About production and the address of organic agricultural products and raw materials

This Law determines legal and economic basis of production and turnover of organic agricultural products and raw materials and is aimed at providing proper functioning of the market of organic products and raw materials, and also at ensuring confidence of consumers in the products and raw materials marked as organic.

Section I
General provisions

Article 1. Determination of terms

1. In this Law the stated below terms are used in such value:

production of organic products (raw materials) - productive activity of physical persons or legal entities (including on cultivation and conversion) where during such production use of agricultural chemicals, pesticides, the genetically modified organisms (GMO), preservatives and so forth, and at all production phases is excluded (cultivation, conversion) the methods, the principles and rules determined by this Law for receipt of natural (environmentally friendly) products, and also preserving and recovery of natural resources are applied;

organic raw materials - the raw materials received as a result of the certified production according to requirements of this Law and which goes for further use for receipt of new products;

organic products - products received as a result of the certified production according to requirements of this Law;

organic products of aquacultures - fish and other water live resources divorced and which are grown up in special artificial conditions or in the fishery water objects determined for this purpose according to this Law;

traditional (inorganic) products - products made according to all-acceptable production technologies of agricultural products where it is possible to use any chemical remedies, synthetic fertilizers, preservatives, artificial dyes, growth stimulants, hormones, antibiotics, fragrances, stabilizers, amplifiers of taste and so forth according to the legislation;

the paragraph of the seventh is excluded;

parallel production - simultaneous production of organic and traditional (inorganic) products;

transition period - the transition period from production of traditional (inorganic) products (raw materials) to production of organic products (raw materials);

hydroponic production - method of cultivation of plants in case of which their root is only in mineral nutrient solution or in the inert circle, such as perlite, gravel or mineral wool to which nutrient solution is added;

the paragraph the eleventh is excluded;

ingredient - any substance, including the food supplements, fragrances and enzymes constituting the ingredient used in case of production or preparation of foodstuff also remains in ready-made product even in the changed form. Remaining balance of veterinary medicines and pesticides is not considered as ingredient;

the paragraph the thirteenth is excluded;

the paragraph the fourteenth is excluded;

marking - words, descriptions, signs for goods and services, the names of trademark, the image or the symbols concerning some foodstuff and placed on any packaging, the label (sticker), consumer pack, the counterlabel, kolyeretka, label, stopper, the insert, the document, the message, other elements of packaging accompanying or relating to such foodstuff;

the paragraph the sixteenth is excluded;

the paragraph the seventeenth is excluded;

the register of producers of organic products - the list of persons which are granted the right to make (to grow up, process) organic products (raw materials);

test cultures - agricultural plants in which content of poisonous substances in case of inspection of the territory for assessment of its suitability of cultivation of organic products is determined;

the paragraph the twentieth is excluded.

2. The terms "the auditor on certification", "conformity assessment body", "assessment of conformity", "confirmation of conformity", "certificate of conformity" are used in the values determined in the Law of Ukraine "About confirmation of conformity".

Article 2. Law coverage

1. This Law governs the relations in the field of production and the address of organic products (raw materials) and extends to subjects of managing who conduct economic activity in this sphere, and on the organic products (raw materials) received according to requirements of this Law.

Article 3. The legislation of Ukraine in the field of production and realization of organic products (raw materials)

1. The legislation of Ukraine in the field of organic production consists of the Constitution of Ukraine, the Law of Ukraine "About protection of the surrounding environment", this Law and other laws of Ukraine, international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, other regulatory legal acts published according to it.
