AGREEMENT OF COMMONWEALTH OF INDEPENDENT STATES

About cooperation in the field of environmental protection of the State Parties of the Commonwealth of Independent States

The governments of the State Parties of the Commonwealth of Independent States which further are referred to as with the Parties

understanding responsibility to the people and the people of other states, and also future generations for providing favorable conditions for accommodation,

based on the right of each state to establish procedure for use of the earth, its subsoil, the woods, water resources, plant and animal life and other natural resources,

proceeding from understanding of integrity and indivisibility of the environment, unity of interest of all states in its preserving and sustainable development,

noting that borders between the states can not match with natural and ecological and basin borders, and understanding that economic and other activity in the territory of one state shall not cause environmental damage, to quality of life of the population and economic activity of other states,

recognizing need of acceptance of coordinated actions and development of the interstate relations in the field of creation of the legal basis of environmental protection and environmental management,

understanding need of carrying out the coordinated basic and applied ecological researches,

being guided by the Concept of further development of the Commonwealth of Independent States of October 5, 2007 and the Strategy of economic development of the Commonwealth of Independent States for the period till 2020 of November 14, 2008,

agreed as follows:

Article 1

The parties cooperate in the field of environmental protection: protection and use of lands, soils, subsoil, woods, waters, atmospheric air, ozone layer and climate, plant and animal life.

Article 2

The cooperation of the Parties is performed in the following main directions:

development and acceptance of regulatory legal acts, environmental standards and standards in the field of environmental protection and environmental management;

maintaining inventory of natural resources and implementation of environmental monitoring;

enhancement of system of the state control (supervision) of state of environment;

taking measures for reproduction of live resources, preserving and recoveries of biological diversity;

development of network of reserves, wildlife areas, national parks and other especially protected natural territories and natural complexes, taking measures to minimization of economic and other activity in the zones adjoining to them;

comprehensive assessment of ecological effects of economic and other activity;

implementation of the actions aimed at the development and enhancement of environmental assessment, including plans and programs, and also evaluating impact on the environment of the planned activities in cross-border context;

taking measures for development of ecological education and education of the population, ensuring publicity in environmental issues;

development of general approaches and implementation of the approved actions for recovery of the rare and being under the threat of disappearance animal species and plants having general for the State Parties of this agreement areas;

implementation of innovative projects, energy efficient and resource-saving technologies, low-waste, wasteless and ecologically safe engineering procedures;

implementation of forming of system of economic mechanisms of environmental management and environmental protection, stimulation of market development of ecological services, products, technologies and equipment.

Article 3

For ensuring cooperation in the field of environmental protection of the Party recognized reasonable:

to jointly develop and perform interstate programs and projects in the field of environmental protection and ecological safety;

develop and apply the approved indicators of quality evaluation and control of state of environment and anthropogenous impacts on it, providing comparability of data on state of environment in cross-border context;

develop and use by agreement the approved techniques according to impact of economic and other activity on the environment;

develop and apply the approved control methods in the relation: protection of rare and endangered species of wild animals and wild-growing plants, and also places of their dwelling and growth; prevention and minimization of harm from invasion of aggressive alien types of wild animals and wild-growing plants; studying of influence of genetically changed organisms on components of biological diversity;

develop general approaches and perform the approved actions for recovery of the rare and being under the threat of disappearance animal species and plants having general for the State Parties of this agreement areas;

perform exchange of information about state of environment;

develop and perform the approved scientific and technical policy in the field of environmental protection, conduct the coordinated scientific research;

develop and apply the agreed principles of stimulation of nature protection activities;

interact in the field of nature protection technologies, development, production and mutual deliveries of the necessary new equipment and devices of nature protection appointment, special technical means and individual protection equipment for monitoring, the prevention and mitigation of consequences of natural and technogenic catastrophes;

combine and concentrate common efforts and resources for realization of the interstate priority directions of development of education, science and technology in the field of rational use of natural resources, prevention of emergency situations of natural and technogenic nature.

Article 4

For implementation of this agreement of the Party agreed to create Interstate ecological council of the State Parties of the Commonwealth of Independent States.

Activities of Interstate ecological council of the State Parties of the Commonwealth of Independent States are performed based on the Provision which is appendix to this agreement and its integral part.

The parties appoint members of Interstate ecological council of the State Parties of the Commonwealth of Independent States and inform on it Executive committee of the CIS.

Article 5

Financing of joint actions and programs in the field of environmental protection is performed within the means provided in national budgets to the relevant ministries and departments for accomplishment of the functions assigned to them and also due to attraction of non-budgetary sources on contractual basis.

Article 6

This agreement does not affect the rights and obligations of each of the Parties following from other international treaties which participant is its state.
