AGREEMENT BETWEEN THE GOVERNMENTS OF STATE MEMBERS OF THE SHANGHAI COOPERATION ORGANIZATION

About sci-tech cooperation

The governments of state members of the Shanghai Cooperation Organization (further - referred to as with the Parties),

aiming at cooperation increase, based on the principles of equality and mutual respect, to development and strengthening of friendship of state members of the Shanghai Cooperation Organization (further - SCO),

being guided by provisions of the Charter of SCO of June 7, 2002, and also other documents of SCO,

recognizing importance of need of enhancement of sci-tech cooperation between state members of SCO,

agreed as follows:

Article 1

The parties according to the national legal system of state members of SCO develop cooperation in the following directions:

- environmental protection and rational use of natural resources;

- sciences about life;

- agricultural sciences;

- nanosystems and materials;

- information and telecommunication technologies;

- power and energy saving;

- sciences about Earth, including seismology and geology;

- and other mutually agreed areas of cooperation.

Article 2

The cooperation in the directions called in Article 1 of this agreement is performed according to the national legal system of state members of SCO as on bilateral, and multilateral basis in the following forms:

- organization of scientific and technical researches;

- development and implementation of joint scientific and technical programs and projects;

- the organization and participation in scientific conferences, seminars and other events held within SCO;

- development and deployment of innovative technologies in the different fields of science;

- exchange of scientific and technical information;

- exchange of experts and scientists;

- other possible forms determined by the Parties by the mutual arrangement.

Article 3

The parties provide protection of the rights to results of intellectual activities acquired during implementation of this agreement according to the national legal system and international treaties which participants are state members of SCO.

Article 4

Carrying out conditions, financing of the joint actions, scientific and technical programs and projects specified in Article 2 of this agreement are approved in each case by the interested organizations of the states of the Parties.

Article 5

Coordination of cooperation on implementation of provisions of this agreement is performed by the permanent working group on sci-tech cooperation of state members of SCO created by the decision of meeting of heads of the ministries and departments of science and technology of state members of SCO and operating according to its regulations of work.

Article 6

For the purpose of implementation of separate provisions of this agreement of the Party sign the relevant protocols which are integral part of this agreement.

Article 7

By mutual consent of the Parties changes and additions which are its integral part can be made to this agreement and are drawn up by separate protocols.

Article 8

This agreement does not affect the rights and obligations of the Parties following from other international treaties which participants are their states.

Article 9

In case of the matters of argument and disagreements connected with interpretation and application of provisions of this agreement they are permitted by consultations and negotiations between the Parties.

Article 10

Working languages of cooperation within this agreement are the Russian and Chinese languages.

Article 11

This agreement is signed for a period of five years and becomes effective from the date of receipt by depositary of the last written notice of each of the Parties which signed it of accomplishment of the interstate procedures necessary for its introduction in force.

This agreement will be prolonged automatically for the subsequent five-year periods if the Parties do not make other decision.

Article 12

This agreement after its entry into force is open for accession to it of any state which became the member of SCO.

For the joined state this agreement becomes effective after 30 days from the date of receipt by depositary of the document on accession.

The depositary notifies the Parties on the date of entry into force of this agreement concerning the joined state.

Article 13

The either party can leave this agreement, having sent through diplomatic channels the written notice of it to depositary in 90 days prior to expected date of exit from this agreement. The depositary shall inform other Parties on this intention within 30 days from the date of receipt of the adequate notice.

Cancellation of this agreement does not affect the activities performed according to it begun but which are not completed before the termination of its action if the Parties do not agree about other.

Article 14

Depositary of this agreement is the Secretariat of SCO which will send to the Parties its verified copy within 7 working days after receipt of the original of the Agreement by the Secretariat.

It is made in the city of Bishkek on September 13, 2013 in one authentic copy in the Russian and Chinese languages, and both texts are equally authoritative.
