About the higher and postgraduate professional education

Chapter 1. General provisions

This Law is the international legal act, the legal basis of coordination of policy of the states of the Commonwealth in the field of the higher and postgraduate professional education and is directed to support and development of integration processes in this area.

Article 1. The basic concepts used in this Law

Higher education - the education aiming at preparation and retraining of specialists of appropriate level, requirements satisfaction of the personality in deepening and expansion of education based on unfinished higher education, secondary general (complete) education, primary professional education, secondary professional education.

Postgraduate professional education - the education giving to citizens opportunity of increase in the education level, scientific, pedagogical qualification based on higher education.

Autonomy of educational institutions - independence in matching and placement of personnel, implementation of educational, scientific, financial and economic and other activities according to the legislation and the charter of educational institution.

The academic freedom - freedom to state subject at discretion, to choose subjects for scientific research and to make them by the methods, and also freedom of students to gain knowledge according to the bents.

The graduate student - person having the higher education studying in postgraduate study and preparing the thesis for degree of the candidate of science.

State policy in the field of education - the guide and the regulating activities of the state in the field of education performed by it for the purpose of effective use of opportunities of education for achievement of quite particular strategic objectives and permission of tasks of nation-wide or global value. It is implemented by means of the laws, nation-wide programs, governmental decrees, the international programs and agreements and other acts, and also by involvement of public organizations and movements, the general public for its support by the means (mass media, public academies, professional associations, etc.) which are available at their order.

Remote educational technologies (education at distance) - one of forms of education, purposeful and methodically organized management of educational cognitive activity and development of persons which are in distance from the organizations of education by means of electronic and telecommunication means.

Additional education - the process of education and training performed on the basis of additional educational programs of all levels for the purpose of comprehensive satisfaction of educational needs of citizens, society and the state.

The doctoral candidate - the person having academic degree of the candidate of science and enlisted in doctoral studies for preparation of the thesis for degree of the doctor of science.

Final state assessment of students - the procedure which is carried out for the purpose of determination of extent of assimilation of the state educational standard of appropriate level of education by them by results of which the education document is issued.

Qualification - the type and degree of professional readiness of the graduate reflected in the education document to accomplishment of professional activity or continuation of education.

Nostrification of education documents - the procedure which is carried out for the purpose of determination of equivalence of the documents issued to the citizens who got education in other states, in the international or foreign educational institutions (their branches).

Educational policy - set of intentions and actions of social movements and bodies of the central, regional and local government in relation to functioning and educational development in general or its separate subsystems. The educational policy consists of three basic elements:

- content of prevailing ideas (philosophy) of education;

- nature of the current legislation about education and the announced legislative initiatives;

- general orientation of daily organizing and management activity in the field of education.

The general educational space of the Commonwealth of Independent States is characterized by community of the principles of state policy in the field of education, coordination of the state educational standards, programs, lists of professions and specialties, the education levels, normative terms of training, standards and requirements for preparation and certification scientific and research and educational personnel and programs, equal opportunities and free realization of the rights of citizens to education in educational institutions in the territory of the CIS countries. Forming of general educational space is one of the priority directions of policy of the State Parties of the Commonwealth of Independent States.

Education - continuous process of education and training which purpose is achievement of high level of moral, intellectual, cultural and physical development and professional competence of members of society.

Retraining and increase in professional qualification - the education within appropriate levels of professional education performed for the purpose of enhancement of competence or increase in skill level by this or that profession.

Profession - the main occupation, labor activity of the person confirmed by the relevant documents on education.

Specialty - complex acquired by purposeful preparation and work experience of knowledge, skills necessary for certain type of activity, confirmed by the relevant documents on education.

The student of higher educational institution - person in accordance with the established procedure enlisted in higher educational institution for training.

Vocational education - training of children and adults with physical defects or having for one reason or another some difficulties with study which is performed in special or in regular educational institutions.

Branch of higher educational institution - the separate division of the legal entity located out of the place of its stay and performing all its functions or their part, including functions of representation.

The representation of higher educational institution - the separate division of the legal entity located out of the place of its stay which represents the interests of the legal entity and performs their protection.

The external studies - independent studying by students of disciplines according to the main educational program of higher education for the chosen direction of preparation with the subsequent certification in higher educational institution.

Article 2. State policy and the state guarantees of the rights of citizens in the field of the higher and postgraduate professional education

1. State policy in the field of the higher and postgraduate professional education is based on the following principles determined by the Model law "About Education" and the Concept of the Model educational code for the State Parties of the CIS:

1) equal availability of the higher education to all on the basis of capabilities of everyone;
