1. Approve the enclosed Rules of issue and prolongation of effective period of certificates of aeronautical personnel.

2. Declare invalid:

1) the order of the Minister of Transport and Communications of the Republic of Kazakhstan of March 14, 2011 No. 138 "About approval of Rules of issue of certificates of aeronautical personnel" (registered in the Register of state registration of regulatory legal acts at No. 6860, published in the Kazakhstanskaya Pravda newspaper of August 20, 2011, No. 265-266 (26686-26687));

2) the subitem 1) the List of regulatory legal acts of the Republic of Kazakhstan to which changes and additions are made, the acting minister of transport and communications of the Republic of Kazakhstan approved by the order of December 2, 2011 No. 711 "About modification and amendments in some orders of the Minister of Transport and Communications of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts at No. 7366, published in the Kazakhstanskaya Pravda newspaper of April 19, 2012, No. 108-109 (26927-26928)).

3. To committee of civil aviation of the Ministry of Transport and Communications of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

Rules of issue and prolongation of effective period of certificates of aeronautical personnel

Chapter 1. General provisions

1. These rules of issue and prolongation of effective period of certificates of aeronautical personnel (further – Rules) are developed according to Item 3 of article 54 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for issue and prolongation of effective period of certificates of aeronautical personnel and rendering the state service "Issue of Certificates to Aeronautical Personnel" (further – the state service).

2. In these rules the following terms and determinations are used:

1) aeronautical personnel – the physical persons having special and (or) professional training, performing activities for accomplishment and flight servicing of air vehicles, airborne transportations and aerial works, maintenance of air vehicles, the organization and air traffic maintenance, air traffic control;

2) the certificate of aeronautical personnel – the document confirming qualification and powers of aeronautical personnel;

3) the register of the granted certificates of aeronautical personnel (further – the Register) – the document in which record about issue of certificates of aeronautical personnel is kept;

3-1) payments in the field of civil aviation – payment of physical persons and legal entities for the services rendered by authorized organization in the field of civil aviation and also obligatory expels of legal entities for implementation by it of constant surveillance over safety-of-life function and aviation safety in the budget of authorized organization in the field of civil aviation;

4) authorized body in the field of civil aviation - the central actuator performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

5) authorized organization in the field of civil aviation – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, aviation safety and aviation safety;

6) civil aviation organization – the legal entity performing activities in the field of civil aviation;

12) the external pilot – physical person which performs necessary actions on flight execution of the unmanned aerial vehicle and which manages relevant organs of flight control during flight time;

13) the member of flight crew – the person belonging to aeronautical personnel, having the existing certificate of aeronautical personnel to whom the obligations connected with management of the air vehicle during airborne time are assigned.

3. The authorized organization issues the following types of certificates of aeronautical personnel:

1) for members of flight crew:

the certificate of the private pilot of PPL (the airplane, the helicopter, the airship, the air vehicle with system of increase in lifting force);

the certificate of the pilot of commercial aviation of CPL (the airplane, the helicopter, the airship, the air vehicle with system of increase in lifting force);

certificate of the pilot of polynomial crew (airplane) of MPL;

the certificate of the linear pilot of ATPL (the airplane, the helicopter, the air vehicle with system of increase in lifting force);

certificate of the pilot of free aerostat of FBPL;

certificate of the pilot of glider of GPL;

2) for the members of flight crew other than pilots:

certificate of the navigator of FNL;

certificate of the flight engineer (aircraft mechanic) of FEL;

certificate of the flight radio operator of FROL;

3) other aeronautical personnel:

the certificate of the external pilot of RPL (the airplane, the airship, glider, the rotary wing aircraft, the air vehicle with system of increase in lifting force or free aerostat);

certificate of the dispatcher of air traffic maintenance of ATCL;

the certificate of personnel on maintenance of AML air vehicles;

the certificate of the employee on flight servicing or the flight dispatcher of FDL;
