About approval of the Regulations on functioning of system of anti-corruption telephone lines

The parliament adopts this ordinary law.

Art. 1. - Approve Regulations on functioning of system of anti-corruption telephone lines it (is applied).

Art. 2. - To the central industry bodies of public management, autonomous administrative authorities and bodies of local public authority to take necessary measures for ensuring system operation of anti-corruption telephone lines.

Art. 3. - Determine that functioning and content of system of anti-corruption telephone lines are performed for the account and within the financial resources provided and which are available in budgets of the bodies specified in Article 2.

Art. 4. - That to assign monitoring of execution of the Regulations on functioning of system of anti-corruption telephone lines and effective functioning to the National center for fight against corruption which within the competence can initiate necessary checks.

Regulations on functioning of system of anti-corruption telephone lines

I. General provisions

1. The regulations on functioning of system of anti-corruption telephone lines (further - the Provision) aim at warning of corruption and fight against it in the central industry bodies of public management, autonomous administrative authorities and bodies of local public authority.

2. System of anti-corruption telephone lines

The system of anti-corruption telephone lines consists of three levels:

a) national anti-corruption line;

b) specialized anti-corruption lines;

c) institutional lines for informing.

3. Purpose of anti-corruption telephone lines Anti-corruption telephone lines of all three levels are effective at the same time and information on making of acts of corruption, the acts adjacent to corruption, or the facts of corruption behavior, consideration of the acquired information and acceptance of proper measures, including representation of the corresponding materials to competent authorities are supplemented mutually in the central industry bodies of public management, autonomous administrative authorities and bodies of local public authority for the purpose of acceptance by phone.

4. The principles of functioning the System of anti-corruption telephone lines functions on the basis of the following principles:

confidentiality - use of the acquired information only for execution of job responsibilities, implementation of registration, storage and use of personal data in strict accordance with provisions of the Marine life protection act of personal data No. 133 of July 8, 2011;

cooperation - cooperation between all central industry bodies of public management, autonomous administrative authorities and bodies of local public authority in promotion of system of anti-corruption telephone lines and increase in its efficiency, and also in receipt of information by means of system;

openness of bodies before society - public body cooperates with the called person, responsibly manages telephone line within system of anti-corruption telephone lines and provides to the public the complete information about working processes; availability - open and easy access to anti-corruption telephone lines.

5. Confidentiality of information obtained through system of anti-corruption telephone lines

1) the Public bodies responsible for management of system of anti-corruption telephone lines take necessary measures for ensuring nondisclosure of information obtained by means of system of anti-corruption telephone lines the, and personal data calling. In cases when calling refuses to be provided, the call is considered anonymous and the provided information is not processed.

2) the Operator of anti-corruption telephone line, and also other persons owing to job responsibilities examining with given calling information, shall use it only in the office purposes, not disclose it and not transfer to the third parties, except as specified, when the legislation provides other.

6. Promotion of system of anti-corruption telephone lines

Public bodies advance anti-corruption telephone lines by means of social information campaigns with use of different means: printed materials (posters, brochures, leaflets, etc.), banners, audio-and video clips, web pages of public bodies.

II. National anti-corruption line

7. Purpose of the national anti-corruption line

The national anti-corruption line is telephone line on which information on making of acts of corruption, the acts adjacent to corruption, on any other facts of corruption behavior is accepted. The national anti-corruption line is intended for collection of the specified information both for the purpose of consideration of possible illegal acts, and for the purpose of establishment of the industries subject to corruption, by the complex analysis of the acquired information.

8. General rules of functioning of the national anti-corruption line

1) Management of the national anti-corruption line is assigned to the National center for fight against corruption (further - the Center) which regulations regulate functioning of this line.

2) Calls to the national anti-corruption line are free and can be performed round the clock.

3) information Obtained on the national anti-corruption line is registered in the Register on calls accounting to the national anti-corruption line provided in appendix to this Provision.

4) the Center determines the necessary number of operators for normal functioning of the national anti-corruption line.

9. Calls to the national anti-corruption line

1) the Call to the national anti-corruption line can be received by the robot answering machine or the operator. This alternative is provided calling in interval between 06:00 and 22.00 hours. In the rest of the time of days the call is received by the robot answering machine. In case the operator is busy with acceptance of the previous call, defiant can either wait for the operator, or use services of the robot answering machine.

2) the Calls received directly by the operator are registered without delay in the Register on calls accounting to the national anti-corruption line. The calls received by means of the robot answering machine in interval between 06:00 and 22.00 hours, are listened by the operator and are registered in the specified Register right after the termination of the previous call. If calling asks to tell him number of registration of its call, the operator during the specified period of time takes necessary measures for provision of such information.
