ORDER OF THE MINISTRY OF INTERNAL AFFAIRS OF UKRAINE

of October 4, 2013 No. 950

About questions of application of the administrative legislation of Ukraine by law-enforcement bodies of Ukraine

(as amended of the Order of the Ministry of Internal Affairs of Ukraine of 11.08.2014 No. 808)

According to the Code of Ukraine about administrative offensesto the Law of Ukraine "About free legal assistance", to subitems 25, of the 26th Item 4, to Item 11 of the Regulations on the Ministry of Internal Affairs of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 383, to the Items 2, 10 Procedures for informing the centers for provision of free secondary legal assistance on cases of detention of persons approved by the resolution of the Cabinet of Ministers of Ukraine of December 28, 2011 No. 1363, for the purpose of respecting the rule of law when implementing production on cases on administrative offenses, and also reduction of regulatory legal acts of the Ministry of Internal Affairs of Ukraine in compliance with requirements of the Code of Ukraine about administrative offenses I ORDER:

1. Approve:

1.1. The instruction for registration of materials about administrative offenses in law-enforcement bodies of Ukraine which is applied.

1.2. Regulations on the commission of head departments, Departments of MIA of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, on transport on control of condition of respecting the rule of law when implementing administrative production by law-enforcement bodies which is applied.

1.3. Regulations on the commission on reconciliation of accounting treatment for administrative offenses district, district in the cities, city managements (departments), linear managements (departments) of internal affairs, head departments, the Departments of MIA of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, on transport which is applied.

2. To heads of structural divisions of the office of the Ministry of Internal Affairs of Ukraine, chiefs of head departments, Departments of MIA of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, on transport to organize studying with staff of this order, by results in a month to accept offsettings and to provide accomplishment of this order.

3. To department of material security of the Ministry of Internal Affairs of Ukraine (Bakumov of Page F.) provide production of necessary number of forms of protocols on administrative offenses, forms of resolutions on cases on administrative offenses and forms of protocols on administrative detention.

4. (Verbensky M. G.) annually when forming budget request of the Ministry of Internal Affairs of Ukraine the next fiscal year to provide to general staff of the Ministry of Internal Affairs of Ukraine in Department of material security of the Ministry of Internal Affairs of Ukraine the generalized annual requirement of law-enforcement bodies by types, series and quantities of blank products.

5. Recognize invalid orders of the Ministry of Internal Affairs of Ukraine of February 22, 2001 as No. 185 "About approval of the Instruction for registration of materials about administrative offenses", No. 272/5463, registered in the Ministry of Justice of Ukraine on March 26, 2001 of March 11, 2002 No. 254 "About modification of the Instruction for registration of materials about administrative offenses, Ukraine approved by the order of the Ministry of Internal Affairs of 22.02.2001 No. 185",   No. 620 registered in the Ministry of Justice of Ukraine on March 20, 2002 for No. 274/6562, of June 5, 2004 "About introduction of amendments to the order of the Ministry of Internal Affairs of Ukraine of 22.02.2001 No. 185", registered in the Ministry of Justice of Ukraine on June 10, 2004 for No. 714/9313.

6. Repeal the order of the Ministry of Internal Affairs of Ukraine of October 18, 2002 No. 1038 "About approval of Standard regulations on the commission on control of condition of respecting the rule of law in administrative and law-enforcement activities in law-enforcement bodies and the commission on reconciliation of accounting treatment for administrative offenses in gorraylinorgana of internal affairs".

7. (Berezan V. M.) to provide to general staff of the Ministry of Internal Affairs of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

8. To impose control over the implementation of this order on the deputy minister militia lieutenant general Ratushnyak V. I.

9. This order becomes effective after its official publication.

The instruction for registration of materials about administrative offenses in law-enforcement bodies of Ukraine

I. General provisions

1.1. This Instruction establishes procedure for registration in law-enforcement bodies of Ukraine of materials about administrative offenses, procedure for hearing of cases about administrative offenses, and also determines procedure for control of compliance with law in case of registration of materials about administrative offenses.

1.2. This Instruction is developed according to the Code of Ukraine about administrative offenses (further - КУоАП), the Law of Ukraine "About free legal assistance", the Regulations on the Ministry of Internal Affairs of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 383, the Procedure for informing the centers for provision of free secondary legal assistance on cases of detention of persons approved by the resolution of the Cabinet of Ministers of Ukraine of December 28, 2011 No. 1363.

II. Officials of law-enforcement bodies of Ukraine, authorized to constitute protocols on administrative offenses

2.1. Constitute protocols on administrative offenses, protocols on administrative detentions, protocols of withdrawal of things and documents, protocols of survey of things and personal inspection, to receive explanations from persons who are brought to the administrative responsibility, the victims, witnesses employees of law-enforcement bodies which have special ranks have the right.

2.2. Protocols on administrative corruption offenses are constituted by employees of divisions on fight against organized crime of the Ministry of Internal Affairs of Ukraine.

2.3. On behalf of law-enforcement bodies (militia) to consider cases on administrative offenses and have the right to impose administrative punishments:

chiefs of law-enforcement bodies and their deputies, chiefs or deputy chiefs of district, city, district departments (managements) of internal affairs in the cities - for the administrative offenses provided by paragraph one of Item of 1 part two of Article 222 КУоАП;
