of Tajikistan to the Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan.

Determine that the Migratory service under the Government of the Republic of Tajikistan joins in system of the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan.

8. Transform the Ministry of Health of the Republic of Tajikistan to the Ministry of Health and Social Protection of the Republic of Tajikistan.

Determine that the functions connected with social protection of the population of the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan are assigned to the Ministry of Health and Social Protection of the Republic of Tajikistan and Public service of medico-social examination of the Ministry of Labour and Social Protection of the population of the Republic of Tajikistan is placed under departmental authority of the Ministry of Health and Social Protection of the Republic of Tajikistan.

9. Abolish the Ministry of melioration and water resources of the Republic of Tajikistan.

10. Rename the State committee of land management and geodesy of the Republic of Tajikistan into the State committee of land management and geodesy of the Republic of Tajikistan.

11. Rename Committee on cases of religion under the Government of the Republic of Tajikistan into Committee on religion, streamlining of traditions, celebrations and ceremonies under the Government of the Republic of Tajikistan.

12. Transform the Agency on construction and architecture under the Government of the Republic of Tajikistan to Committee on architecture and construction under the Government of the Republic of Tajikistan.

13. Transform Head department on the state supervision of safe operation to the industries and to mountain supervision under the Government of the Republic of Tajikistan in Service on the state supervision of safe operation in the industry and to mountain supervision under the Government of the Republic of Tajikistan.

14. Form the Agency of forestry under the Government of the Republic of Tajikistan.

Determine that the Public institution of forestry and hunting of Committee of conservation under the Government of the Republic of Tajikistan joins in system of this Agency.

15. Form the Agency of melioration and irrigation under the Government of the Republic of Tajikistan.

Determine that the functions connected with melioration and irrigation of the abolished Ministry of melioration and water resources of the Republic of Tajikistan are assigned to the specified Agency.

16. Transform the State agency of social insurance and pensions of the Republic of Tajikistan to the Agency of social insurance and pensions under the Government of the Republic of Tajikistan.

17. For the purpose of promotion of reform in system of local authority, coordination of activities of local executive bodies of the government and local government bodies, assistance in uniform development of regions of the country to form Committee on local development in case of the President of the Republic of Tajikistan.

18. Transform Management of public service in case of the President of the Republic of Tajikistan to the Agency of public service in case of the President of the Republic of Tajikistan.

19. To the government of the Republic of Tajikistan:

- provide enhancement of structure of state bodies based on this Decree;

- in three-months time to develop and approve structure of central office, the scheme of management and provision of again formed and restructured ministries and departments with ensuring accurate distribution of functions and elimination of duplication of functions and powers of state bodies;

- resolve the organizational, financial and material matters following from this Decree;
