Based on provisions of article 46 of the Law on water No. 272 of December 23, 2011. (The official monitor of the Republic of Moldova, 2012, No. 81, the Art. 264) DECIDES: the Government

1. Approve Regulations on quality requirements of underground waters it (is applied).

2. To impose control of execution of this resolution on the Ministry of the environment.

Regulations on quality requirements of underground waters

Chapter I General provisions

1. The regulations on quality requirements of underground waters (further - the Provision) establish both quality requirements of underground waters, and regulation concerning condition of underground waters, tasks on their management, and also regulations concerning procedure for use and protection of underground waters from impact of any kind of pollution.

2. This Provision partially shifts Article 4 and appendix to the Directive 2000/60/CE of the European Parliament and Council of October 23, 2000 about establishment of political bases of Community in the field of the water published in the Official magazine of the European Union by L 327 of December 22, 2000 and also the Directive 2006/118/CE of the European Parliament and Council of December 12, 2006 about protection of underground waters from pollution and deterioration published in the Official magazine of the European Union by L 372 of December 27, 2006.

3. Requirements of this provision extend to the central specialized bodies, bodies of local public authority, owners of water supply systems and consumers of water, the company and organization who perform designing, construction and operation of systems of supply with drinking water, state bodies which perform control and supervision in the field of protection of underground waters, and also on physical persons and legal entity which activities directly or indirectly influence quality of underground waters.

4. For the purposes of this provision the used concepts have the following values:

roof of water-bearing layer - the layer of waterproof or rather waterproof breeds expanded in the upper part of water-bearing (complex) layer;

the quality requirement of underground waters - the value expressed by concentration of certain pollutant, group of pollutants or indicator of pollution in underground water which shall not exceed admissible regulations to provide health protection of the person and the environment;

bed of water-bearing layer - the layer of waterproof or rather waterproof breeds expanded under sole of water-bearing (complex) layer;

artesian well / artesian well - the vertical excavation of round section drilled in crust for the purpose of hydrogeological investigation and intake of underground waters;

level of natural geochemical background - concentration of substance or measure value in underground water object which corresponds to lack of anthropogenous changes or only the smallest changes, in proportion to undisturbed conditions;

the available resource of underground waters means annual average long-term level on gas station of underground water objects minus the annual average long-term level of output necessary for achievement of nature protection tasks concerning the surface water provided in management plans by basin districts for the purpose of avoidance of considerable change of condition of these waters and avoidance of any caused damage to the related land ecosystems;

good shape of underground waters means condition of underground water object when its quantitative and chemical condition, at least, good;

the good chemical shape of underground waters means condition of underground water object which complies with the following conditions:

1) chemical composition of underground water object shall be such that concentration of pollutants did not exceed the quality requirement of the underground waters established according to appendix No. 1 to this Provision;

2) chemical composition of underground water object shall be such that concentration of pollutants did not promote failure to carry out of the nature protection tasks provided by management plans basin districts for the related surface water or to considerable reduction of ecological or chemical quality of the corresponding objects and considerable deterioration in land ecosystems which directly depend on underground water object;
