About approval of the Regulations on monitoring and systematic accounting of condition of surface and underground water

(as amended of the Order of the Government of the Republic of Moldova of 21.11.2018 No. 1143)

Based on article 13 of the Law on water No. 272 of December 23, 2011. (The official monitor of the Republic of Moldova, 2012, No. 81, the Art. 264) DECIDES: the Government

1. Approve Regulations on monitoring and systematic accounting of condition of surface and underground water it (is applied);

2. Control of execution of this resolution is imposed on the Ministry of Agriculture, regional development and the environment.

Regulations on monitoring and systematic accounting of condition of surface and underground water

Chapter I General provisions

1. The regulations on monitoring and systematic accounting of condition of surface and underground water (further - the Provision) partially shift Article 8 and appendix V to the Directive 2000/60/EU of the European Parliament and Council of October 23, 2000, the establishing frame of actions of Community of rather water economy published in the Official magazine of the European community (JOCE, No. L327 of December 22, 2000) and determine:

1) complex long-term system of quantitative and quality standard of surface and underground water with use of procedures and technical measures of sampling, the analysis and synthesis for the purpose of management and long-term use of water resources;

2) procedures, obligations and tasks for development, updating and implementation of programs of monitoring of condition of surface and underground water (further - programs of monitoring);

3) the main requirements to contents of programs of monitoring, parameters which shall be traced, the technical procedures and measures necessary for sampling and compliance to requirements of analyses for each parameter, quality control, laboratory practice and data management, and also other procedures and measures, as required, for satisfaction of other requirements concerning data.

2. For this provision the used concepts have the following values:

monitoring of condition of waters is system of assessment of physical, chemical, biological and microbiological parameters of water depending on natural and anthropogenous conditions;

programs of monitoring - the tool of consecutive and comprehensive assessment of condition of water resources for simplification of the forecast, development and approval of plans for management of water objects, and also the analysis of progress of their implementation;

indicators of quality of waters - the quality requirement of waters which is expressed by the size of concentration of certain physical and chemical parameter, group of physical and chemical parameters and biological parameter which do not exceed standard rates of quality for the purpose of health protection of the person and the environment;

national monitoring system - system by means of which the state constantly traces condition of water resources and anthropogenous impact which is based on spatio-temporal parameters and indicators which provides information necessary for development of strategy, measures for the prevention of effects of human activities, natural disasters and on recovery of ecological situation;

the considerable increasing tendency - any considerable, from the statistical and ecological point of view, increase in pollutant, group of pollutants or indicator of pollution in water which is considered obligatory for reversal of tendency.

3. Monitoring types:

1) supervising monitoring (N) - estimates condition of all waters within each hydrographic pool or under - the pool, providing information for: approvals of assessment procedure of impact, effective development of the subsequent programs of monitoring, assessment of long-term trends of change of quality and quantity of water resources, developments of administrative-territorial criteria of condition of water objects, and also reasons for optimization and improvement of national monitoring system;

2) operational monitoring (o) - aims at determination of those water objects revealed as a result of supervising monitoring as nature protection tasks subject to risk of failure to carry out concerning water resources, and also estimation of the changes which resulted from application of the program of the measures included in the management plan by the basin district;

3) research monitoring(s) - determines the reasons of excesses of limits of quality requirements of waters, for determination of the reasons for which water object is not able to realize nature protection tasks concerning water resources where supervising monitoring shows that the tasks established for water object cannot be reached, and operational monitoring is not established yet, and also for determination of scale and impact of emergency pollution. This type of monitoring provides necessary information for development of the program of measures for the purpose of achievement of nature protection tasks concerning water resources and special measures on elimination of effects of emergency pollution.

4. The national monitoring system of waters includes two types of monitoring, according to requirements of the current legislation: supervising monitoring which is intended for assessment of condition of all water objects in hydrographic pools, and the operational monitoring (integrated into supervising monitoring) for water objects which risk not to correspond to the nature protection tasks concerning water resources established in management plans by basin districts.

5. In cases of emergency pollution, for adoption of urgent decisions, for the purpose of protection of quality of water resources and prevention of emergency situations, research monitoring which provides the additional information about condition of water objects which cannot be received by means of carrying out operational monitoring is performed. On the basis of this information special measures on elimination of effects of emergency pollution, and also specific measures are developed for achievement of nature protection tasks concerning the water resources established in the management plan by hydrographic basin districts.

6. Functions of monitoring of quality of waters, generally determinations of extent of pollution, are assigned to the central body of public protection department of the environment, through the subordinated organizations equipped with functions in the field (The public hydrometeorological service and the Agency on geology and mineral resources) whereas monitoring of quality of drinking water from superficial and underground sources belongs to tasks of the central body of public management for health care with its territorial structures.

7. Organa responsible for monitoring of condition of waters, submitting to the central body of public protection department of the environment, bear responsibility for quantitative monitoring (hydrological and hydrogeological parameters), high-quality monitoring (physical and chemical, biological parameters), and also for monitoring of the accruing essential tendencies and changes caused by human activities.

8. Organa responsible for monitoring of condition of waters, submitting to the central body of public management for health care, bear responsibility for monitoring of sanitarno-chemical, toxicological, microbiological, virologic and parasitological parameters of the waters used for drinking appointment according to provisions of the Law No. 272-XIV of February 10, 1999 on drinking water, and also the waters used for bathing and recreation.

9. Complex scientific research about condition of water resources is systematically conducted by Academy of Sciences of Moldova, through organizations subordinated to it including based on results and primary data obtained from the Public hydrometeorological service and the Agency on geology and mineral resources.

10. Monitoring of condition of surface and underground water in cross-border context is performed taking into account provisions of bilateral agreements with neighboring countries and international treaties which participant the Republic of Moldova is.

Chapter II Monitoring and systematic accounting of condition of surface water

Section 1 High-quality and quantitative monitoring of surface water

11. Systematic supervision of quantity, quality and ecological condition of surface water, including the cross-border rivers, is performed by the Public hydrometeorological service and the central body of public management for health care based on national network of monitoring.

12. Quantitative monitoring of the hydrological mode of the rivers of the Republic of Moldova is performed via the fixed network of hydrological stations according to the procedures stated in regulations of the Public hydrometeorological service.
