1. Approve the enclosed Instruction about procedure for storage, movement of alcoholic beverages with the damaged excise stamps of the Republic of Belarus and trade in them in the territory of the Republic of Belarus (except for being under customs control).

2. Recognize invalid:

the resolution of the Ministry of Trade of the Republic of Belarus of November 5, 2010 No. 32 "About modification of the resolution of the Ministry of Trade of the Republic of Belarus of January 15, 2007 No. 2" (The national register of legal acts of the Republic of Belarus, 2010, No. 287, 8/22983).

3. This resolution becomes effective since December 30, 2013.

1. This Instruction determines procedure for storage, movement of alcoholic beverages with the damaged excise stamps of the Republic of Belarus (further - excise stamp) and trade in them in the territory of the Republic of Belarus (except for being under customs control).

2. The legal entities performing in the procedure established by the legislation wholesale, retail trade by alcoholic beverages, storage (as type of business activity) the specified drinks, the individual entrepreneurs performing in the procedure established by the legislation retail trade by alcoholic beverages on objects of public catering in pouring and also the legal entities and individual entrepreneurs using alcoholic beverages in case of production of own food products (except for productions of other alcoholic beverages), in case of identification of alcoholic beverages with the damaged excise stamps draw up the statement of availability of alcoholic beverages with the damaged excise stamps (further - the act) in duplicate in form according to appendix to this Instruction.

The act does not join the alcoholic beverages with the opened consumer pack realized in the procedure established by the legislation by legal entities on shopping facilities and (or) objects of public catering in pouring, individual entrepreneurs on objects of public catering in pouring, and also used by legal entities and individual entrepreneurs in case of production of own food products (except for productions of other alcoholic beverages).

3. Alcoholic beverages with the damaged excise stamps from the moment of their inclusion in the act are subject to storage separately from other alcoholic beverages.

4. Storage of alcoholic beverages with the damaged excise stamps is allowed only in the presence of the act.

5. Movement of alcoholic beverages with the damaged excise stamps, and also trade in them according to the legislation is not allowed.

6. Alcoholic beverages with the damaged excise stamps are subject to remarking by the excise stamps intended for remarking of alcoholic beverages with the damaged excise stamps in form and according to the procedure, the established resolution of Council of Ministers of the Republic of Belarus of April 28, 2008 No. 618 "About some questions of turnover of alcoholic beverages" (The national register of legal acts of the Republic of Belarus, 2008, No. 110, 5/27587).
