About approval of the Instruction about procedure for certification of the notary

Based on Item 2 of article 27 of the Law of the Republic of Belarus of July 18, 2004 "About notariate and notarial activities" the Ministry of Justice of the Republic of Belarus DECIDES: No. 305-Z

1. Approve the Instruction about procedure for certification of the notary it (is applied).

2. To the Belarusian notarial chamber to take measures for implementation of this resolution.

3. This resolution becomes effective since January 1, 2014, except for Item 2, of the official publication of this resolution which is becoming effective later.

The instruction about procedure for certification of the notary

1. This Instruction establishes procedure for certification of the notary (further, unless otherwise specified, – the certificate).

2. The certificate is the document confirming the status of the notary and his membership in the Belarusian notarial chamber.

3. The form of the certificate belongs to forms of documents with certain degree of protection and is made according to the legislation based on orders of the Belarusian notarial chamber in form according to appendix 1 and according to the description according to appendix 2.

Orders for production of forms of certificates are created according to offers (requests) regional (Minsk city) notarial chambers (further – territorial notarial chambers).

4. The application for certification is submitted by the notary to the relevant territorial notarial chamber.

Two photos of the notary of 3 x 4 cm in size are enclosed to the application for certification the questionnaire on receipt of the certificate of the notary in form according to appendix 3,.

5. The notary addresses for issue of the new certificate in cases:

changes of surname, own name, middle name (if that is available), the notarial district – no later than five working days from the date of receipt of the certificate on implementation of notarial activities according to Item 8 of the Instruction on procedure for issue of the certificate on implementation of notarial activities, introduction in it of changes and (or) amendments, the issue of its duplicate and cancellation approved by the resolution of the Ministry of Justice of the Republic of Belarus of December 31, 2013 No. 214;

elections as the chairman, vice-chairman (the termination of powers of the chairman, the vice-chairman) of the Belarusian notarial chamber, territorial notarial chamber, and also loss (plunder), unfitness of the certificate for its further use (damage) – no later than five working days from the date of approach of the specified events.

For receipt of the new certificate the notary submits to the relevant territorial notarial chamber the application for certification with indication of the reasons of need of issue of the new certificate and appendix to it:

two photos of the notary of 3 x 4 cm in size;

questionnaires on receipt of the certificate of the notary in form according to appendix 3, except for case of loss (plunder), unfitness of the certificate for its further use (damage).

6. The territorial notarial chamber no later than the working day following behind day of receipt of the statement for certification with appendix of necessary documents sends the offer (request) provided by part two of Item 3 of this Instruction and the arrived documents to the Belarusian notarial chamber.

7. Certification is performed by the Belarusian notarial chamber in a month from the date of receipt of the documents specified in Item 6 of this Instruction.

Earlier issued certificate is subject to delivery in the Belarusian notarial chamber in case of receipt of the new certificate by the notary. The former sequence number is assigned to the new certificate.

8. Certification is considered in register of issue and delivery of certificates in form according to appendix 4, which is conducted by the Belarusian notarial chamber.

9. The Item is excluded according to the Resolution of the Ministry of Justice of the Republic of Belarus of 18.03.2022 No. 44
