About approval of the Instruction for determination of cool qualification of staff of law-enforcement bodies of the Republic of Kazakhstan

For the purpose of implementation of the Presidential decree of the Republic of Kazakhstan of January 17, 2004 No. 1284 "About single system of compensation of employees of the bodies of the Republic of Kazakhstan containing at the expense of the government budget and the estimate (budget) of National Bank of the Republic of Kazakhstan", being guided by the subitem 16) of Item 12 of the Regulations on the Ministry of Internal Affairs of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of June 22, 2005 No. 607, I ORDER:

1. Approve the enclosed Instruction for determination of cool qualification of staff of law-enforcement bodies of the Republic of Kazakhstan (further - the Instruction).

2. To chairmen of committees, chiefs of departments and other structural divisions of Central office of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry of Internal Affairs), departments of internal affairs, departments of criminal executive system, the departmental organizations of formation of the Ministry of Internal Affairs to organize studying and to provide strict execution of requirements of this Instruction by staff of law-enforcement bodies of the Republic of Kazakhstan.

3. To department of financial provision of the Ministry of Internal Affairs and financial services of territorial authorities of internal affairs of the Republic of Kazakhstan (further - Department of Internal Affairs) annually to provide in expense budget assignment for employee benefit of Department of Internal Affairs of the monthly allowance to official pay rate for cool qualification according to the order of the Ministry of Internal Affairs of September 22, 2011 No. 492 "About single system of compensation of the military personnel, employees and administrative government employees of law-enforcement bodies of the Republic of Kazakhstan".

4. Territorial Department of Internal Affairs to provide to department of the back of the Ministry of Internal Affairs and services of logistic support employees with the corresponding breastplates and certificates.

5. To department of personnel work (Abdigaliyev A. U.) provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

6. To impose control of execution of this order on department of personnel work (Abdigaliyev A. U.).

7. This order becomes effective after ten calendar days after its first official publication.

Instruction for determination of cool qualification to the staff of law-enforcement bodies of the Republic of Kazakhstan

1. General provisions

1. This Instruction for determination of cool qualification of staff of law-enforcement bodies of the Republic of Kazakhstan (further - the Instruction) disaggregates conditions of assignment, confirmation, decrease and deprivation of cool qualification to faces of the private and the commanding structure of law-enforcement bodies of the Republic of Kazakhstan (further - employees) according to the level of mastering the specialty reached by them.

2. Carrying out testing for assignment of cool qualification is carried out for the purpose of mastering of professional knowledge, skills on post, increases in professional skill of employees taking into account specifics and profile of operational and service activity, fixing of personnel in services of law-enforcement bodies and creations of steady professional kernel in collectives.

3. To the staff of law-enforcement bodies of the Republic of Kazakhstan (further - the Department of Internal Affairs) taking into account the level of professional education, years of service (experience) of occupational work, professional training consistently appropriates the following cool qualifications:

"the specialist of the II class" - to the employees having years of service (experience) of occupational work in law-enforcement service at least 5 years, who passed tests by all types of professional office and physical training according to the established criteria for this cool qualification;

"the specialist of the I class" - to the employees having cool qualification "the specialist of the II class" and years of service (experience) of occupational work in law-enforcement service at least 7 years, who passed tests by all types of professional office and physical training according to the established criteria for this cool qualification;

"the specialist of the I class - the mentor" - to the employees having cool qualification "the specialist of the I class" and years of service (experience) of occupational work in law-enforcement service at least 10 years performing mentorship for one and more employees, from among young specialists and reappointed, and also passed tests by all types of professional office and physical training according to the established criteria for this cool qualification.

4. Length of service in the specialty for establishment of cool qualification shall be continuous.

5. When moving employees on one specialty cool qualification and defined benefit of the cash allowance remains.

6. When changing specialty (appointment to higher, equivalent, and also subordinate position, in case of transfer in other division if accomplishment of service duties on new position requires availability from the employee of additional or other knowledge and skills) cool qualification remains, and the cash allowance is paid for classiness after confirmation of cool qualification following the results of academic year according to Item 25 of this Instruction.

7. To persons which arrived to service to Department of Internal Affairs according to the procedure of transfer (sending out on business) from other law enforcement and special state bodies, the available cool qualification proves to be true following the results of academic year, payment of the cash allowance for classiness is made after confirmation of cool qualification according to Item 25 of this Instruction.

8. Cool qualification to persons recovered by a court decision remains, in other cases assignment of cool qualification is made according to Item 3 of this Instruction.
