About electronic procedures of customs clearance of goods

(as amended on 15-01-2020)

For the purpose of realization of part (3) Article 9 of the Customs code No. 1149-XIV of July 20, 2000 (repeated publication: The official monitor of the Republic of Moldova, 2007, special release) and for simplification of the customs procedures connected with export and commodity import, reducings time of customs clearance and the number of the documents necessary for export and import, DECIDES: the Government

1. Approve:

Regulations on the electronic procedure of customs clearance of commodity export, according to appendix No. 1;

Regulations on the electronic procedure of customs clearance of commodity import, according to appendix No. 2.

2. From the moment of the publication of this Resolution in the Official monitor of the Republic of Moldova economic agents are allowed to perform export transactions with use of electronic procedures at Chisinau customs, customs of Ungen - customs post of Skulen-Skulen, Bender's customs - customs post of Tudor-old Cossack, and since March 1, 2014 - on all customs posts.

It is allowed to perform import transactions with use of electronic procedures since September 1, 2014 at Chisinau customs, customs of Ungen – customs post of Skulen-Skulen, Bender's customs – customs post of Tudor-old Cossack, and since March 1, 2015 – on all customs posts.

3. To Customs Service to take the measures necessary for implementation of the electronic procedure of customs clearance of export and commodity import.

4. To the ministries and other public authorities responsible for regulation of export and import to provide development and deployment of the information systems necessary for data exchange online for electronic customs clearance of export and commodity import.

5. Grant the right to Customs Service to perform the procedure and use of certificates of open key in customs information systems.

Appendix №1

Regulations on the electronic procedure of customs clearance of commodity export

I. General provisions

1. The regulations on the electronic procedure of customs clearance of commodity export (further - the Provision) establish procedure for customs clearance of commodity export with use of electronic (information) procedures, without paper basis.

2. For the purposes of this provision the following concepts are used:

1) ceased to be valid;

2) the electronic customs declaration - the complete customs declaration in the electronic form of format and structure established by Technical regulations of seal, use and creation of the complete customs declaration approved by the Order of the director of Customs Service No. 346/2009, created, structured, processed, kept and transferred by the user of information customs system to customs authority by means of information processes (without paper basis) to which the digital signature issued according to the current legislation is applied;

3) ceased to be valid.

3. Economic agents who declare the goods independently or through the customs broker can use the electronic procedure of customs clearance of commodity export.

II. Features of filling and storage of the electronic customs declaration

4. The electronic customs declaration is filled in according to Technical regulations of seal, use and creation of the complete customs declaration, taking into account specifics of the procedure of electronic declaring.

5. The digital signature issued according to the current legislation as follows is applied to the electronic customs declaration:

1) the economic agent who is the exporter signs the customs declaration completed and submitted on its own behalf;

2) the customs broker signs the customs declaration completed and submitted on its own behalf for the economic agent irrespective of representation type (direct or indirect).
