1. Approve the Technique of assessment of objects of fuel and energy complex which are leased or concession it (is applied).

To provide to fund of state-owned property explanations concerning application of the specified Technique.

Technique of assessment of objects of fuel and energy complex which are leased or concession

1. This Technique is applied to cost determination of objects of fuel and energy complex which are leased or concession according to the Law of Ukraine "About features of lease or concession of objects of fuel and energy complex which are in state-owned property".

2. Assessment objects which cost is determined according to this Technique are separate inventory objects and groups of inventory objects on the lists approved with the Ministry of Energy which create or on the basis of which complete property complexes or systems of complete property complexes of the companies, their structural divisions (branches, workshops, sites) which provide can be created its conversions (are intended) and sufficient for carrying out economic activity in the field of production of coal and lignite (brown coal).

3. For cost determination of object of assessment independent assessment of property according to the Law of Ukraine "About assessment of property, property rights and professional estimative activity in Ukraine", national standards, the Technique of assessment of objects of the lease approved by the resolution of the Cabinet of Ministers of Ukraine of August 10, 1995 No. 629 is carried out (ZP of Ukraine, 1995, No. 12, Art. 276; Official Bulletin of Ukraine, 2003, No. 1, Art. 23), and this Technique.

4. Cost determination of object of assessment is performed at stage of its organizational technical training to transfer to lease or concession.

Under property of the companies which are the complete property complexes determined according to the paragraph the twelfth Item 3 of the National standard No. 1 "General valuation principles of the property and property rights" approved by the resolution of the Cabinet of Ministers of Ukraine of September 10, 2003 No. 1440 (The Official Bulletin of Ukraine 2003, No. 37, the Art. 1995) (further - the National standard No. 1), or system of complete property complexes which are transferred to concession and are subject to assessment, it is necessary to understand property (fixed assets, including construction in progress, intangible assets) which provides production of the corresponding products (creation of services) in industries of economy and it is included in the list of property which is included assessment object.

The Ministry of Energy provides creation of lists of property which is going to be transferred to concession, taking into account requirements of part five of article 3 of the Law of Ukraine "About concessions".

7. For cost determination of object of assessment for its transfer to concession of the Ministry of Energy:

determines date of assessment (date of inventory count);

addresses to Fund of state-owned property concerning carrying out competitive selection of the subject of estimative activities;

approves the lists of property constituted by results of inventory count of property which joins and is not included assessment object, in form according to appendices 1 and 2;

exercises control of preparation by the company, in economic vedaniye or operational management of which there are assessment objects (further - the company), the basic data necessary for assessment, and also transfer balance by results of inventory count;

signs (as the customer) the agreement on evaluating property with the company and subject of estimative activities which became the winner of competitive selection;

submits to Fund of state-owned property the valuation report of property on reviewing;

approves the conclusion about property value in the presence of the review of the appraiser who has at least biennial experience of practical activities according to property and works in Fonda of state-owned property who contains conclusion that the valuation report of property by results of reviewing is classified by the signs given in paragraphs second or third Item 67 of the National standard No. 1. Availability of such review and the approved (approved) conclusion about property value is the basis for preparation and signing of the delivery-acceptance certificate of works with the subject of estimative activities.
