1. Approve the enclosed Rules of use of transport (except representations of the foreign states and the international organizations having diplomatic immunity) for arrival in zone of emergency situation of social nature, and also delivery of persons needing the emergency medical care in the medical organization if the delay can create real threat of life or to human health, with compensation of material damage to owners in case of its causing.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

The decision on use of transport (except representations of the foreign states and the international organizations having diplomatic immunity) for arrival in zone of emergency situation of social nature is accepted by the first head of state body according to the prevention and liquidation of emergency situation of social nature or replacement his face.

3. The state body according to the prevention and liquidation of emergency situation of social nature creates the request for use of transport, fixes date and time of the beginning of transportation and sends it to the owner of transport with the simultaneous notification of authorized body in the field of transport.

The owner of transport makes the decision on terms of provision and departure of transport for accomplishment of transportations according to appendix 1 to these rules.

4. The request for provision of transport goes in writing or in electronic form, the first head of state body assured by the digital signature according to the prevention and liquidation of emergency situation of social nature.

5. In case of use of transport for delivery of persons needing the emergency medical care in the medical organization if the delay can create real threat of life or to human health, and also in case of its return to the owner of transport or to person representing it by the commandant's office of the area issues the technical inspection report of the vehicle certifying technical condition of transport, and also its picking and condition in form according to appendix 2 to these rules.

6. The used transport is provided with the owner of transport the fuel and lubricants and other materials sufficient for implementation of transportation in destination and back to the permanent base, and shall conform to safety requirements of transportations according to the laws of the Republic of Kazakhstan.

The authorized body in the field of civil aviation in case of receipt of the notification on the planned flight provides aeronautical servicing of aircrafts from airports of departure and arrival.

3. Procedure for compensation of material damage to owners in case of its causing

For compensation of damage caused under the circumstances specified in Item 1 of these rules, the owner of the vehicle within seven working days from the date of causing material damage represents to state body according to the prevention and liquidation of emergency situation of social nature, the commandant of the area (during action of emergency rule) in the place of use of the vehicle the application form for compensation of damage which is filled in in form according to appendix 3 to these rules.

9. Are enclosed to the application for compensation of damage:

1) for physical persons - the copy of the identity document of the owner of the vehicle, and for legal entities - the copy of the certificate or the certificate of the state (accounting) registration (re-registration) of the legal entity (branch and representation);

2) the copy of the registration certificate of the vehicle used in case of liquidation of emergency situation of social nature;
