About application of the Agreement on the free trade area of October 18, 2011 between its Parties and the Republic of Uzbekistan

being guided by the purposes, the principles and terms of the Agreement on the free trade area of the October 18, 2011 which is hereinafter referred to as "Agreement"

agreed as follows:

Article 1

From the date of the introduction of the this Protocol in force according to the procedure, stipulated in Article the 7th this Protocol, all provisions of the Agreement are applied in the relations between Agreement parties and the Republic of Uzbekistan taking into account the conditions provided by the this Protocol.

Article 2

1. For the purposes of application of provisions of articles 2 and 3 of the Contract between Agreement parties and the Republic of Uzbekistan:

a) in cases when provisions of article 2 of the Agreement refer to appendix 1 to the Agreement, appendix 1 to the this Protocol is understood by the Parties of the this Protocol;

b) in cases when provisions of Item 2 of article 3 of the Agreement refer to appendix 2 to the Agreement, appendix 2 to the this Protocol is understood by the Parties of the this Protocol.

2. Before date of accession of the Republic of Uzbekistan to the WTO or till December 31, 2020, depending on what of these dates will come earlier:

a) The agreement party and the Republic of Uzbekistan will not use provision of article 19 of the Agreement for dispute settlement, arising between such Agreement party and the Republic of Uzbekistan concerning application of Item 8 of Article 2 and article 17 of the Agreement;

b) the reference to article III GATT 1994 in article 5 of the Agreement for the purposes of application of the Contract to trade between the Republic of Uzbekistan and Agreement parties is understood as the reference to similar provisions of bilateral international treaties of the Republic of Uzbekistan with Agreement parties, in case of availability of such agreements;

c) The Republic of Uzbekistan is not connected by provisions of article 10 of the Agreement, at the same time Agreement parties keep the right to apply measures, stipulated in Article 9 Agreements, to the goods coming from the Republic of Uzbekistan;

d) The Republic of Uzbekistan is not connected by provisions of paragraph one of Article 11 and article 12 of the Agreement. The Republic of Uzbekistan will apply technical, sanitary and phytosanitary measures to goods of Agreement parties and production processes of such goods on the basis of national treatment or most favored nation treatment depending on what of these modes is optimum for the producer and/or the exporter of goods of the concerned party of the Agreement;

e) The Republic of Uzbekistan is not connected by provisions of Item 1 of article 14 of the Contract in case of severe violations of balance of paying balance and serious difficulties with external financing of the Republic of Uzbekistan;

e) the matters of argument arising between Agreement parties and the Republic of Uzbekistan in case of realization of provisions of the Agreement will be solved on the basis of bilateral negotiations of the corresponding Agreement party and the Republic of Uzbekistan;

g) Agreement parties are not connected by provisions of Item 8 of Article 2, of the article 5, of article 10, of paragraph one of Article 11, of Article 12, of Item 1 of Article 14 and Article 17 concerning the Republic of Uzbekistan.
