1. Approve the Instruction about order of registration of notary offices and notarial bureaus and maintaining the register of notary offices and notarial bureaus it (is applied).

2. No. 178 is excluded according to the Resolution of the Ministry of Justice of the Republic of Belarus of 08.12.2020

3. To head departments of justice regional, Minsk city executive committees to provide till July 1, 2014 replacement of the registration certificates of the private notary granted before entry into force of the Presidential decree of the Republic of Belarus of November 27, 2013 No. 523, on registration certificates of notarial bureau.

4. Declare invalid the resolution of the Ministry of Justice of the Republic of Belarus of June 7, 2006 No. 28 "About approval of the Regulations on notarial bureau" (The national register of legal acts of the Republic of Belarus, 2006, No. 94, 8/14545).

5. This resolution becomes effective after its official publication.

The instruction about order of registration of notary offices and notarial bureaus and maintaining the register of notary offices and notarial bureaus

1. This Instruction determines order of registration head departments of justice regional (The Minsk city) executive committees (further – head departments of justice) notary offices and notarial bureaus, and also procedure for maintaining by the Ministry of Justice of the register of notary offices and notarial bureaus.

2. For registration of notary office the regional, Minsk city notarial chamber (further – territorial notarial chamber) directs to the relevant head department of justice the application for registration of notary office with application of a copy of the decision of territorial notarial chamber on formation of notary office accepted according to part one of Item 1 of article 14 of the Law of the Republic of Belarus "About notariate and notarial activities".

For registration of notarial bureau the notary performing notarial activities in notary office directs to the relevant head department of justice the application for registration of notarial bureau with application of a copy of the decision (the statement from the decision) boards of the Belarusian notarial chamber about approval of formation of the notarial bureau accepted according to Item 1 of article 15 of the Law of the Republic of Belarus "About notariate and notarial activities", except for requests for registration of notarial bureau in the case established by part one of Item 2-1 of this Instruction.

The statement for registration of notary office, notarial bureau (further, unless otherwise specified, – the statement for registration) shall contain the data specified in paragraphs the fourth or seventh Item 8 of this Instruction.

The documents specified in parts one and the second this Item go to head department of justice no later than fifteen calendar days from the date of decision making of territorial notarial chamber about formation of notary office or receipt of the decision by the notary of the copy (the statement from the decision) boards of the Belarusian notarial chamber about approval of formation of notarial bureau.

2-1. In case of investment of the notary performing notarial activities in notarial bureau with powers on implementation of notarial activities in other notarial district the notary addresses to head department of justice in the new place of implementation of notarial activities with the statement for registration of notarial bureau. Documents (their copy) confirming investment of the notary with powers on implementation of notarial activities in other notarial district and also earlier granted registration certificate of notarial bureau are enclosed to such application.

The head department of justice in case of registration of notarial bureau according to part one of this Item sends the notice of registration and the original of earlier granted registration certificate of notarial bureau to the head department of justice which granted it the certificate.

3. The decision on registration of notary office, notarial bureau is drawn up by the order of the chief of head department of justice.
