About approval of Provisional regulations for the organization of participation of law enforcement officers of the Kyrgyz Republic in activities for maintenance of international peace and safety outside the Kyrgyz Republic

For the purpose of high-quality selection and the direction of law enforcement officers of the Kyrgyz Republic in peacekeeping organization missions of the United Nations the Government of the Kyrgyz Republic decides:

1. Approve the enclosed Provisional regulations for the organization of participation of law enforcement officers of the Kyrgyz Republic in activities for maintenance of international peace and safety outside the Kyrgyz Republic.

2. Determine that the expenses connected with implementation of the organization of participation of law enforcement officers of the Kyrgyz Republic in activities for maintenance of international peace and safety outside the Kyrgyz Republic become covered at the expense of budgetary funds of the relevant law enforcement agencies from which employees, and also other sources which are not prohibited by the legislation of the Kyrgyz Republic go.

3. To the Ministry of Internal Affairs of the Kyrgyz Republic in two-month time in accordance with the established procedure to develop and submit the corresponding projects of the regulatory legal acts of the Kyrgyz Republic following from this resolution for consideration of the Government of the Kyrgyz Republic.

4. To the Ministry of Internal Affairs of the Kyrgyz Republic, Public service of execution of punishments under the Government of the Kyrgyz Republic and Public service on control of drugs under the Government of the Kyrgyz Republic to bring the decisions into accord with this resolution.

5. Determine that the Provisional regulations are effective till March 31, 2014, but no later than effective date owing to regulatory legal acts which acceptance is stipulated in Item 3 presents of the resolution.

6. This resolution becomes effective from the date of official publication.

7. To impose control of execution of this resolution on department of defense, law and order and emergency situations of Government office of the Kyrgyz Republic.

Provisional regulations for the organization of participation of law enforcement officers of the Kyrgyz Republic in activities for maintenance of international peace and safety outside the Kyrgyz Republic

1. General provisions

1. These Provisional regulations determine procedure for the organization of participation of law enforcement officers of the Kyrgyz Republic in activities for maintenance of international peace and safety outside the Kyrgyz Republic, and also competence of state bodies of the specified sphere.

2. For the purposes of these Provisional regulations the following terms and determinations are used:

law enforcement agencies - the Ministry of Internal Affairs of the Kyrgyz Republic (further - the Ministry of Internal Affairs), Public service on control of drugs under the Government of the Kyrgyz Republic (further - GSKN), Public service of execution of punishments under the Government of the Kyrgyz Republic (further - GSIN);

law enforcement officers are the staff of law-enforcement bodies, the staff of monitoring bodies of drugs, the staff of bodies of criminal executive system of the Kyrgyz Republic (further - employees);

the national contingent - employee group of the law enforcement agencies of the Kyrgyz Republic directed in structure of police component of peacekeeping forces for accomplishment of tasks on providing law and order and public safety;

the civil police officer - the law enforcement officer of the Kyrgyz Republic from among militia personnel sent to the structure of police component of peacekeeping forces for accomplishment of tasks on providing law and order and public safety giving help to forces of local police on maintenance of legality and procedure;

preliminary selection and selection - complex of the events held by state bodies for the purpose of identification from number of persons employed of the law enforcement agencies corresponding on the moral and business qualities, level of training and the state of health according to requirements the United Nations (further - the UN), the regional international organizations (further - the international organizations);

training - complex of the actions directed to acquisition and enhancement of knowledge, skills necessary for the civil police officer;

medical examination - complex of the events held by state bodies in accordance with the established procedure for the purpose of determination of the validity of employees for health reasons to participation in activities for maintenance of international peace and safety.

3. Employees participate in peacekeeping missions according to the international treaties which came in the procedure established by the law into force which participant is the Kyrgyz Republic, legislative and other regulatory legal acts of the Kyrgyz Republic and these Provisional regulations.

2. Selection and training of employees as civil police officers

4. The main activities of the Ministry of Internal Affairs on ensuring participation of employees in peacekeeping missions are:

- selection and training of candidates;

- organization of their sending to peacekeeping missions;

- analysis and assessment of activities of the contingent of the Kyrgyz Republic;

- normative legal support of participation in peacekeeping missions;

- forming of reserve of participants of peacekeeping transactions.

5. Training of the employees directed as civil police officers for participation in activities for maintenance of international peace and safety, includes actions for carrying out preliminary selection, training and medical examination.

6. Preliminary employee screening, shown willingness to participate in activities for maintenance of international peace and safety as civil police officers, and also their special preparation are performed by personnel divisions of the relevant law enforcement agencies.

7. The employees who showed willingness to participate in activities for maintenance of international peace and safety as civil police officers (further - candidates) submit in accordance with the established procedure addressed to the head of the relevant law enforcement agency the official report.

Based on the submitted official report the head of law enforcement agency, taking into account recommendations of direct and immediate superiors, makes the decision on the admission of the candidate for passing of actions for preliminary selection.
