About protection of public health from impact of tobacco smoke and consequences of consumption of tobacco products

This Law determines the principles of state policy in the field of protection of public health from impact of tobacco smoke and consequences of consumption of tobacco products, governs the relations arising during the importing, realization and consumption of tobacco products in Turkmenistan.

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) tobacco - sort one - and the long-term herbs and bushes containing nicotine and others the unhealthy substances of the person cultivated for the purpose of receipt of raw materials (tobacco raw materials) for tobacco products manufacture;

2) tobacco products are the products fully or partially made of enzymatic tobacco (sheet) and (or) rustic tobacco, with addition or without addition of sauces and (or) fragrances, intended for smoking (smoking tobacco products), sucking, chewing, shuffing (not smoking tobacco products) and (or) different ways of consumption of tobacco products;

3) tobacco smoke - the smoke containing in atmospheric air in the place where smoking of tobacco products is performed or performed;

4) consequences of consumption of tobacco products - damnification (harm) of life or to health of the person, the circle of its dwelling owing to consumption of tobacco products and impact of tobacco smoke, and also the medical, demographic, social and economic consequences connected with it;

5) the tobacco organizations (industry) - the legal entities and individual entrepreneurs who are engaged in production, wholesale distribution and import of tobacco products;

6) turnover - wholesale and retail trade by tobacco raw materials and (or) tobacco products, and also their storage, import and export;

7) excise stamp - the brand having protection elements, applied on each unit of tobacco product according to the legislation of Turkmenistan confirmatory that the marked tobacco products have legal origin;

8) fight against tobacco - the measures taken for the purpose of reducing turnover of tobacco products, their advertizing and promotion, liquidation or reduction of their consumption, counteraction to illegal trade in tobacco products and also other measures directed to protection of public health;

9) advertizing of tobacco products - the information distributed in any forms and by means of any means intended for the uncertain group of people for the purpose of forming and maintenance of interest in tobacco product, including information in which without mentioning of specific tobacco products their trademarks and their elements are used;

10) promotion of tobacco and tobacco products - set of measures, actions taken by producers and (or) sellers, intermediaries for the purpose of increase in demand, sale, expansion of the market of tobacco and tobacco products;

11) sponsorship of tobacco products - the type of contribution to event, action or the individual, the purpose, result or probable result of which is sales promotion of tobacco product or the use of tobacco directly or indirectly;

12) illegal tobacco product trade - the type of activity forbidden by the law, concerning production, sending, obtaining, distribution, sale or acquisition of tobacco products, including aiming to promote such activities;

13) ingredient - the substance (except for tobacco leaf and other parts of tobacco) used in case of production of tobacco product, and which is present at finished tobacco product including in the changed form;

14) consumer pack - the minimum packing unit of tobacco products in which they are acquired by the consumer:

a) pack - the unit of consumer pack made of cardboard, paper or other material, containing certain quantity of tobacco product;

b) the block - group consumer pack with certain quantity of packs of the cigarettes which are wrapped up by polymeric film, paper or paper tape;

c) boxing - group consumer pack with certain quantity of packs of the cigarettes laid in box from cardboard which can be wrapped up by polymeric film.
