Based on the paragraph of the twelfth of Article 9 and part five of article 63-6 of the Law of the Republic of Belarus of November 26, 1992 "About environmental protection" the Council of Ministers of the Republic of Belarus DECIDES: No. 1982-XII

1. Approve Regulations on procedure for transfer of typical and (or) rare natural landscapes and biotopes under protection to users of the parcels of land and (or) water objects it (is applied).

2. This resolution becomes effective since July 26, 2013.

Regulations on procedure for transfer of typical and (or) rare natural landscapes and biotopes under protection to users of the parcels of land and (or) water objects

1. This Provision determines procedure for transfer of typical and (or) rare natural landscapes, typical and (or) rare biotopes under protection to users of the parcels of land and (or) water objects.

The Ministry of Natural Resources and Environmental Protection (further – Ministry for Protection of the Environment and Natural Resources) will organize work on identification of typical and (or) rare natural landscapes, typical and (or) rare biotopes and their accounting within accomplishment of state programs in the field of rational (steady) use of natural resources and environmental protection, carrying out scientific and other research, monitoring of flora, maintaining the state inventory of flora, other actions for rational (steady) use of natural resources and environmental protection.

2. Identification of typical and (or) rare natural landscapes and biotopes is performed by the legal entity having specialists of the corresponding profile when carrying out scientific and other research, monitoring of flora, inspection of the territory (grounds) by it within maintaining the state inventory of flora, other actions in the field of environmental protection (further – the legal entity).

The fact of identification of typical or rare natural landscape, typical or rare biotope is fixed by the legal entity in the passport of typical or rare natural landscape which is drawn up in form according to appendix 1, or the passport of typical or rare biotope which is drawn up in form according to appendix 2 (further – the passport), within thirty calendar days from the moment of identification of such places. Along with the passport the legal entity draws up the security obligation in form according to appendix 3.

In case of identification of typical or rare natural landscape, typical or rare biotope in the territory of two adjacent regions of the passport are drawn up on each certain area.
