About procedure for consideration of materials and decision makings about assignment (appointment) of radio frequency or the radio-frequency channel

Based on part eleven of article 30 of the Law of the Republic of Belarus of July 19, 2005 "About telecommunication" and for the purpose of enhancement of state regulation in the field of use of radio-frequency range the Council of Ministers of the Republic of Belarus DECIDES: No. 45-Z

1. Approve Regulations on procedure for consideration of materials and decision making on assignment (appointment) of radio frequency or the radio-frequency channel it (is applied).

2. Bring in the Regulations on procedure for issue to legal entities and individual entrepreneurs of permissions of the State inspectorate of the Republic of Belarus for telecommunication of the Ministry of Communications and Informatization of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of September 24, 2008 No. 1401 "About approval of the Regulations on procedure for issue to legal entities and individual entrepreneurs of permissions of the State inspectorate of the Republic of Belarus for telecommunication of the Ministry of Communications and Informatization of the Republic of Belarus, modification and amendments in resolutions of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1054 and of November 21, 2007 No. 1560 and recognition voided some resolutions and separate provisions of the orders of the Government of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2008, No. 236, 5/28423), the following changes and amendments:

2.1. state Item 1 in the following edition:

"1. This Provision establishes procedure for issue to legal entities and individual entrepreneurs of permissions to operate of the head station of system of cable television, on right to use of radio-frequency range during the designing, construction (installation) and operation of radio-electronic means (further - RES) civil appointment, on accession of network of telecommunication to network of telecommunication public, single republican data transmission network (further - ERSPD) and inclusion in ERSPD.";

2.2. in Item 2:

from part one of the word "acquisition of RES and (or) VCh of devices" to exclude;

in part two of the word "VCh of Devices" shall be replaced with words "high-frequency devices (further - VCh of the device)";

2.3. in item 4:

in part one of the word "Acquisition of RES and (or) VCh of Devices, Operation" to replace with the word "Operation";

third to add part with the paragraph the fourth the following content:

"right to use of radio-frequency range during the designing, construction (installation) of RES of civil appointment for wearable (portable) radio stations.";

2.4. state Item 5 in the following edition:

"5. The Ministry of Communications and Informatization establishes forms of the applications submitted by legal entities and individual entrepreneurs for issue of the permissions provided by this Provision and the list of RES and (or) VCh of devices which are operated without permissions of BELGIE affirms.";

2.5. state Item 7-1 in the following edition:

"7-1. In case of change of the data specified in the permission provided by this Provision, the legal entity or the individual entrepreneur shall file in BELGIE petition for receipt of new permission in a month.

In case of not giving by the legal entity or individual entrepreneur of the statement for receipt of new permission in time, established by part one of this Item, permission is terminated.";

2.6. 11, 18 and 21 to add part one of Items with the words "and the document confirming introduction of payment for issue of this permission, except as specified when such payment is brought by means of use of the automated information system of single settlement and information space";

2.7. in part one of Item 14 of the word "the beginnings of production of the project documentation submits in BELGIE the application of the established form" shall be replaced with words "approvals of design assignment submits in BELGIE the application of the established form and the document confirming introduction of payment for issue of this permission, except as specified when such payment is brought by means of use of the automated information system of single settlement and information space";

2.8. state Item 16 in the following edition:

"16. BELGIE in time no more than one month or within five months if BELGIE is determined need of carrying out the international coordination of radio frequency or the radio-frequency channel, from the date of registration of a statement:

16.1. renders the services (performs works) connected with assignment (appointment) of radio frequency or the radio-frequency channel, according to the procedure, established by the legislation, and the document for payment of these services (works) sends to the legal entity or the individual entrepreneur;

16.2. in case of decision making about assignment (appointment) of radio frequency or the radio-frequency channel for the declared RES of civil appointment:

sends to the legal entity or the individual entrepreneur basic data for calculation of the amount of payment for use of radio-frequency range;

issues to the legal entity or the individual entrepreneur permission to right to use of radio-frequency range during the designing, construction (installation) of RES of civil appointment if there is copy of the document confirming introduction of payment for use of radio-frequency range;

16.3. in case of decision making about refusal in assignment (appointment) of radio frequency or the radio-frequency channel the motivated notification on refusal in issue of permission to right to use of radio-frequency range during the designing, construction (installation) of RES of civil appointment sends to the legal entity or the individual entrepreneur.";

2.9. in Item 17:

third to state the paragraph in the following edition:

"availability of the decision on refusal in assignment (appointment) of radio frequency or the radio-frequency channel for the declared RES of civil appointment;";

word in paragraph four", provided by subitem 16.1.4 of Item 16" shall be replaced with words "for the services of BELGIE connected with assignment (appointment) of radio frequency or the radio-frequency channel";

2.10. in Item 19:

the second subitem 19.1 to state part in the following edition:

"For the declared wearable (portable) radio stations performs the works connected with assignment (appointment) of radio frequency or the radio-frequency channel, according to the procedure, established by the legislation;";
