1. Approve the Procedure for conducting non-state examination of project town-planning documents and accreditation of experts it (is applied).

1. The procedure for conducting non-state examination of project town-planning documents and accreditation of experts (further the Procedure) is developed for the purpose of implementation of articles 64 and 65 of the Town-planning code of the Republic of Tajikistan.
2. In this Procedure the following basic concepts are applied:
- non-state examination - examination of project documents, for the purpose of control of observance of requirements of regulatory legal acts of the Republic of Tajikistan, regulations, rules and standards after project development;
- accreditation of experts is process for physical persons and legal entities for the purpose of receipt of the right of conducting non-state examination of construction projects by authorized state body in the field of architecture and town planning;
- national standards are standard which was approved and accepted by authorized state body of the Republic of Tajikistan on standardization;
- project documentations - the purpose of physical persons and legal entities or the state on providing favorable conditions for the environment and life activity of the person who is presented in the form of architecture, town planning and construction documents (drawings, graphical and text materials, engineering calculation and expenses);
- the certificate on power is document which is issued to physical persons and legal entities, authorized state body after accreditation passing.
3. This Procedure establishes conducting non-state examination of project documents of construction of facilities and accreditation of experts.
4. Non-state expertize is carried out by physical persons and legal entities which underwent the state accreditation (further - the non-state expert) at the initiative of the builder, the customer or person, on the basis of the agreement, concluded with the builder or the customer who prepares project documents or inzhenerno - prospecting works.
5. Project documents for non-state examination can be submitted in full or separate parts.
6. Non-state examination will be executed on the basis of the signed contract between the applicant and the non-state expert.
7. Non-state examination can carry out project documents of capital construction (separate parts of construction projects, updating, major repair) which conducting examination requires the legislation of the Republic of Tajikistan.
8. Conducting non-state examination of project documents, this determination of compliance of project documents to the following requirements:
- to construction regulations and rules, regulatory legal acts of the sphere of town planning, technical requirements, including to sanitary and epidemiologic, ecological, protection of objects having cultural heritage, fire-proof, industrial, nuclear, radiation requirements and to other safety;
- to results of engineering and prospecting works;
- to the established estimate norms;
- to requirements of town planning;
- to national standards;
- architectural planning to task;
- to design assignment.
9. Results of non-governmental examination of these conclusions about compliance (positive) project documents or their discrepancy (negative) is the requirement of Item 8 of this Procedure. In the conclusion recommendations after modification to project documents and for improvement of project decisions are reflected.
10. For conducting non-state examination the following documents are submitted:
- the letter or the statement for conducting state examination;
- project documents for construction of the main objects according to regulations and rules of town planning;
- the decision of local executive body of the government on construction;
- specifications for connection to points of engineering networks;
- approval of the project with relevant organs of the state control;
- architectural and planning task;
- results of engineering and prospecting works;
- copy of task for accomplishment of engineering and prospecting works.
11. The requirement of other documents which are not provided by this Item is forbidden.
12. The conclusion of non-state examination is signed by the authorized expert and affirms the head of body of non-state examination.
13. For conducting non-state examination the applicant can address several non-state experts at discretion.
14. The sample of the conclusion of non-state examination is established by authorized state body on town-planning activities.
15. Non-state examination is paid, is performed based on Regulations on working price lists on conducting non-state examination of construction projects and payments of the salary of experts approved according to the legislation of the Republic of Tajikistan by authorized state body in the field of architecture and town planning.
16. Accreditation of physical persons and legal entities for the purpose of receipt of the right of conducting non-state examination of construction projects is carried out by authorized state body in the field of architecture and town planning (further - authorized state body).
17. Physical persons and legal entities undergo accreditation for receipt of the following powers:
- conducting non-state examination of project documents;
- conducting non-state examination of results of engineering and prospecting works;
- conducting non-state examination of project documents and engineering and prospecting works.
18. Non-state experts perform the activities only within the powers received after accreditation.
